1 International Recording, indicating and integrating Rate of Flow meter for the Filtration Plant at a cost of $520.00 Motion was seconded by Councilman Mueller and name prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Reed, and Steck, 4; nays, none, Councilman Pannell absent. Councilman Reed moved that the deeds from C. H. Jung and wife, conveying 39/100 acre of land, and Henry Johnson and wife, conveying 64/100 acre of land, immediately north of Dam Boulevard and west of Hearn Street, for street purposes be accepted Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Reed, and Steck, 4; nays, none, Councilman Pannell absent. The application of Patton Transfer Company to install a gasoline pump and underground tank at their place of business, corner of Guadalupe and 25th Streets, together with the report of Safety Committee upon same, were read and Councilman Reed moved that permitbe granted, in accordance with the recommendations of the Safety Committee. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Reed, and Steck, 4; nays, none, Councilman Pannell absent. The Council then recessed, subject to call of the Mayor. REGULAR MEETING OF THE CITY COUNCIL: 139 Approved: OW.M Fadden Mayor. Austin, Texas, July 14th, 1927. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; absent, Councilman Steck. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Reed and same prevatled by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. Mesars, Hewlett and Page, representing the concrete sewer pipe industry, with their attorney, W. D. Hart, appeared before the Council with refer- ence to the enforcement of the sewer pipe ordinance, claiming that vitrified clay sewer pipe was not having to meet the requirements of the concrete sewer pipe as specified in said ordinance. After a lengthy discussion of the matter, the Council assured the concrete sewer pipe representatives that the matter would be looked into and in the future no discrimination would be allowed. Mayor McFadden laid before the Council the following resolution: WHEREAS, the City of Austin heretofore contracted with D. T. Iglehart for the purchase of the certain real estate hereinafter described, and upon the terms hereinafter described; and WHEREAS, before the consummation of said transaction, said D. T. Iglohart died, and left a will, by the terms of which will M. B. D. Iglehart and 140 Albert W. Wilkerson were named Independent Executors, with power to dispose of the property owned by deceased; and WHEREAS, said will has been duly probated in the County Court of Travis County, Texas, and said N. B. D. Iglehart and Albert W. Wilkerson have both duly qualified as said Independent Executors of the will of said D. T. Iglehart, deceased, and are ready to comply with said contract as heretofore made between City of Austin and said D. T. Iglehart, now deceased; therefore, 1. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Adam R. Johnson, Oity Manager, be and he is hereby authorized and empowered to purchase for and in the name of the City of Austin from N. B. D. Iglehart and Albert W. Wilkerson, Independent Executors of the will of D. T. Iglehart, deceased, for the consideration and upon the terms and conditions hereinafter expressed, the following described real estate, together with all the rights, appurtenances, fixtures and improvements thereto in anywise belonging, to-wit: the South 200 feet of Lot Number 5, and all of Lots Numbers 6 and 7, in Block Number 5, in the Subdivision of Outlot Number 11, in Division "Z", in the City of Austin, Travis County, Texas, according to the map or plat of said Subdivision, of record in Plat Book Number 1, at page 30, Records of Travis County, Texas. 2. THAT the consideration to be paid by the City of Austin to said M. B. D. Iglehart and Albert W. Wilkerson, Independent Executors aforesaid, for said property shall be Twenty-five Thousand ($25,000.00) Dollars, payable as follows: Five Thousand ($5,000,00) Dollars in cash, and the balance in three equal installments, evidenced by the promissory Notes of the City of Austin, dated July 15, 1927, executed in its name, by Adam R. Johnson, City Manager, and payable on or before one, two and three years after date, respectively, with 6% interest from date of said notes. 3. THAT for the purpose of making the cash payment aforesaid, there is hereby appropriated and set aside out of the Water & Light Fund of the City of Austin, the sum of $5,000.00, and a warrant therefor shall issue, payable to the order of said M. B. D. Iglehart and Albert W. Wilkerson, Independent Executors of the will of D. T. Iglehart, deceased; and said warrant and said executed notes shall be delivered to said Independent Executors upon delivery by them to the City of Austin of their general warranty deed to said property, conveying same to the City of Austin, and also a complete Abstract of Title to said property, which shall show good and merchantable title to said property, in said Independent Executors, free from all liens and incumbrances whatsoever, on the date of said conveyance, as approved and shown in the written opinion of the City Attorney. 4. THAT said transaction shall be further conditioned upon the payment of all taxes due on said property up to July 15, A. D. 1927. Councilman Mueller moved the adoption of the above resolution. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. 141 Mayor NoFadden laid before the Council the following ordinance: AN ORDINANCE PROHIBITING THE ERECTION, CONSTRUCTION, BUILDING, ΚΑΙΝΤΕΝΑΝΟΣ OR OPERATION OF GASOLINE STATIONS IN THE CITY OF AUSTIN, WITHOUT APERMIT BE OBTAINED THEREFOR FROM THE CITY COUNCIL OF THE CITY OF AUSTIN, AND PROVIDING A PENALTY. The ordinance was read the first time and Councilman Reed moved that the rule be suspended and the ordinance placed on its second reading. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. The ordinance was read the second time and Councilman Reed moved a further suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. The ordinance was read the third time and Councilman Reed moved that same be finally passed. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Counoilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. Mayor McFadden laid before the Council a letter from Judge James R. Hamilton, protesting against the encroachment by the owners of Shoal Crest Addition upon property owned and held by him. Councilman Reed moved that the communication be referred to the City Attorney and City Manager for attention. Motion prevailed by the following vote: Ayes, Mayor NoFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. Mayor McFadden laid before the Council application of Albin Pils to creot a gasoline filling station at 1508 East 12th Street, together with the report of the Safety Committee upon same. Councilman Reed moved that the permit be granted, in accordance with the recommendation of the Safety Committee, Motion prevailed by the following vote: Ayes, Mayor NoFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. Councilman Reed moved that the City Manager be authorized to purchase a rock crusher from the Austin Bridge Company for the sum of $1600.00. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck absent. The semi-annual report of W. E. Roberts, Dairy Inspector, for the six months ending July 1st, 1927, was read and ordered filed. Councilman Reed moved that the Council recess, subject to call of the Mayor.
