REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, December 16,1926, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller and Pannell, 3; absent, Councilmen Barker and Reed. Mayor McFadden stated that the reading of the Minutes would be deferred until later in the meeting and the committees present would be heard. A committee from the United Charities, composed of A. C. Baldwin, Dr. W. R. Minter, Mrs. Forrest Farley, Miss Nellie M. Hall and Miss Nell Baker, were then heard in the matter of an adjustment of the work said organization and the City Department of Public Welfare. The committee requested the Council to continue the present financial support being given said organization until the beginning of their next fiscal year in October, 1927. The Council took the matter under advisement. Mayor McFadden laid before the Council for its third reading the following ordinances AN ORDINANCE CREATING THE CITY PLAN COMMISSION AND DEFINING ITS MEMBERSHIP, PURPOSES AND FUNCTIONS. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Kueller, and Pannell, 3; nayes, none, Councilmen Barker and Reed absent. Councilman Mueller moved that the City Manager and City Clerk be authorized to open the election boxes containing returns of the School Bond Election held June 25th, 1926, in order to make certified copies of the original returns to the Attorney General in his examination of the School Bond Record Transcript. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Pannell, 3; nayes, none, Councilmen Barker and Reed absent. City Manager Johnson laid before the Council a request from the Chamber of Commerce, asking the City to furnish extra lighting for the Community Christmas Celebration, and advised that the cost of same would be about $140.00 and that the City could salvage about one-half of this amount after the celebration was over. The Council agreed that the request should be granted. Councilman Mueller moved that, owing to the inability of the residents along Duval Street to come to an understanding with reference to the paving of said street, the City Manager be authorized and instructed to return, unopened, all bids received for the paving of said street and express to the contractors the thanks of the Council for such bids. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Pannell, 3; nayes, none, Councilmen Barker and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, the owners of property abutting on Laurel Lane, between Speedway and Hemphill Park, have petitioned the City to prepare a gravel foundation and drainage system for said street, in consideration of which said property-owners will pay the entire expense of topping said street with asphalt; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and instructed to advertise for bids for topping said street with asphalt in accordance with the specifications prepared by the Assistant City Engineer, and that he accept the lowest and best bid therefor, and that he proceed with the work of improvement of said Street, upon being assured in his judgment and discretion of the full payment by said property-owners of the cost of topping same as aforesaid. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Pannell, 3; nayes, none, Councilmen Barker and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, the property described as Lots 31 and 31, of Outlot 35, in Division "D", in the City of Austin, Texas, has heretofore been assessed for city taxes for the year of 1912; and WHEREAS, during said year said property was owned, occupied and used by the University Young Men's Christian Association, and for the said reason should have been exempted from taxation for said year; and WHEREAS, on account of such fact, said property has been exempted from taxation for all years subsequent to said year 1912 and in accordance with the State statute relating thereto; now, therefore, , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Tax Assessor and Collector be and he is hereby authorized and instructed to strike from the tax rolls of the City for the year 1912 said Lots 31 and 314, of Outlot 35, in Division "D", and to cancel the taxes assessed and levied for said year against the University Young Men's Christian Association, as the owner of said property, and that said City Tax Assessor and Collector take credit therefor in accordance with the terms of this resolution. Councilman Mueller moved that the above resolution be adopted. Motion prevailed by the following vote: Ayes, Mayor Moradden, Councilmen Mueller and Pannell, 3; nayes, none, Councilmen Barker and Reed absent. Councilman Reed entered the Council Chamber. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $15,000.00 be and the same is hereby transferred from the Earnings Fund of the Water, Light and Power Department to the credit of the General Fund of the City of Austin. Councilman Pannell moved that the above resolution be adopted. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE REGULATING TRAFFIC ON THE STREETS OF THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PRESCRIBING PENALTIES. The ordinance was read the first time and Councilman Pannell moved that the rule be suspended and the ordinance placed on its second reading. Motion prevailed by the following vote: Ayes, Mayor HoFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. The ordinance was read the second time and Councilman Pannell moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. The Mayor laid before the Council the following ordinance: AN ORDINANCE AMENDING SECTION 3 AND SECTION 7 OF THE CERTAIN ORDINANCE ENTITLED "AN ORDINANCE AUTHORIZING THE ISSUANCE OF THE SCHOOL BONDS OF THE CITY OF AUSTIN, TEXAS, TO THE AMOUNT OF ONE HUNDRED AND FIFTY THOUSAND DOLLARS, AND PROVIDING FOR THE PAYMENT THEREOF. The ordinance was read the first time. On motion of Councilman Barker, the rule was suspended and the ordinance was passed to the second reading by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The ordinance was read the second time and on motion of Councilman Barker the rule was suspended and the ordinance passed to the third reading by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Mueller, Pannell, and Reed, 5; nayes, none. The ordinance was read the third time, and on motion of Councilman Barker was passed finally by the following vote: Ayes, Mayor NoFadden, Councilnen Barker, Mueller, Pannell, and Reed, 5; nayes, none.
