582 RECESSED MEETING OF THE CITY COUNCIL: Austin, Texas, June 28, 1926. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Yett, Councilmen Haynes and Searight, 3; absent, Councilmen Avery and Nolen, 2. T. B. Trotter, of the firm of T. B. Trotter & Company, Auditors, appeared before the Council and presented ten copies of said firm's audit of the several departments of the city government. Councilman Haynes moved that the Auditors' report be received and filed. Motion prevailed by the following vote: Ayes Mayor Yett, Councilmen Haynes and Searight, 3; nayes, none, Councilmen Avery and Nolen absent. 0. P. Patterson and other residents of West 32nd Street appeared before the Council and protested against the placing of lights on said street. A. J. Zilker and George Dowell appeared before the Council in behalf of the citizens of the Tenth Ward and asked that a part of the old Barton Creek Bridge be placed over the creek at the intersection of Red River and Second Street. The application of the Gulf Refining Company, together with the Safety Committee's report upon same, for the erection of a gasoline filling station at 1818 Congress Avenue was read and Councilman Haynes moved that same be granted as recommended. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Searight, 3; nayes, none, Councilmen Avery and Nolen absent, Councilman Haynes introduced the following resolution: WHEREAS, at a hearing of the Board of Equalization of the City of Austin for the year 1922 in connection with protests of property owners regarding valuation of Austin city property for taxes for the year 1922, Oitizens Loan & Investment Company, a corporation, through its representative, complaied of the valuation placed on its property by said Board of Equalization, and a compromise agreement was reached by and between the representative of said corporation and said Board of Equalization that certain properties of said corporation should be rendered for taxes for the year 1922 at a general advance of 25 per cent over the valuation of said property fixed by the Board of Equalization for the year 1921, and a notation of said agreement was made by a member of said Board of Equalization on the face of the property rendition of said Citizens Loan & Investment Company for the year 1922; and : WHEREAS, it appears that in the making up of the tax rolls for the year 1922 by the City Tax Collector and Assessor, and his assistants, said notation and agreement was overlooked, and the properties of said Citizens Loan & Investment Company were erroneously placed on the tax rolls for said year 1922 at the value complained of by said corporation, and not the compromise values agreed upon by said Board of Equalization; Now, therefore, in consideration of the premises, and in order that the agreement of said Board of Equalization for the year 1922 with the representative of said corporation may be properly carried out, and the properties of said corporation be carried on the tax rolls of the City of Austin at the figures mutually agreed upon between said parties, be it resolved by the City Council of the City of Austin that the Tax Collector and Assessor of the City of Austin i be and is hereby authorized and instructed to make correction in the valuation of the properties of said Citizens Loan & Investment. Company as rendered for the year 1922, in conformity with the intentions and agreement by and between the Board of Equalization of the City of Austin, and said corporation as set out in the attached memorandum signed by C. N. Avery and A. W. Townsend, members of said City Board of Equalization for the year 1922. The above resolution was adopted by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Bearight, 3; nayes, none, Councilmen Avery and Nolen absent. The application of C. B. Kilpatrick to erect a gasoline filling station at 1506 East Ist Street, together with the Safety Committee's report upon same, was read and Councilman Haynes moved that same be granted. Motion prevailed by the following vote: Ayes, Mayor Yett, Councilmen Haynes and Seuright, 3; nayes, none, Councilmen Avery and Nolen absent. The Council then rеcеssеd. Councilman Haynes introduced the following resolution: WHEREAS, Geo. s. Dowell, as the Attorney for and representing Willie Donley and R. B. Wright, both service car drivers, or former service car drivers, has presented the respective claims of the above mentioned parties for the refund of all sums of money by the above mentioned parties for license for operating an automobile carrying passengers for hire in the City of Austin, Texas, under a void ordinance, a schedule of said claim and the respective amounts thereof and the time of respective payments with the certificate of the City Assessor and Tax Collector thereon being hereto attached and made a part hereof, showing the aggregate amount due the respective above named parties the sum of Thirty-seven Dollars and Fifty Cents ($37.50) as principal, and Seven Dollars and Sixty-eight Cents ($7.68) as interest, aggregating Forty-five Dollars and Eighteen Cents ($45.18) due to Willie Donley, and the sum of Three Hundred Fifty Dollars ($350.00) principal, and One Hundred and Twenty-two Dollars and Eighteen Cents ($122.18) as interest, aggregating Four Hundred and Seventy-two Dollars and Eighteen Cents ($472.18) due to R. B. Wright; and WHEREAS, by resolution adopted by the City Council on June 24th, 1926, City of Austin acknowledged the justice of the said claim and authorized the Mayor of the City of Austin to settle the said claims by giving the note or obligation of the City of Austin to said Willie Donley, due December 31, 1926, for the sum of Forty-five Dollars and Eighteen Cents ($45.18), and note to R. B. Wright, due December 31, 1926, for the sum of Four Hundred Seventy-two Dollars and Eighteen Cents ($472.18), Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 583
