510 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, January 07, 1926. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; absent, none. The Minutes of the last meeting were read and Councilman Haynes moved that the same be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The petition of Victor Gleckler, Attorney for Petitioners of the Esperanza School District, asking that same be taken in the city limits for school purposes only, was read. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the following emergency and provisional appropriations are made for the benefit of the several departments which they may serve: For Department "A", Mayor and Superintendent of Public Affairs-----$ 3,500.00 For Department "B", Revenue For Department "B", Sanitary For Department "D", City Hall 1,500.00 5,000.00 --- 1,800.00 For Department "C", Water, Light and Power Department 25,000.00 For Department "0", Sanitary Sewer Fund 4,000.00 For Department "D", streets - 18,500.00 For Department "E", Police 3,600.00 For Department "E", Fire ------- 15,000.00 For Department "A", Hospital 3,500.00 For Department "A", Sub-Department Public Health 400.00 For Public Health 250.00 For Parks 1,000.00 For General Fund (Contingent) 15,000.00 For Oakwood Cemetery 1,000.00 For Oakwood Annex 1,000.00 For Evergreen Colored Cemetery ------- 500.00 These appropriations are intended to be merely temporary and will be substituted by the appropriations of the General Budget, which, presumably, will be passed on or before the day of A. D. 1926. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Searight moved that the new cemetery purchased for colored people be known as "Evergreen Cemetery". Councilman Avery moved that bills against the Police Department, approximating $900.00, be allowed and the Superintendent of Receipts, Disbursements and Accounts be authorized to approve same. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The following reports were read and ordered filed: Public Health Nursing Board; Fred Sterzing, Assessor and Collector; Fred Sterzing, Assessor and Collector, for year 1925. Councilman Searight moved that he be authorized to purchase one 10-ton Caterpillar tractor for use of the Street Department. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Searight moved that the street disos on Rio Grande and West 12th Streets be removed. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Searight, 4; nayes, Councilman Nolen. The Council then recessed until 3:00 o'clock P. M. : AFTERNOON SESSION Present, Mayor Yett, Councilmen Avery, and Haynes, 3; absent, Councilmen Nolen and Searight, 2. J. J. Timmins, G. N. Holton, and Geo. C. Hawley, members of the State Fire Insurance Commission, appeared before the Council and made certain recommendations to the City with reference to re-locating fire stations with a view to reducing fire hazards. The Council agreed to comply with the request so far as possible. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: as of , That the sum of $2700.00 be and the same is hereby transferred date December 31, 1925, from the item specified as "Codifying city ordinances, under Sub-head No. 1, "A" Department of Public Affairs, as same appears in the General Budget of the City of Austin for the year of 1925, to the item specified as "Miscellaneous" under Sub-head No. 3, City Hospital, Department of Public Affairs, as same appears in said Budget. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $251.58 be and the same is hereby transferred, as of date December 31, 1925, from the item specified as "Stationery, postage, eto." under sub-head No. 1, "A" Department of Public Affairs, as same appears in the General Budget of the City of Austin for the year 1925, to the item specified as "Incidentals to be expended by the Mayor", as same appears in said Budget. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. Councilman Haynes introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of One Thousand Dollars ($1000.00) be and the same ів hereby transferred from the fund for Auditing Department, as appropriated in the Budget of 1925 under Department "B", to the item "Miscellaneous" in the Sanitary Department of said Department "B". !! 511 512 The foregoing resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, and Haynes, 3; nayes, none, Councilmen Nolen and Searight absent. The Minutes of the last meeting were read and Councilman Searight moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. W. L. Darnell, Superintendent of Palm School, appeared before the Council and asked that the city install traffic signals near the school on East First Street. Councilman Haynes moved that Councilman Searight be instructed to confer with the School Board with reference to the placing of such removable signs at Palm School and any other school they might deem proper. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The communication of Rev. J. N. Marshall, asking the City Council to fix a price for lease or sale of the old Reservoir site on East Avenue, was read and Councilman Haynes moved that it was the sense of the Council to decline to sell or lease said property at this time. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none, Councilman Avery moved that Robt. Rockwood and J. Woody be instructed to visit all buildings in the course of construction in the city and see that permits are issued for same. Councilman Avery introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and he is hereby authorized and directed to enter into contract on behalf of the City of Austin with Carl T. Widen, by the terms of which contract said Carl T. Widen shall agree to sell and the City shall agree to purchase the following described real property situated in the City of Austin, Travis County, Texas, to-wit, the E. 46 feet of Lote Nos. 2 & 7 in Blook No. 1 and all of Lot No. 1 in Block No. 23, for the consideration of $9500.00 and the assumption by the City of the payment of all taxes on said premises for the year 1926, said purchase price to be paid as follows: $2500.00 in cash on delivery of deed and the balance as evidenced by one certain vendor's lien note for the sum of $7,000.00, with interest from date at 8% per annum, and payable on or before December 31,1926; all upon condition that said Carl T. Widen shall furnish a complete abstract of title to said premises 'showing good and merchantable title to the same in him, provided, that if upon examination of said title by the City Attorney any objections to same are presented, :
