612 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, September 30,1926. The Council was called to order by the Mayor. Roll call showed the following members pгesent: Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5 absent, none. The Minutes of the last meetings were read and adopted by the following vote: Ayes, Mayor Mofadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Mayor MoFadden offered the following resolution; which was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none: ******* RESOLUTION. After a long and efficient service as City Clerk, Joe Hornsby has passed beyond this life. As our tribute to his worth, we, the City Council, hereby express our esteem for his memory and our high estimate of him as a citizen and public servant. IT IS RESOLVED: That a page of the Minutes of this Body be set apart to record this expression, that same may be permanently and fittingly preserved in the public archives; and that a copy of this resolution be sent to the family of the deceased. 613 614 M. 0. Parrish, et al., appeared before the City Council in behalf of the Austin Public Library Association for permission to erect on the half block immediatelysouth of Wooldridge Park, ceded by the State of Texas to the City of Austin for library purposes, a temporary building to be used as a public library. Councilman Reed moved that the Council express itself as favorable to the proposition, but that a formal arrangement be made between the City and the Library Association and that the plans for, and erection of, said building be approved by the City Council and that the conduct of the library be under the supervision of, but without expense to, the City. Motion was carried by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that the application of Paul 0. Simma Company, Agents; for the installation of a drive-in filling station at the corner of Lavaca Street and 13th Street be laid over until the next regular session of the City Council for further consideration. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Marshall Bell, Attorney for Mrs. Fritiof Schneider, presented an application for correction of the assessment on her stock of merchandise for year 1925, which was referred to the City Attorney for attention Polk Shelton, representing the American Legion Travis Post No. 76, presented a request for the use of certain streets for Gray's Carnival Shows. T. H. Williams and others brought up an application heretofore filed with the City Council to pass an ordinance for one hour parking on the north side of West 5th Street between Congress Avenue and Colorado Street. The matter was referred to the City Manager and City Attorney for attention. A. Gustafson and H. A. Saunders appeared before the Council with reference to the opening of an alley in the 1800 block on East 6th Street. Councilman Barker moved that the matter be referred to the City Manager for thorough investigation and report back to the Council at the next regular meeting, together with his recommendation and plat of the property involved furnished by the Oity Engineer. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. C. B. Cook appeared before the Council to ascertain the future policy of the City with reference to maintaining its force of grave diggers. Councilman Reed moved that the City continue its present policy of maintaining such force, which motion carried by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, Councilman Barker. Councilman Barker moved that the Travis County Abstract & Title Company be granted the relief from taxation asked for in their petition under date of September 15, 1926. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Reed moved that W. A. Darter be granted the relief from taxation asked for in his petition to the City Council under date of September 25, 1926. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker nominated C. W. Councilman Reed moved that the claim of Dr. Schoch, in the amount of $55.00, for damages sustained by his daughter at Barton Springs, be not allowed and that the Oity Manager be directed to address letter to Dr. Schoch setting forth the City's attitude in this matter. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. , Councilman Barker moved that the City Council, having determined as its policy not to allow the use of the City's streets for the conduct of professional carnival shows, the application of the American Legion Travis Post No. 76 for use of the streets for Gray's Carnival Shows, be denied. Motion was seconded by Councilman Mueller, and carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that the claim of W. E. Dozier, in the amount of $304.19, for paving work on East and West 4th Streets, as per his claim filed with the City Council, upon recommendation of the City Attorney, City Engineer, and City Manager, be paid. Motion was seconded by Councilman Pannell, and carried by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; пауев,. none. Councilman Reed moved that the account of City Manager Johnson, in the amount of $116.38, as expenses of his trip to Colorado Springs in attendance upon the City Managers Convention, be approved and ordered paid. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that the resolution of the City Council, authorizing the payment of Five Hundred Dollars ($500.00) to Dr. Bolton for additional services, passed by the City Council on July 1st, 1926, be rescinded. Motion was seconded by Councilman Mueller and carried by the following vote: Ayes, Councilman Barker, Mueller, and Reed, 3; nayes, Mayor McFadden and Councilman Pannell. Councilman Pannell moved that the City Manager be authorized to rent to C. W. Harmon , a certain space on Red River Street for a fruit stand, it not being possible to use said space for street purposes. Motion was seconded by 616 Councilman Reed and carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Pannell moved that the Council notify W. B. Head that it will consider the TP&L matter at ten o'clock A. M., October 20th, 1926, and that a committee be appointed from the Council to formulate with him a proposal satisfactory to the Council. Motion was seconded by Councilman Barker and carried by the following vote: Ayes, Mayor MoFadden, Councilman Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Reed moved that the action of the City Manager in awarding the contract for steel shelving for the vault to Tobins, in the amount of $803.12, be approved Motion was seconded by Councilman Barker and carried by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Pannell, and Reed, 4; Councilman Mueller present but not voting. Councilman Barker moved that action on A. R. Hazard's application for an extension of water, light and sewer service to University Park Addition be deferred and that he continue negotiations with the City Manager with reference to same. Councilman Reed seconded the motion and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. H. W. Bull and others appeared before the Council with reference to automobile insurance for the City of Austin. Councilman Barker moved that the matter of placing such automobile insurance be referred to the City Manager for his ection thereon. Councilman Pannell seconded the motion and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Mayor McFadden laid before the Council the following resolution: RESOLUTION ESTABLISHING LOCATION FOR CURB LINE ON CONGRESS AVENUE AND NINETEENTH STREET FROM A POINT 75 FEET SOUTH 19 DEGREES WEST FROM THE SOUTH LINE OF NINETEENTH STREET ON CONGRESS AVENUE TO A POINT ON THE SOUTH LINE OF NINETEENTH STREET WHERE SAME IS INTERSECTED BY THE WEST LINE OF BRAZOS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the ourb line location at the southeast corner of the intersection of Congress Avenue and Nineteenth Street be established in accordance with the plan prepared by the Assistant Oity Engineer of Austin, Texas; said plan being herewith attached and marked Exhibit "A", and being more particularly described as follows: Beginning at a point on the west face of the existing curb on the east side of of Congress Avenue about 75 feet, South 19 degrees West from the south line of Nineteenth Street and from which point the city monument at the intersection of Congress Avenue and Nineteenth Street bears North 7 degrees & minutes east, 118.3 feet; Thence with a curving line a distance of 86.6 feet to an iron stake at the point of a compound curve, said curving line having a radius of 102.09 feet, and the long
