REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, May 06, 1926, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; absent, none. The Minutes of the last meeting were read and Councilman Haynes moved that same be adopted. The reports of Fred Sterzing, Assessor and Collector, Mrs. R. C. Walker, Pure Food Inspector, Public Health Nursing Association, and A. S. Anderson, Public Weigher, were read and ordered filed. Councilman Avery moved that the fine assessed against Lonne Sabins for operating an automobile with one light, in the amount of $16.80, be remitted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Communication of Earl E. Simms; Agent for J. Novy, with reference to his property in the 1600 block on East 6th Street, offering to sell from ten to twenty feet frontage on East 6th Street, and rĂ¼nning back in a southerly direction between parallel lines to the south line of the now established passage way running east and west in said block, at a price of $125.00 per front foot, was read and Councilman Nolen moved that the City Attorney be instructed to file condemnation proceedings against said J. Novy, condemning sufficient width for an alley. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Searight introduced the following resolution: , WHEREAS, that there is in the progress of construction a building located at the corner of West Seventh Street and Colorado Street in the City of Austin, involving the expenditure of a large sum of money, and WHEREAS, there is now located at the corner of West Seventh Street and Colorado Street and at the corner of West Eighth Street and Colorado Street buildings which were constructed a great many years ago; and WHEREAS, it is the judgment of the City Council that a property line should be established between West Seventh Street and West Eighth Street and on the east side of Colorado Street in the City of Austin, Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN IN OPEN COUNCIL AT A REGULAR MEETING: , That the City of Austin hereby waivesany claim it has or may have against the owners of the building to be located at the corner of West Seventh Street and Colorado Street on LotsNo. 11 and 12 Block No. 83 of the original City of Austin for any real or supposed encroachment on said Colorado Street up to the line as hereby established, and further that the east line of Colorado Street be and the same is hereby established as the east line of Colorado Street between West Seventh Street and West Eighth Street as follows: FIRST: Establish the center line of Colorado Street by measuring 380 feet west from the west property line of Congress Avenue on East Eighth Street, and 380 feet from the west property line of Congress Avenue on Seventh Street. SECOND: Thence measure from the above established center line of 559 560 Colorado Street at right angles 37.5 feet and easterly to a point and the present building line on the Southeast corner of Eighth and Colorado Street intersection. THIRD: Thence measure from the above established center line of Colorado Street at right angles and Easterly 38.2 feet to a point and the present building line on the Northeast corner of Seventh and Colorado Street intersection. Thus establishing a straight line between the present buildings on the East side of Colorado Street between Seventh and Eighth Streets, and between said two points for the East line of Colorado Street. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The report of the Safety Committee upon the application of G. Flury to hang an electric sign at T. H. Williams Store was read and Councilman Avery moved that same be adopted as recommended by the Committee, Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. The Minutes of the last meeting were read and Councilman Haynes moved that same be adopted as read. Burkhart and other residents of 47th Street, Hyde Park, asking that 45th to 47th Streets be improved and made passable, was read and same was laid on the table. The communication of the Austin Air Service was read and laid on the table. Francis Fischer appeared before the Council and asked that drainage of his property in the 4500 block on East Avenue be made. The petition of G. M. Harris, asking for remission of fine for speeding assessed against him in the Corporation Court, was read and Councilman Nolen moved that said fine of $22.80 be remitted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Avery, Haynes, Nolen, and Searight, 5; nayes, none. Councilman Avery presented the claim of L. Soderberg for damages to his property at 119 West (th Street, in the sum of $82.75, and Councilman Searight moved that Councilman Avery be authorized to pay same upon proper release.
