The claim of Scott & Gregg, Physicians, for services rendered F. M. Giles, City Fireman, was presented and Councilman Avery moved that same be referred to the Superintendent of Police. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. filed. The report of C. N. Avery for the month of February was read and ordered Bide of J. P. McDonald, Julius F. Johnson, Johnson Brothers, C.A.Maufrais Carl Knape, Ben Knape, and Austin Bridge Company, to build a storm sewer through Oakwood Cemetery were opened and read and Councilman Avery moved that same be referred to the City Engineer for his report back to the Council at ten o'clock Friday, March 12th, 1926. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The Council then recessed. Leonard, City Engineer, on bids for construction of storm sewer through Oakwood Cemetery was laid before the Council and Councilman Searight moved that the bid of Johnson Brothers be accepted as the best bid. Councilman Haynes introduced his annual report for the year 1925 as Superintendent of Receipts, Disbursements and Accounts. Councilman Haynes laid before the Council the following communication: To the Honorable Mayor and City Council, Gentlemen: "Austin, Texas, March 18, 1926. In reference to my annual report for 1925, I desire to congratulate the Administration and our Citizens on the small bonded debt and the generally 545 546 good financial condition of our City as shown by the report, which is a tribute to the Administration and the Commission Charter, under which Austin has s0 materially improved, and let hope that equally as good, or even better financial administration of the affairs of the City may prevail under the new form 'of Government adopted by the people and that Austin may continue to prosper. Respectfully, (Sgd) H. L. Haynes, Superintendent Receipts, Disbursements and Accounts." The application of Billy Ebner to erect electric signs at the Texan Hotel, West 7th Street, W. T. Farley, 916 Congress Avenue, and the Smart Shop, 106 East 6th Street, together with the Safety Committee's Report upon same, was read and Councilman Searight moved that same be granted, as recommended by the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Searight, 4; nayes, none, Councilman Nolen absent. Councilman Haynes introduced the following resolution: WHEREAS, in Cause No. 41380 in the District Court of Travis County, Texas, the City of Austin has sued John R. Lawrence and wife, Ida E. Lawrence, for taxes due the City of Austin on Lot No. 2 and the East 10 feet of Lot No. 1, in Block No.127 of the City of Austin for the years 1912 to 1923, both inclusive; and WHEREAS, defendante in said cause have made a proposition to the City to settle said taxes for the sum of One Thousand, Four Hundred, Twenty-three Dollars and Fifty-eight Oents ($1423.58) and to pay all costs in said suit, said proposed settlement being made upon the contention that the improvements on said property have been over-assessed for said years; and WHEREAS, the City Council has considered same and find that said improvements have been over-assessed for said years and that said offer of settlement is fair and equitable, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Attorney and J. W. Maxwell, Special Tax Attorney, be and they are hereby authorized and instructed to enter into an agreement with the defendants in said suit to settle said suit according to proposition above set out, and that such settlement be evidenced by an agreed judgment to be entered in said cause.
