212 same being Lots 22 to 25, Block 2, Outlot 77, Division "B", Lakeview Addition. The matter was referred to the City Attorney to have proper resolution drawn covering same. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE FIXING AND LEVYING MUNICIPAL TAXES FOR THE CITY OF AUSTIN, TEXAS, FOR THE YEAR A.D. 1927. The ordinance was read the first time and Councilman Pannell moved that the rule be suspended and the ordinance placed on its second reading. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The ordinance was read the second time and Councilman Pannell moved a further suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden moved that the City Manager be directed to advertise for bids for the sale of the Hospital Bonds, said bids to be opened December 22nd. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Councilman Kueller moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Council then recessed. Approve Wer REGULAR MEETING OF THE CITY COUNCIL: Hayor. Austin, Texas, December 15, 1927. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, and Steck, 3; absent, Councilmen Pannell and Reed, 2. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Kueller and Steck, 3; nays, none, Councilmen Pannell and Reed absent. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN; That the sum of $13,060.00 be and the same is hereby transferred from the Water & Light Fund to the General Fund of the City of Austin, same being the aggregate sum of principal and interest paid or due during the year 1927 on Water & Light Refunding Bonds of the issue of 1917, which item was erroneously omitted from the General Budget for 1927. Councilman Mueller moved the adoption of the above resolution. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Steck, 3; nays, none, Councilmen Pannell and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, there has been earned as interest on the daily balances of the Water & Light Fund, deposited with the City Treasurer, the sum of $2,603.46, which interest has been deposited to the credit of said Fund; and WHEREAS, it is desirable that said interest be transferred to the credit of the General Fund; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the said sum of $2603.46 be and the same is hereby transferred from the Water & Light Fund to the General Fund of the City of Austin. Councilman Steck moved the adoption of the above resolution. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Steck, 3; nays, none, Councilmen Pannell and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, Paul W. Kaiser, Agent, holds the promissory note of the City of Austin, aated June 24, 1926, for $252.84, due December 31,1926, payable to the order of Paul W. Kaiser, for himself and as Agent for Lee Shoto, E. W. Perry, Chas. Williams, J. W. Catchen and G. J. Merritt, said note being executed by W. D. Yett, Mayor, under authority of a resolution passed by the City Council on June 24, 1926; and WHEREAS, said note was given for the purpose of refunding certain license taxes paid by said parties for operating automobiles for hire in the City of Austin, and which payments, made respectively by the above named parties, amount to $218.75, the items of which are shown in said resolution and here referred to; and WHEREAS, said Paul W. Kaiser, for himself and as agent for the other named parties, has proposed to settle said note and claims for the actual aggregate amounts so paid in by said parties; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $218.75 be and the same is hereby transferred from the Water & Light Fund to the General Fund of the City of Austin, and appropriated out of said last named fund for the purpose of settling the matters involved in said note; and for said purpose a warrant for $218.75 shall issue, payable to the order of Paul W. Kaiser, Agent, and said warrant shall be delivered to said party upon his delivery to the City of said note duly cancelled. Councilman Mueller moved the adoption of the above resolution. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Steck, 3; nays, none, Councilmen Pannell and Reed absent. 213 214 Mayor McFadden laid before the Council the following resolution: WHEREAS, on June 29, 1926, W. D. Yett, Mayor, executed and delivered to John Williams the note of the City of Austin for $21.36, for the refund of license fees for the operation of an automobile for hire, and on June 28,1926, executed and delivered the City's note to Willie Donley for $45.18 for the same purpose; and WHEREAS, both of said notes were subsequently acquired by Gec. S. Dowell, who brought suit on same, but who now proposes to settle said claims for the amounts actually paid by said parties for said licenses and the accrued costs of court; and WHEREAS, it is found that said amounts equal the aggregate sum of $56.25 and said court costs amount to $5.10; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $61.35 be and the same is hereby transferred from the Water & Light Fund to the General Fund of the City of Austin and appropriated out of said last named fund for the purpose of settling said matters; and for said purpose a warrant for $56.25 shall issue, payable to the order of Geo. S. Dowell, and a warrant for $5.10 shall issue, payable to the order of Frank R. Tannehill, Justice of the Peace, for the costs of court, and said warrants shall be delivered to the respective parties upon their delivery to the City of proper acquittances. Councilman Mueller moved the adoption of the above resolution. