Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The Council then adjourned. Jaetornsley Big Rewrit REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 8th, 1926. The Council was called to order by Mayor Pro tem Haynes. Roll call showed the following members present: Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; absent, Mayor Yett and Councilman Avery, 2. Councilman Searight moved that the reading of the Minutes of the last meetings be suspended. Motion prevailed, by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayee, none, Mayor Yett and Councilman Avery absent. Mrs. E. Raven appeared before the Council and asked that the city pay claim for damages to car. Couroilman Searight moved that same be referred to the City Attorney, J. Bouldin Rector, and Councilman Nolen for report back to the Council at its next regular meeting. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayes, none, Mayor Yett and Councilman Avery absent. The monthly reports of J. N. Littlepage, City Marshal, and the City Hospital were read and ordered filed. The communication of R. H. Kirby, informing the City Council that he intended to make certain repairs at 1400 Congress Avenue was read and Councilman Searight moved that same be referred to Oity Fire Marshal, Robert Rockwood, to see that permit was taken out for same. Motion prevailed by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayes, none, absent, Mayor Yett and Councilman Avery, 2. Councilman Searight introduced the following resolution: WHEREAS, on the plat of the Travis Heights Addition to the City of Austin, recorded in Plat Book No. 3, page No. 15, in the office of the County Clerk of Travis County, a space fifty (50) feet in width, resembling a street, but without name or designation, is shown intersecting Block No. Forty-nine (49) of said Addition; and WHEREAS, said space has never been used for street purposes, but was intended at the time of the recording of said plat as right-of-way for an Interurban Railway projected to run from the City of Austin to the City of Lockhart, which interurban railway project has long since been abandoned; and WHEREAS, O. 0. Norwood, a resident citizen of Austin, is now the owner in fee simple of all lots in said Block No. Forty-nine (49), and abutting upon said right-of-way space, and is also the owner of the fee simple title to said right-of-way space, and is in actual possession of said property, and 551 552 desires to utilize said entire Block No. Forty-nine (49), including such rightof-way space, as one unbroken tract, in connection with adjacent properties owned by the said Norwood; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That any rights or easments accruing to said City by virtue of the appearance of said right-of-way space in said Block No. Forty-Nine (49) of Travis Heights Addition, as shown on said plat above described, be and are hereby formally abandoned and released unto the said 0. 0. Norwood, owner as aforesaid of the fee simple title to all of Block No. Forty-Nine (49); and said right-ofway space is hereby declared to be closed for street purposes, and legal possession thereof is hereby formally delivered to the said 0. O. Norwood. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Haynes, Councilmen Nolen and Searight, 3; nayes, none, Mayor Yett and Councilman Avery absent. The communication of Hart & Patterson, Attorneys for Patton Transfer Company, asking refund on automobile license paid the city, was read and Councilman Haynes moved that same be referred to the City Attorney. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Nolen, 3; nayes, none, Councilmen Avery and Searight absent. The application of J. C. Bryant Creamery Company to hang an electrio sign at 117 West 5th Street was read and Councilman Haynes moved that same be referred to the Safety Committee. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Nolen, 3; nayes, none, Councilmen Avery and Searight absent. The application of Geo.
