REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, January 05, 1928. 227 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The Mayor laid before the Council the following application of Ernest Nalle: "Austin, Texas, January 4, 1928. To the Honorable Mayor and Board of Commissioners of the City of Austin, Austin, Texas. Gentlemen: I, the undersigned, have entered into a contract with the firm of Walsh & Burney, Inc., for the erection of a fireproof building at the corner of East Eight Street and Congress Avenue, for which a permit has been lawfully issued in connection therewith, and on behalf of the contractors and myself respectfully petition the Honorable Council as follows: 1. For the permit, right and privilege of the use of Congress Avenue in front of said property, from the curb line to a line parallel and ten feet east of the east rail of the street car track, and for the use of one-half of East Eighth Street for the depth of said lot, said portion of said streets to be fenced off by a fence and runway on Congress Avenue, and the fence on East Eighth Street, to be erected at the expense of the contractor and myself. 2. That the City construct at its expense, for the benefit of property owners in this section of said improvements, and for the benefit of the improvements before mentioned, a catch basin of sufficient capacity to take care of the storm waters at or near the corner of East Eighth and Congress Avenue, and connect the same with the storm sewer on Congress Avenue. 3. For the permit, right and privilege of excavating for the basement under the sidewalk of Congress Avenue and East Eighth Street, in front and along the entire premises on Congress Avenue and Eighth Street. 4. That the City, at its own expense, extend the sanitary sewer in alley, which alley is parallel to Congress Avenue and likewise between Seventh and Eighth Streets, from its present terminus in the rear of the Stephen F. Austin Hotel, to the rear of the property upon which the improvements are to be erected, so that proper connection can be made to the same. Your petitioner prays that the premises be considered, and all things herein prayed for be granted to him and his general contractor, Walsh & Burney, Inc. Respectfully, (Sgd) Ernest Nalle. " The following communication from the City Engineer with reference to the above application was also read: Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: "Austin, Texas, January 5, 1928. In accordance with your request, I have made a study of the application of Ernest Nalle for street space assignment for the purpose of constructing a building et Eighth Street and Congress Avenue. In reference to paragraph No. 1 of the Nalle application, beg to advise that I recommend 20 feet east of the east rail of the street car track instead of 10 feet, and I recommend that he be permitted to use one-half of East Eighth Street, all of said grants to be based upon the plans and recommendations accompanying this letter. In regards paragraph No. 2 about the catch basin at the corner of Eighth Street and Congress Avenue, beg to advise that this would be a permanent improvement to the block and that it would be proper for the City to assume this expense. 228 In regards paragraph No. 3, I suggest that it is a matter of policy to be determined after the securing of advice from the City Attorney by the City Council. This entails, however, a study of the type of construction to be placed under the sidewalk from an architectural and engineering standpoint, and I suggest that final decision on this matter be postponed until the entire set of plans of the building, including the proposed use of sidewalk area, is presented to the City authorities. In regards paragraph No. 4, beg to advise that it has never been the policy of the City to take over the expense of giving special depth mains for the development of business propositions, and that this expense should be borne entirely by the owner of the property. Mr. Palmer advises that he made two estimates for connection with the Nalle property, but we have not been advised as to which plan was adopted, nor have we been shown plans of the present building. To give them a connection for everything except the basement, as previously proposed would require an expense to the property owner of only the customary $12.00 fee. The estimate for the special work previously made was slightly under $3,000. Other recommendations and amplifications of those contained in this letter will be found in the recommendations for working space which accompany this letter. Respectfully submitted, (Sgd) Orin E. Metcalfe, City Engineer." The City Manager submitted to the Council the following recommendations for working space on the Nalle building at the corner of East Eighth Street and Congress Avenue: "Boundaries for all working space shall be determined as follows: West side of Congress Avenue working space to be 28 feet east of and parallel to the center line of Congress Avenue except that this boundary will terminate with a 45 degree line tangent to the corner of the curh. Allow one-half the width of Eighth Street. The center line of Eighth Street to be determined by the established monument lines of Eighth Street. At the north boundary of said working space there shall be erected a solid board fence 8 feet in height of such a permanent nature that it cannot be moved except by wrecking. This fence shall be constructed for any of the space used and may have a built-in sliding door of sufficient size to allow the passage of a truck. At the west side of said working space, and on a 45 degree line at the intersection there shall be constructed a covered walk as shown on plan. This walk shall be floored with at least 3/4 inch planks and covered with boards at least 2 inches in thickness. The top of the walk shall beat its lowest point at least 7 feet from the floor. Inside of the walk shall be sheeted solid with shiplap, or its equivalent The outside wall of the walk shall be sheeted in a similar manner to a height of three feet. There will be no welk provided on the north boundary of the working space on Eighth Street. • Ordinances prohibiting the parking of any cars on Eighth Street between Congress Avenue and Brazos Street during the period of construction to be provided. Storm waters to be taken care of by the contractor on both Eighth Street and Congress Avenue. No vehicles to be unloaded by the Contractor while parked in either Eighth Street or Congress Avenue. All of contractor's materials to be unloaded in space allotted. No space to be allotted on alley except for 4 feet for scaffolding purposes during the necessary period for such scaffolding. When the building has reached a height of three stories, there shall be constructed an overhanging canopy ten feet in width on the wall of the building facing the alley." The Council approved the above recommendations for working space on the Nalle Building and the matter was further referred to the City Attorney for proper resolution covering same. Mayor McFadden moved that the general plan for the extension of natural gas high pressure lines in various parts of the city, as submitted by the Austin Gas Company, be adopted, and the City Attorney directed to draw resolution covering the matter and submit same to the Council. Motion prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. City Manager Johnson laid before the Council a number of applications of the Austin Gas Company to extend gas lines and Mayor McFadden moved that the permits be granted and the City Attorney directed to draw resolution granting same. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Councilman Mueller moved that the City Manager be authorized to pay the reward of THREE HUNDRED DOLLARS, offered by the City for the arrest and conviction of any one guilty of arson, to Bob Rockwood, John Woody, and Rex Fowler for the arrest and conviction of E. L. Williamson in the Criminal District Court of Travis County, Texas, on January 4th, 1928, for the crime of arson. Councilman Steck moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent.
