0 REGULAR MEETING OF THE CITY COUNCIL: 165 Austin, Texas, September 08, 1927. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion prevailed by the following vote: Ayes, Mayor MdFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor MoFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That the City of Austin will pay, and does hereby offer a standing reward of THREE HUNDRED DOLLARS for the arrest and conviction of any person guilty of committing the crime of arson within the city limits of the City of Austin, Texas. Councilman Mueller moved the adoption of the above resolution. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The application of J. L. Jordan, Agent for Simms Oil Company, to erect a gasoline filling station at the corner of South Congress Avenue and Live Oak Street, came before the Council; also a protest from property owners in that vicinity objecting to the granting of same. Mayor McFadden moved that action on the application be deferred until the protesters could be given a hearing. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The application of A. H. Reese to erect a drive-in gasoline filling station on the east side of Guadalupe Street between 38th and 39th Streets, was submitted to the Council, and Mayor McFadden moved that the permit be granted, subject to the following recommendations of the City Engineer and Safety Committee: "September 8, 1927. Mr. Adam R. Johnson, City Manager, Austin, Teхав. Dear Sir: In regard to the application of A. H. Reese for the permission to erect a drive-in gasoline filling station between Thirty-eighth and Thirty-ninth Streets on the east side of Guadalupe Street, beg to advise that Mr. Reese has agreed to properly take care of the unusual drainage features which will be encountered in said installation at at his own expense. This proposed site is east of the street railway track in the middle of a long block. There is a little hazard in this situation on account of the street car track not being in the center of the street. I would like for the Council to pass as to this hazard before granting the permit; otherwise I am ready to sign a formal recommendation that permission be granted. Yours very truly, (Sgd) Orin E. Metcalfe, City Engineer." 166 "Austin, Texas, September 7, 1927. Hon. Mayor & City Council, Gentlemen: We, your committee on the application of Mr. A. H. Reese, asking for permission to erect a drive-in gasoline filling station between 38th and 39th Streets on the east side of Guadalupe Street, beg leave to report as follows: We, the Committee, recommend that this permission be granted subject to the following conditions: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be determined before construction is begun. 2. That ceiling of that portion of building that extends over drive-ways shall be covered with metal. Supporting pillars to be constructed of brick or re-inforced concrete. 3. That gasoline storage tanks and pumps shall be of an approved type and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing the installation of such equipment. 4. That gasoline storage tanks, pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alley. 5. That electric lights shall be used, and all electric wiring shall be installed in compliance with regulations governing the wiring of gasoline filling station, and under the supervision of the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is stored or handled. 7. That there shall be provided at least one chemical fire extinguisher. 8. That provision shall be made to take care of all waste oils and water by having the proper connections with storm or sanitary sewer. Connection to be made under the supervision of the City Engineering Department. Connections to be determined before intended improvements are begun. 9. That permission shall be granted subject to the above conditions, and the present and future rules, regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said A. Councilman Pannell moved that the Council set Monday, September 26th, at 8:00 P. M. as the date for a hearing with the attorneys representing the dormitories in the matter of taxing same. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. A letter from D. R. Woodard, representing the colored people, to City Manager Johnson, thanking the City for the summer concerte given them, was read and filed. paving The matter of the alleys in the business and down-town districts of theCity came up for discussion and the Council instructed City Manager Johnson to have proper resolution drawn covering the matter and present same at the next regular meeting of the Council. A petition from property owners on 25 Street, asking that the City open said street west to Pearl Street was read and referred to the City Manager for investigation and report back to the Council. Councilman Mueller moved that the Council recess, subject to call of the Mayor. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The Council then rеcеssеd. After hearing protests against the erection of a gasoline filling station at the corner of Live Oak Street and South Congress Avenue, Councilman Pannell moved that permit be granted to the Simms Oil Company for the erection of same, subject to the following recommendations of the Safety Committee: "Austin, Texas, September 2,1927. 0 Hon.
