550 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 01, 1926. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; absent, none. Mayor Yett moved that the reading of the Minutes of the last meeting be postponed. Motion prevailed by the following vote: Ayes, Mayor Yett, Counoilmen Avery, Haynes, Nolen, and searight, 5; nayes, none. Councilman Searight introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That hereafter all purchasers of lots or space in any of the cemeteries owned by the City of Austin shall be required to pay cash in full for all such purchases before using same and before a deed therefor is given to any such purchaser. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Haynes moved that the bid of V. O. Weed for ambulance service and coffins for white paupers for the period ending July 1st, 1926, be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The monthly reports of J. N. Littlepage, City Marshal, Mrs. R. C. Walker, Pure Food Inspector, and Miss Nellie M. Hall, Secretary United Charities, werе read and ordered filed. Councilman Searight moved that the resignation of Wiley Jones, colored, as City Sexton of Evergreen Cemetery be accepted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Searight nominated Willie Gordon as City Sexton to succeed Wiley Jones resigned. Nomination was confirmed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, and Nolen, 4; nayes, none, Councilman Searight present but not voting. The petition of A. Gans and other residents of 19th Street, asking that improvements be made was read and upon motion of Councilman Avery was referred to the Street Department. Mayor Yett introduced the following ordinance: AN ORDINANCE ORDERING AN ELECTION TO OBTAIN THE CONSENT OF THE QUALIFIED VOTERS OF THE CITY OF AUSTIN, TEXAS, TO THE ISSUANCE OF BONDS BY THE CITY COUNCIL FOR THE PURPOSES OF: (1) THE CONSTRUCTION AND IMPROVEMENT OF PUBLIC FREE SCHOOL BUILDINGS AND THE PURCHASE OF SITES AND EQUIPMENT THEREFOR; AND (2) THE CONSTRUCTION AND IMPROVEMENT OF HOSPITAL BUILDINGS AND THE PURCHASE OF EQUIPMENT THEREFOR. The above ordinance was read the first time and Councilman Avery moved that the rule be suspended and the ordinance be placed on its second reading. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. 1 The ordinance was read the second time and Councilman Avery moved that the rule be suspended and the ordinance be placed on its third reading and final passage. The ordinance was read the third time and Councilman Avery moved that same be finally passed. Councilman Searight moved that the reading of the Minutes of the last meetings be suspended. Motion prevailed, by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayee, none, Mayor Yett and Councilman Avery absent. Mrs. E. Raven appeared before the Council and asked that the city pay claim for damages to car. Couroilman Searight moved that same be referred to the City Attorney, J. Bouldin Rector, and Councilman Nolen for report back to the Council at its next regular meeting. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayes, none, Mayor Yett and Councilman Avery absent. The monthly reports of J. N. Littlepage, City Marshal, and the City Hospital were read and ordered filed. The communication of R. H. Kirby, informing the City Council that he intended to make certain repairs at 1400 Congress Avenue was read and Councilman Searight moved that same be referred to Oity Fire Marshal, Robert Rockwood, to see that permit was taken out for same. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayes, none, absent, Mayor Yett and Councilman Avery, 2. Councilman Searight introduced the following resolution: WHEREAS, on the plat of the Travis Heights Addition to the City of Austin, recorded in Plat Book No. 3, page No. 15, in the office of the County Clerk of Travis County, a space fifty (50) feet in width, resembling a street, but without name or designation, is shown intersecting Block No. Forty-nine (49) of said Addition; and WHEREAS, said space has never been used for street purposes, but was intended at the time of the recording of said plat as right-of-way for an Interurban Railway projected to run from the City of Austin to the City of Lockhart, which interurban railway project has long since been abandoned; and WHEREAS, O. 0. Norwood, a resident citizen of Austin, is now the owner in fee simple of all lots in said Block No. Forty-nine (49), and abutting upon said right-of-way space, and is also the owner of the fee simple title to said right-of-way space, and is in actual possession of said property, and 551
