shall terminate, and the agreement to supply electric power and energy to the Oity of Austin shall be cancelled, and all parties shall be released and discharged from any and all obligations and liabilities imposed by the Ordinance 3. That the definition of the word "cost", appearing in Section 15, be so amended as to make it certain that all of the elements of cost to the Texas Power & Light Company of manufacture and supply of electric power and energy to the City of Austin be included. 4. Certain typographical errors should be corrected, and certain obscure and ambiguous provisions should be made certain, to which your attention will be directed later. Roll call showed the following members present: Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; absent, none. Members of the Austin Insurance Exchange, composed of A. H. Osburn, President, Chas. Wicker, Howard Bull and others, filed a protest with the Council against the awarding of an automobile insurance policy to an out-of-town concern. The committee were given a hearing, but no action was taken by the Council. В. А. Cox, representing the Texas Employers' Insurance Association, and Brown Robbins were heard with reference to Workmen's Compensation Insurance The matter was referred to the City Manager. representing the Woodward Body Works, Sam Sparks requested that the Council reconsider its action to discontinue allowing a rebate for water used for fire purposes at Penn Field, and also the placing of a sewer charge on Penn Field. The matter was deferred for further consideration. Miss Casis and Miss Ione Spears appeared before the Council with reference to taxes on lot owned by the University Y. W. O. A., requesting a remission of taxes for the years 1920 to 1925, inclusive. The matter was deferred for further consideration. Judge Chas. A. Wilcox and Dr. W. F. Bryan, representing the Board of Stewards of the First Methodist Church, appeared before the Council and requested an adjustment of the rendition for taxes on the Parsonage of the First Methodist Church. The Council expressed itself as being in favor of such action if it is found practicable to do so. Walter Durham appeared before the Council and requested a refund on water line extension made to his place east of Travis Heights some ten, or more, years ago. The Council took no action on the matter, except to advise said Durham that his claim was probably barred by limitation. 627 628 Mayor. Mayor MoFadden moved that Council recess, subject to call of the Motion was seconded by Councilman Pannell and carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Barker, Mueller, and Pannell, 4; absent, Councilmen Reed. The Mayor laid before the Council the amended milk ordinance for its second reading and Councilman Barker moved that the ordinance be further amended in several particulars and that the Council instruct the City Attorney to re-draft same, with all amendments, and present same for passage at the next meeting of the Council. Councilman Pannell seconded the motion and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, and Pannell, 4; absent, Councilman Reed. Mayor McFadden moved that the application of W. F. Smith for permit to build a gasoline filling station on Lot 1, Block 4, M. E. Whitten Addition to the City of Austin, same to be situated on West 34th Street between Wabash and McDonald Avenues, be granted subject to the following conditions: 1. That all buildings, gasoline storage tanks, pumps and other equipment shall be placed inside of the property line, and all buildings shall be constructed in compliance with the regulations governing building inside of the Fire Limits. : 2. That gasoline storage tanks and pumps shall be of an approved type and shall bear the label of the National Board of Fire Underwriters and shall be installed in compliance with the State and City regulations governing such installations. 3. That gasoline pumps and other service equipment shall be so placed that cars receiving supplies therefrom will not in any manner obstruct traffic on either sidewalk or street. 4. That lighting shall be done by electric lights, and all electric wiring shall be installed in metal conduit, under the supervision of the City Electrical Department. 5. That "NO SMOKING" signs shall be displayed at all times and no person shall be permitted to smoke or have any open flame on premises where gasoline is handled or sold. 6. That chemical fire extinguisher shall be provided for emergency use. 7. That permission shall be granted subject to the above conditions, and that the present and future regulations, rules and ordinances of the City of Austin, Texas, applying to or regulating auto filling stations and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper , pres present, future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said W. F. Smith has failed and refused and will continue to fail and refuse to perform any such conditions, regulations or ordinances. Councilman Pannell seconded the above motion and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, and Pannell, 4;. nayes, none, Councilman Reed absent. Smith to install a gasoline filling station at the northwest corner of the intersection of Concordia and East Avenues, be granted subject to the following conditions:
