185 Councilman Pannell nominated Dr. Lee Edens for the position of Director of the City Health Department. This nomination was seconded by Councilman Mueller, and confirmed by the following vote: Ayes: Mayor McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5; Nayes, none. Councilman Mueller moved that the Council recess, subject to the call of the Mayor. The motion prevailed upon the following vote: Ayes, Layer McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5, Nayes, none. The Council then recessed. REGULAR MEETING OF THE CITY COUNCIL: ON.M Fadden Austin, Texas. October 13, 1927. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5; absent none. The minutes of the last meeting were read and Councilman Steck moved their adoption, which was seconded by Councilman Mueller. The motion prevailed upon the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5; nayes, none. Mayor McFadden announced that the oath of office would be administered to Dr. Lee Edens, Director of the City Health Department. Judge Ed. R. Kone, Judge of the Corporation Court, then administered the oath of office to Dr. Lee Edens, Director of the City Health Department. The Mayor then announced that the bids received in accordance with the request for bids on the paving of certain alleys in the City of Austin, and the excavation of same, would be opened. The following letter from the American Legion was read: Austin, Texas, October 13, 1927. TO THE HONORABLE CITY COMMISSIONERS: Gentlemen: The American Legion, Travis Post No. 76, are sponsoring the John Francis Carnival in the City of Austin during the present week. This Carnival was brought to this City by the American Legion for the purpose of raising funds with whien to pay for their Club House. In order to bring the Carnival here the Legion obligated themselves to pay for the State, County and City licenses, which has been done. The City license fee amounted to $50.00. The American Legion, Travis Post No. 76, respectfully requests you to refund the amount paid out for city license in bringing this Carnival to this City. It is only in view of the fact that the proceeds are to go to pay part of the debt against the Legion home that we make this request. The Mayor laid before the Council the following request for the installation of a gasoline pump and underground storage tank on the premises of E. M. Ashford at 3016 Guadalupe street, Austin, Texas, to be for private use only: Austin, Texas, September 30, 1927. "Mr. Adam R. Johnson, City of Austin, Austin, Texas. Dear Sir: We are desirous to install a pump and underground storage tank on the private property owned by Mr. E. M. Ashford, 3016 Guadalupe street, Austin, Texas. This pump and tank will be installed according to the City Ordinance meeting the inspection of the City Fire Marhsal, pump and tank bearing the Underwriter's label. Thanking you in advance for your kind consideration in this matter, and trusting it will be your pleasure to advise us at the very earliest possible moment, beg to remain Very truly yours, 189 (Sgd) C. The following is the report of the Safety Committee on the above re"Austin, Texas, October 1, 1927. Mayor and City Council, Gentlemen: We, your committee on the application of E. M. Ashford asking permission to install underground gasoline storage and pump on his premises at 3016 Guadalupe street, for private use, make the following report: We, the committee, recommend that this permission be granted subject to the following conditions: 1. That gasoline storage tank and pump shall be used only for рurрове stated in application for private use of applicant) and shall be located inside of the property line, and 30 feet from any residence. 2. That gasoline storage tank and pump shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters, and shall be installed in compliance with State and City regulations governing such installations. 3. That gasoline pump shall be so located that care receiving service therefrom will not obstruct sidewalk, street or alley. 4. That electric light shall be used for lighting and wiring shall be done in accordance with regulations governing wiring of gasoline filling stations. う。 That "NO SMOKING" sign shall be posted, and no person shall be permitted to smoke or have any open flame near gasoline tank or pump. 6. That chemical fire extinguisher snall be provided for emergency use. 7. That permission shall be granted subject to the above conditions, and the present and future rules, regulations and ordinances of the City of Austin, Texas, applying to or regulating the installation of gasoline storage tanks and pumps, and said permission shall be held to be granted and accepted subject to all necessary reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police traffic and fire regulations; and the right of revocation is retained if, 190 after hearing, it is found by the City Council that the said E. K. Ashford has failed and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. APPROVED: Adam R. Johnson, City Manager. (Signed) J. E. The Mayor laid before the Council the foliowng letter: "Austin, Texas, October 12, 1927. Mr. Adam R. Johnson, City Manager, City. Dear Mr. Johnson: I hereby make application to install an oil storage tank in the alley adjacent to my property at the corner of 9th and Lavaca streets. This tank will be buried well underneath the ground, with no opening in the alley other than a connection for filling purposes, which will be kept closed and securely locked at all times. This tank will be so installed that it will in no wise be an obstruction in the alley. On account of having struck solid rock in the bottom of our basement, where we had contemplated the making of this installation, it will be impossible to reach sufficient depth to carry out my original plans, therefore, the necessity of this request. Very truly yours, (Sgd.) E. L. Steck. The storage tank above mentioned will be used to store crude oil for fuel purposes, and will serve my establishment located on the property above stated, and the contents of such tank will not be sold or delivered to any other person. (Sgd.) E. L. Steck." 191 The following is the report of the Safety Committee on the above request: "Austin, Texas, October 12, 1927. Hon. Mayor and City Council: Gentlemen: We, your committee on the application of Mr. E. L. Steck, asking permission to install a fuel oil storage tank in the alley adjacent to his property at the corner of 9tn and Lavaca streets, make the following report: We, the committee, recommend that this permission be granted, subject to the following conditions: 1. That tank shall be of an approved type, as shall all connections to tank, and that tank shall be installed and all connections thereto made in compliance with regulations governing such fuel oil installations, and subject to the approval of the City Safety Committee. 2. That top of tank shall be at least three (3) feet below grade level; that all pipes connecting to tank shall be at least eighteen (18) inches below grade level; that there shall be at least six (6) inches of concrete over tank. 3. That filler pipe to tank shall terminate in a concrete or metal filler box with top, filler pipe to be equipped with a screw cap and lock. 4. That there shall be a vent pipe from tank that shall terminate not less than twelve (12) feet above grade and at least two and one-half (25) feet from any wall opening, vent pipe shall terminate with a goose-neck connection. 5. That tank shall be used only for the purpose of storing fuel oil, to be used in connection with oil burning equipment installed in the building under 192 control of the applicant, all equipment to be kept in proper repair and working order at all times. 6. That permit shall be granted subject to the above conditions, and the present and future rules, regulations and ordinances of the City of Austin, Texas, applying to or regulating the installation of fuel oil storage tanks and their equipment, and said permission shall be held to be granted and accepted, subject to all necessary, reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of proper fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said E. L. Steck has failed and refused, and will continue to fail and refuse to perform any such condition, regulations and ordinances. APPROVED: Adam R. Johnson, City Manager. Signed J. E. The Mayor laid before the Council the following letter: "Austin, Texas, October 7, 1927. Honorable Adam Johnson, City Manager, Austin, Texas. Dear Sir: I wish to make application with you for permission to install a gasoline pump at the gravel pit just south and west of Congress Avenue bridge, at the intersection of South Congress Avenue and Barton Springs Road, on old circus grounds, - to be operated by the Austin Sand and Gravel Company. Yours truly, (Sgd.) W. C. Moore." The following is the report of the Safety Committee on the above request: "Austin, Texas, October 10, 1927. Hon. Mayor and City Council: Gentlemen: We, your committee on the application of W. C. Moore asking permission to install a gasoline tank and pump at the Austin Sand and Gravel Company's pit, at the intersection of South Congress Avenue and Barton Springs Road, on old circus grounds, make the following report: We, your committee, recommend that this permission be granted, subject to the following conditions: 1. That gasoline storage tank and pump shall be installed inside of the property line and on premises controlled by the applicant. 2.
