16 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas. December 23,1926, The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Pannell and Reed, 3; absent, Councilmen Barker and Mueller, 2. The Minutes of the last meetings were read and Councilman Reed moved that same be adopted. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Pannell and Reed, 3; naynes, none, Councilmen Barker and Mueller absent. Councilman Barker entered the Council Chamber. Councilman Reed moved that the Council recess. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell, and Reed, 4; nayes, none, Councilman Mueller absent. Motion was seconded by Councilman Reed and same carried by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. 0. H. Page appeared before the Council with reference to the use of concrete sewer pipe in the construction of sanitary sewers. The Council instructed the City Attorney to amend the ordinance governing the character of material to be used in sanitary Bewers so that same shall hereafter provide for the use of other satisfactory material also. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT in all cases where it is necessary to extend the City's water lines, electric lines and sanitary sewer lines beyond the corporate boundaries of the City of Austin in order to serve any person or property, the City Manager is authorised to contract with the parties so situated and desiring any such service to construct such extensions from the City boundaries to the point desired, conditioned that said party shall pay the entire cost of construction, and upon the completion of said work shall convey to the City of Austin the absolute title of same; provided, that nothing herein is intended to alter or amend the terms of a certain resolution heretofore passed providing for the extensions of certain water lines within the city limits, as insofar as said resolution applied to such extensions within the city limits, nor shall this resolution alter or amend the terms of the certain resolution heretofore passed, prescribing the rates to be charged for such service to persons and property outside of the corporate boundaries. Y Councilman Reed moved the adoption of the above resolution. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE REGULATING TRAFFIC ON THE STREETS OF THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PRESCRIBING PENALTIES. The ordinance was read the first time and Councilman Reed moved that the rule be suspended and the ordinance placed on its second reading: Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. The ordinance was read the second time and Councilman Reed moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. The ordinance was read the third time and Councilman Reed moved that same be finally passed. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, West 60 feet of Lot 18, Block "B", Outlot 3, Terrace Park, City of Austin, was assessed for city taxes in the name of Martha F. Kamrath for the year 1926, at a valuation of $1665.00; and WHEREAS, it has been made known to the City Council that the valuation placed upon said property was an error, and that the proper 17 18 valuation thereof for taxing purposes should have been $800.00; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the assessment of said property be corrected from the present valuation of $1665.00 as placed on same for taxes for the year 1926, so as to make same at the assessed valuation of $800.00, and that the City Tax Assessor & Collector be and he is hereby instructed to change his rolls according to this correction, and to take credit therefor. Councilman Reed moved that the above resolution be adopted. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. Mayor NoFadden laid before the Council the following resolution: WHEREAS, the stock of merchandise of Union Cigar and News Company, situated at 106 West 6th Street, Austin, Texas, was assessed for taxation at a valuation of $2200.00 for the year 1926; and WHEREAS, it has been made known to the City Council that said assessment is erroneous and that said stock of merchandise should have properly been assessed at $1160.00; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the assessment of said stock of merchandise be corrected from the present valuation of $2200.00 placed on same for the taxes for the year 1926, so as to make same at the assessed valuation of $1160.00, and the City Tax Assessor & Collector be and he is hereby instructed to change his rolls according to this correction, and to take credit therefor. Councilman Mueller moved the adoption of the above resolution. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. City Manager Johnson laid before the Council the request of the Trades Council for a reduction of one-half in their bill for $146.00, same being electricity used by them in staging a carnival, the proceeds of which were given to the poor of the city. Councilman Reed moved that one-half, of $75.00, of said amount be remitted. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. Councilman Reed moved that City Manager Johnson be authorized to prepare a schedule of rates revising the present light and power rates for the purpose of reducing same and present his report to the City Council as soon as practicable, it being desired that said revision shall take effect on February 1st, 1927. Councilman Pannell seconded the motion and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. Judge Ed R. Kone, Judge of the Corporation Court of the City of Austin, appeared before the Council and requested that the fine and costs assessed against W. M. Todd for speeding, under a former administration, and still unpaid on the books of the Corporation Court, be remitted. Councilman Pannell moved that said W. M. Todd be requested to appear before the Council at their next regular meeting to show cause why such remission should be made. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilmen Barker absent. 1 Mayor McFadden moved that Judge Ed R. Kone be granted a leave of absence from Thursday, December 30th, 1926, until Monday, January 3, 1927. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nayes, none, Councilman Barker absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, the City Tax Assessor and Collector has this day submitted to the City Council the tax rolls of the City of Austin for the year 1926, which rolls show an aggregate amount of $40,045,516.00 of valuation of property assessed for taxes for said year, and an aggregate amount of $878,092.91 levied as taxes for said year; and WHEREAS, said tax rolls appear in all respects in correct form, the valuations contained in said rolls having been examined and corrected by the Board of Equalization, which has made its report to the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said tax rolls for said year be and the same are hereby approved. Councilman Pannell moved that the above resolution be adopted.
