60 estate on which said improvements are situated, provided the proper corrections are made in said assessments; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: SECTION 1, THAT the assessments of the improvements on Lot 21 and S. 1/2 of 22, Block 7, Hyde Park Annex, be corrected as follows: for 1922, $300.00; for 1923, $275.00; for 1924, $250.00; for 1925, $200.00; and for 1926, $175.00. SECTION 2. THAT the assessment of the improvements on Lot 23, and N. 1/2 of 22, Block 7, be corrected as follows: for 1922, $100.00; for 1923, $75.00; for 1924, $50.00; for 1925, $50.00; and for 1926, $25.00. SECTION 3. THAT the City Tax Assessor & Collector be and he is authorized and instructed to make the above changes on his rolls and take credit therefor. Councilman Pannell moved that the above resolution be adopted. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell, and Steck, 4; nayes, none, Councilman Reed absent. City Manager Johnson laid before the Council a petition from the residents on Eleventh Street from San Jacinto to Red River Streets, asking for the paving, with permanent paving, of said street, and agreeing to pay for the cost of paving if the City would pay for the street intersections. After a discussion as to the cost of such paving, the Council instructed City Manager Johnson to ascertain if the property owners would agree to the paving of said street with 14" asphalt paving, and if so to proceed at once with the work on said street. Mayor McFadden laid before the Council the proposed budget of the City, which had been read at the previous meeting and laid over. Action on same was deferred until the next regular meeting. Councilman Barker moved that the Council recess, subject to call of the Mayor. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell and Steck, 4; nayes, none, Councilman Reed absent. The Council then recessed. O.A. Roll call showed the following The Council was called to order by the Mayor. members present: Mayor McFadden, Councilmen Pannell, Reed, and Steck, 4; absent, Councilman Barker. The Minutes of the last meeting were read and same were adopted by the following vote: Ayes, Mayor McFadden, Councilmen Pannell, Reed, and Steck, 4; nayes, none, Councilman Barker absent. Councilman Barker entered the Council chamber. A committee from the Citizens Health Council, composed of F. W. Sternenberg, 7. E. Long, F. E. Giesecke, and E. T. Manlove, appeared before the Council and requested that the Council include in its budget for the current year liberal appropriations for tuberculosis and mosquito control work. Sam Sparks and J. A. Nichols, representing the Woodward Body Works, requested that they be granted some concession in the way of a reduction in the power used , at Penn Field by reason of the City's action, under a former administration, in allowing St. Edward's College and other parties to connect to the sanitary sewer line owned by them.outside of the city limits. After a discussion of the matter, Councilman Barker moved that the City Manager be instructed to issue no permits for sewer connection on the Penn Field line outside of the city limits for the present until further instructions are obtained from the City Council; provided that this ruling shall not affect the original contracts for easements from property owners.. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilman Barker, Pannell, Reed, and Steck, 5; nayes, none. City Manager Johnson presented to the Council a communication from O. E. Metcalfe, showing test made on concrete and clay tile sewer pipe. Mayor McFadden moved that the City Attorney, City Engineer, and City Plumbing Inspector, working together, prepare an ordinance amending the present ordinance specifying the character of material for sanitary sewer purposes, which ordinance shall adopt the specifications recommended by the American Society for Testing Materials and safeguarding the City's interests in permission of the use of sanitary sewer pipe and specifying special forms of concrete pipe to connect with vitrified clay pipe and specifying special requirements as to chemical tests. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell, Reed, and Steck, 5; nayes, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, on February 3, 1881, a sale was made by the City Tax Collector of Lots 1 to 12, inclusive, in Block 4, Outlot 4, Division "A" of the City of Austin as the property of D. X. Wilson, to satisfy taxes on said property for the years 1873 and 1874, and deed therefor made to the City of Austin, which is recorded in Volume 51, page 465 of the Deed Records of Travis County, Tехав; and WHEREAS, said taxes have been paid and the City of Austin claims no interest in said property by virtue of said sale, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mayor be and he is hereby authorized to execute to the said D. The application of Ewell Nalle to install a 1500 gallon fuel oil tank under the sidewalk in front of the building now being erected by him on Brazos Street just north of the Driskill Hotel, was read and Mayor McFadden moved that the application be referred to the City Manager and Safety Committee for their report back to the Council. Motion prevailed by the fol- lowing vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell, Reed, and Steck, 5; nayes, none. The application of B. H. Williams, Agent for Gulf Refining Company, asking for permission to install a gasoline pump and tank at Weet 2nd and Colorado Streets, together with the report of Safety Committee upon same, was 61 62 read and Councilman Reed moved that same be granted, subject to the conditions set forth in said report. Mayor HoFadden laid before the Council the following ordinance: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE DECLARING WHEN TAXES DUE THE CITY OF AUSTIN SHALL BECOME DELINQUENT, PROVIDING THAT SAME SHALL THEREAFTER BEAR INTEREST, ASSESSING A PENALTY FOR DEFAULT THEREAFTER, AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE. The above ordinance was read the first time and Councilman Reed moved rule be suspended and the ordinance placed on its second reading. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Barker, Pannell, Reed, and Steck, 5; nayes, none. The ordinance was read the second time and Councilmen Reed moved a further suspension of the rule and the ordinance placed on its third reading. The report of the City Manager for the six months ending December 31,1926, including a financial report of the City's business for said period, was received and ordered filed for record, and Mayor McFadden moved that the City Manager be directed to arrange for publication of said reports in the public press, and also provide for publication of said reports and budget in pamphlet form for general distribution. City Manager Johnson laid before the Council for approval expense account of Walter Seaholm, City Electrician, in the amount of $59.35, incurred in his visit to Dallas, January 16th to 20th, 1927, on official business. The Council instructed the City Attorney to prepare proper resolution authorizing the Mayor to purchase for the City of Austin a strip of ground adjacent to its power plant between West Avenue and Bowie Street, owned by Tom Iglehart, for the sum of $25000.00.
