130 Councilman Steck moved the adoption of the foregoing resolution. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Council then recessed, subject to call of the Mayor. REGULAR MEETING OF THE CITY COUNCIL: addr Mayor. Austin, Texas, June 16, 1927. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; absent, none. The Minutes of the last meeting were read and Mayor McFadden moved that same be amended by adding after the last word of the last line of the resolution correcting the assessment on Lots 1 and 5, Outlot 66, "Valley View Addition to the City of Austin", the words, "and said Tax Assessor and Collector is further instructed to change his tax rolls in accordance with such assessment". Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Kayor McFadden moved that the Minutes be further amended by adding after the last word of the last line of the resolution correcting the assessment on Lots 4,5, and 6, Block 30, Hyde Park Addition #1, the words, and said Tax Assessor and Collector is further instructed to change his tax rolls in accordance with such assessment." Trenckmann and others were heard with reference to the repeal of the ordinance recently passed calling for one-hour parking on East 10th Street from Congress Avenue to the alley running parallel with Congress Avenue and Brazos Street. After hearing the protests, it was the opinion of the Council that the ordinance should not be repealed and Councilman Steck moved that the City Manager be instructed to make such adjustments with the protesters as was practicable. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. A committee, composed of Fred C. Morse, Hugo Kuehne, Mrs. S. J. Smith and other abutting property owners, asking that Duval Street be paved with 14" Uvalde Rock Asphalt, and Judge James A. King, representing some of the abutting property owners asking for a cheaper type of paving, were heard. After a lengthy discussion, the Council requested the committees to get together and adjust their differencев and resubmit their proposition to the Council. Judge James R. Hamilton entered a protest against the closing of the entrance to his property by the owners of Shoal Crest Addition and asked that the Council take this matter into consideration before adopting the plat for said Shoal Crest Addition. Horace Barnhart, on behalf of the Lions Club, submitted a resolution to the Council calling for the creation of a Recreation and Playgrounds Department for the City of Austin. The resolution was received and referred to the City Attorney for examination and approval. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That for reasons deemed sufficient, the costs in the following numbered causes, convicted in the Corporation Court of the City of Austin for violation of minor traffic laws, such as signal light ordinance, onehour parking ordinances, double parking, parking adjacent to the University Campus, etc., be and the same are hereby remitted: No. 22,285 - No. 23,415 - No. 23,426 - No. 23,440- No. 23,467 - - No. 23,483 - No. 23.484 No. 23,485 - - No. 23,486 No. 23,496 No. 23,534- No. 23.548 - No. 23,570 - - H. Mayor McFadden moved that a permit be granted to J. L. Smith to erect a gasoline pump at 2216 Guadalupe Street in accordance with the following recommendation of the Safety Committee: "Austin, Texas, Hon. Mayor and City Council, City of Austin, Texaв. Gentlemen: We, your committee appointed to investigate the application of J. L. Smith, requesting permission to erect and operate a drive-in gasoline filling station at 2216 Guadalupe Street, make the following report: We recommend that this permission be granted subject to the following conditions: 1. That all buildings, gasoline storage tanks, pumps and other equipment shall be placed inside the property line. 2. That gasoline storage tanks and pumps shall be of an approved type and shall bear the label of the National Board of Fire Underwriters, and shall be installed in compliance with State and City regulations governing such installations. 3. That gasoline pumps and other service equipment shall be so placed that cars receiving service therefrom will not in any manner obstruct traffic on either sidewalk or street. 4. That all lighting shall be by electric lights and all wiring done under the supervision of the City Electrical Department. 5. and no person permitted to smoke or have any open flames on premises where gasoline is sold or handled. That "NO SMOKING" signs shall be prominently displayed at all times 131 132 6. That chemical fire extinguishers shall be installed for emergency use. 7. That necessary arrangements be made to take care of all waste water, grease and oil by having proper connections with storm sewer or sanitary sewer, in accordance with instructions of the City Engineer. 8. That permission be granted, subject to above conditions and the present and future regulations, rules and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said J. L. Smith has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations or ordinanceв. CITY SAFETY COMMITTEE By J. E. Woody, Chief Fire Department R. F. The above motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck 5; nays, none. City Manager Johnson advised the Council that title to the 7.44 acres of land proposed to be purchased from J. C. Bryant for a gravel pit had been examined and approved by the City Attorney and the field notes verified as correct by the City Engineer, and deed conveying said property to the City had been executed by said J. C. Bryant. Councilman Reed then moved that the City Manager be instructed to close the deal and have warrant in the sum of $3,169.50, issued to the said J. 0. Bryant. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. , Councilman Steck moved that the Council recess, subject to call of the Mayor.