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Steck, 3; nays, none, Councilmen Pannell and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, it is provided in the certain contract between the City of Austin and Dozier Construction Company for the pavement of certain alleys in the City that said Company shall canvass the property owners adjacent to the alley in each block to be paved, and report the result of its canvass to the City Manager for the information of the City Council, and thereupon the City Council shall determine whether or not said alley shall be paved under said contract; and WHEREAS, said Company has made its report on the alleys hereinafter mentioned and the City Council has determined that said alleys shall be paved; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Dozier Construction Company be and the same is hereby authorized and directed to pave the alleys hereinafter named under the terms of the certain contract now existing between the City and said Company, to-wit: Between 4th & 5th Streets and Lavaca & Guadalupe Streets; Between 4th & 5th Streets, and Colorado & Lavaca Streets; Between 10th & 11th Streets, and Congress Avenue & Colorado Street; Between 3rd & 4th Street and Guadalupe & Lavaca Streets; Between 5th & 6th Streets and San Antonio and Guadalupe Streets; Between 9th and 10th Streets and San Jacinto and Trinity Streets; Between 10th and 11th Streets and Congress Avenue and Brazos Street; Between 3rd and 4th Streets and Colorado and Lavaca Streets; 215 Between 5th and 6th Streets and Colorado and Lavaca Streets; Between 10th and 11th Streets and Trinity and Neches Streets; Between 1st and 2nd Streets and Congress Avenue and Brazos Street; Between 6th and 7th Streets and Guadalupe and San Antonio Street; Between 2nd and 3rd Streets and Colorado and Lavaca Streets; and Between 2nd and 3rd Streets and San Jacinto and Trinity Streets. Councilman Reed entered the Council Chamber. A petition, signed by a number of the business men of the city, asking that the City Council make provision in its 1928 budget for the establishment of a municipal airport, was received, read, and ordered filed. A telegram from T. G. Hyslop, Chairman Board of Commissioners of Taylor, Texas, in appreciation of valuable services rendered by Austin Fire Department during a recent fire in their city, was read and ordered filed. Letters of appreciation from the American-Statesman for the city's contribution towards the success of their Santa Claus parade; Miss Selma Streit, Business Manager of the Scottish Rite Dormitory, for promptness in repairing their lighting system; and C. M. Bartholomew, Vice President Austin National Bank, commending the Fire Department for the quick service rendered them during a recent fire in their building, were read. Councilman Pannell entered the Council Chamber. Councilman Reed moved that the claim of the Texan Garage, in the amount of $30.00, for repairing damage done to the car of Tom Overton by reason of one of the city's police cars colliding with same, be approved and ordered paid. Motion prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Reed, 4; nays, none, Councilman Steck present but not voting. Mayor McFadden laid before the Council the following communication : "Austin, Texas, December 12,1927. SECON 2 To the Honorable Mayor and City Council, Austin, Texas. Gentlemen: In accordance with a provision of Sub-division 2, of Section 2, of Article 12, of the Charter of the City of Austin, as amended, the Board of Trustees of the public free schools of the city, at a meeting held on this the 12th day of December, 1927, determined, and you are hereby so advised, that the amount of taxes that shall be levied and collected for the year 1927 for the maintenance of said public free schools, is sixty (60) cents on the one hundred dollars worth of taxable property in the City of Austin. Drake to install an underground gasoline tank and pump at his premises at 1005 West 6th Street be granted, subject to the following recommendations of the Safety Committee: "Austin, Texas, December 9,1927. Hon. Mayor & City Council, Gentlemen: We, your committee on the application of Mr. W. 3. Drake asking permission to install an underground gasoline storage tank with pump, for his private use at his residence located at 1005 West 6th Street, make the following report: We, the committee, recomment that this permission be granted, subject to the following conditions: 1. That gasoline storage tank and pump shall be used only for the purpose stated in the application (for private use only) and said gasoline storage tank and pump shall be located inside of the property line and thirty feet from any residence. 2. That gasoline storage tank and pump shall be of an approved type and shall bear the label of the National Board of Fire Underwriters, and shall be installed in compliance with State and City regulations governing such installations 3. That gasoline pump shall be so located that cars receiving service therefrom will not in any manner obstruct any sidewalk, street or alleyway. 4. That electric lights only shall be used for lighting purposes, and electric wiring shall be installed in compliance with regulations governing the wiring of gasoline filling stations. 5. That "NO SMOKING" sign shall be posted near pump and no person shall be permitted to smoke or have any open flame near premises where gasoline is stored or handled. 6. That approved chemical fire extinguisher shall be provided for emergency use. 7. That permission shall be granted subject to the above conditions, and the present and future rules, regulations and ordinances of the City of Austin, Texas, applying to or regulating the installation of gasoline storage tanks and pumps and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said Mr. W. S. Drake has failed and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Approved: (Sgd) J. E. Woody, Fire Chief. R. F. Rockwood, Fire Marshal. A petition signed by abutting property owners, protesting against the paving of the alley in Block 121, between San Jacinto and Trinity Streets and East 10th and East llth Streets, was read and ordered filed.
