REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, November 12,1926, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Barker, Mueller, and Pannell, 4; absent, Councilman Reed. The Minutes of the last meeting were read and same were adopted by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, and Pannell; 4; nayes, none, Councilman Reed absent. Councilman Reed entered the Council Chamber. John F. Johnson, Contractor for the Nalle Building to be erected at 8th and Congress Avenue, appeared before the Council and submitted plans for the construction of said building. The Council took same under advisement. M. C. Parrish appeared before the Council and asked that the City Council adopt a policy with reference to the taxation of properties developed for the purpose of subdivision and sale of lots. The matter was taken under advisement. A committee from the Austin Safety Council, composed of Eldred McKinnon and others, appeared before the Council and asked that the Council designate the week of December 5-11 as "Safety Week", and also that they be granted permission to have a parade on the streets of the City during that week. Councilman Reed moved that the above requests be granted and that the Mayor issue a proclamation calling for the observance of "Safety Week". Motion was seconded by Councilman Barker and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. R. C. Walker, Attorney, presented a request for reconsideration by the Council of their refusal to grant a permit for the erection of a filling station at 1818 East 6th Street. The matter was referred to the City Manager and Safety Committee for investigation and report back to the Council at their next regular meeting. : Mayor McFadden introduced the following ordinance: AN ORDINANCE FIXING AND LEVYING MUNICIPAL TAXES FOR THE CITY OF AUSTIN, TEXAS, FOR THE YEAR A. D. 1926. The ordinance was read the first time and Councilman Reed moved that Kotion the rule be suspended and the ordinance placed on its second reading. prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes; none. The ordinance was read the second time and Councilman Barker moved a further suspension of the rule and the ordinance placed on its third reading and final passage. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The ordinance was read the third time and Councilman Barker moved that same be finally passed. Yotion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: Application having been made by Mrs. J. E. Pickle for the execution 1 2 , by the City of a quitclaim deed to the S. W. Quarter of Cemetery Lot No.494, hereinafter described; and it appearing upon showing that said property was conveyed by the City of Austin by its then Mayor, on May 12, 1885, to said Mrs. J. E. Pickle, by deed duly executed; and it further appearing that said deed was never recorded, and that same cannot now be recorded by reason of same not having been acknowledged; and that on such showing made, said app11cation should be granted, Therefore, BE IT RESOLVED: That the City Manager of the City of Austin be and he is hereby authorized and instructed to execute and acknowledge quitclaim deed to said Mrs. J. E. Pickle as to said Southwest Quarter of Cemetery Lot No. 494, as described upon the plot or map of the Cemetery of the City of Austin, in Travis County, Texas, now known as "Oakwood Cemetery". Councilman Reed moved that the above resolution be adopted. Motion was seconded by Councilman Barker and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: , Application having been made by J. B. Riley for the execution by the City of a quitclaim deed to Cemetery Lot No, 121, hereinafter described; and it appearing upon showing that said property was conveyed many years ago by the City to J. R. Brizendine and wife; that the deed was lost and never recorded; that both of said parties together with other members of their family, are buried thereon and that same has been used as the family burial ground of said Brizendine family for a long number of years, forty years or more; and it further appearing that said J. B. Riley is an heir of said J. R. Brizendine and wife; that he is in possession of said property and seeing to the care and preservation thereof; and that on such showing made, said application should be granted; THEREFORE, BE IT RESOLVED: That the City Manager of the City of Austin be and he is hereby authorized and instructed to execute and acknowledge quitclaim deed to said J. B. Riley as to said Cemetery Lot No, 121, as described upon the plot or map of the Cemetery of the City of Austin, in Travis County, Texas, now known as "Oakwood Cemetery". Councilman Reed moved that the above resolution be adopted. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE AMENDING SECTIONS ONE AND ELEVEN OF AN ORDINANCE ENTITLED "AN ORDINANCE REQUIRING CONNECTION OF THE SANITARY SEWER SYSTEM OF THE CITY OF AUSTIN IN CERTAIN CASES, REGULATING THE USE OF SANITARY SEWERS AND DRAINS, DECLARING THE CONSTRUCTION AND MAINTENANCE OF CESSPOOLS AND SURFACE CLOSETS A NUISANCE IN CERTAIN CASES, AND PRESCRIBING PENALTIES FOR THE VIOLATION OF THE TERMS OF THIS ORDINANCE", PASSED BY THE CITY COUNCIL ON FEBRUARY 20, 1914, AND RECORDED IN ORDINANCE BOOK "F PAGES 531-534 OF THE ORDINANCE BOOKS OF SAID CITY; REPEALING OF ORDINANCES IN CONFLICT HEREWITH AND PRESCRIBING PENALTIES. , The ordinance was read the first time and Councilman Barker moved that the rule be suspended and the ordinance placed on its second reading. Councilman Barker moved that the Council approve the plan of group insurance for city employees, as presented by the Missouri State Life Insurance Company, and that the City Manager be authorized to co-operate with the agent of said company in putting the plan into operation. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. Councilman Barker moved that City Manager Johnson's request for leave of absence from December 4th to December 11th, inclusive, be granted and that City Attorney, J. Bouldin Rector, be designated to act as City Manager during the absence of City Manager Johnson. Motion prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Barker, Mueller, Pannell and Reed, 5; nayes, none. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: , That the sum of Fifteen Thousand Dollars ($15,000.00) be and the same is hereby transferred from the Earnings Fund of the Water, Light and Power Department to the General Fund of the City of Austin. , Councilman Reed moved the adoption of the above resolution. Motion was seconded by Councilman Barker and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The report of the United Charities for the month of September, 1926, was received and ordered filed.
