REGULAR MEETING OF THE CITY COUNCIL: : Austin, Texas, July 16, 1926. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; absent, none. The Minutes of the last meeting were read and Councilman Mueller moved that same be adopted after the interlineation of the word, "temporary" before the words, "city manager", and the insertion of the initial "R" in the name of Adam Johnson. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. J. M. Patterson, Chairman of the Travis County Democratic Committee, appeared before the Council and asked for the use of Wooldridge Park for Thursday night, July 22nd, 1926. Permission was granted by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that all passes heretofore issued for use of Barton Springs be cancelled on and after this date, that no charge be made for entrance into the pool, but that the usual charge for lockers, etc., to remain the same as at present. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The application of R. H. Drenner to install a gasoline pump at the corner of Lavaca and West 6th Streets was read and same was referred to City Manager, Adam R. Johnson, by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The communication of the Board of Trustees of the Lutheran College, asking that the 50 foot street extending East from Red River Street to the Cameron Road be named Concordia Avenue was read and same was granted as requested by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that Councilman Reed be appointed a committee of one to confer with the City Attorney to arrange interest rate and other features of the $150,000.00 School Bond issue. The following communication of the Texas Power & Light Company, by W. B. Head, Chairman, was read: 593 594 "Austin, Texas, July 14, 1926. TO THE HONORABLE MAYOR AND BOARD OF COMMISSIONERS OF THE CITY OF AUSTIN, Austin, Texas. Gentlemen: On the 30th day of June, 1926, the City Council of the City of Austin passed an Ordinance proposed by the Texas Power & Light Company, wherein said Company, upon the terms and conditions therein mentioned, undertook and agreed to rebuild and complete the Austin Dam, and to supply to the City of Austin such electric power and energy as it required for the operation of its electric distribution system; and the City of Austin undertook and agreed to accept and pay for such power and energy not to exceed 50,000 Kilowatts, and called an election to be held on the the 31st day of July, 1926, to determine whether or said proposal should be accepted, and said Ordinance finally enacted. or not In its written Proposal of said Ordinance the Texas Power & Light Company expressly reserved the right to withdraw said Proposal at any time it saw fit, prior to the holding of such election; and you are here now advised that in the exercise of the right so peserved, the Texas Power & Light Company hereby withdraws said Proposal, and requests that your Honorable Body take appropriate action, noting and accepting such withdrawal. Mayor MoFadden laid before the Council the following ordinance: AN ORDINANCE TO REPEAL THE CERTAIN ORDINANCE PROVIDING THE TERMS OF A CONTRACT BETWEEN THE CITY OF AUSTIN AND THE TEXAS POWER & LIGHT COMPANY FOR THE COMPLETION OF THE AUSTIN DAM, AND THE FURNISHING OF ELECTRIC POWER TO THE CITY BY SAID COMPANY, AND PROVIDING FOR THE SUBMISSION OF SAID ORDINANCE TO A VOTE OF THE PEOPLE AT A SPECIAL ELECTION, TO BE HELD ON THE 318T DAY OF JULY, A.D. 1926, WHICH SAID ORDINANCE IS RECORDED IN BOOK "G"," AT PAGES 274 TO 296, INCLUSIVE, OR THE ORDINANCE RECORDS OF THE CITY OF AUSTIN. The ordinance was read the first time and Councilman Barker moved that the rule be suspended and the ordinance placed on its second reading. The ordinance was read the second time and Councilman Barker moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. City Manager Adam R. Johnson asked that the Council authorize him to pay note of the City of Austin given to F. C. Widen, also note of H. W. Nolen "in favor of Barker Motor Company, and that he be allowed to carry out, so far as : !! 4 possible, the verbal agreement of the former City Council with the Kiwanis Olub for the improvement of Pease Park, and that he be authorized to appoint one additional sanitary inspector. Councilman Reed moved that the above requests be granted and that City Manager Adam R. Johnson make such report of same as he sees proper. Mayor McFadden introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That there is hereby created an account, to be known as "Salary of City Manager", and the unexpended balances of the salary of Mayor, the salary of Superintendent of Department of Receipts, Disbursements & Accounts, the salary of Superintendent of Department of Water, Light & Power, the salary of Superintendent of Department of Streets, Public Property and Improvements, and salary of Superintendent of Police and Public Safety, as said items appear in the general budget of the City of Austin for the year 1926, be and the same are hereby transferred to the General Fund and credited to said account to be known as "0ity Manager's Salary", and the various appropriations in said budget .heretofore made for the respective salaries of said superintendents be and the same are each hereby repealed. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That in all cuses where it is estimated that the extensions of water or electric lines will not yield a gross income of twenty (20%) per cent or better on the investment in such extensions, the City Manager in authorized to contract with parties so situated and desiring water or electric light service to construct such extensions at the cost of such parties, said parties to he reimbursed by the City at the rate of five times the pross amount annun..ly realized by the City from the sale of water or electricity to patrons having a direct connection with such extensions, but provided that in no event shall the City make such annual refund payments longer than for ten years, regardless of whether or not the entire amount of costs has been refunded at the end of such period. 595
