On Owen Street approximately 225 feet, beginning at a point 20 feet south of the north property line of 34th Strect, the center of said mair to be 17 feet west of the east line of Owen Street. Said main to have not less than 3, 1/2 feet of cover at the gutter line of the north side of 34th Street and to have not less than 18 inches of cover at all other pointe. On Waller Street from the south side of 15th Street to the north side of 16th Street, the center of said main to be 12 feet east of and parallel to the west line of Waller Street and to have not less than 18 inches of cover. On 16th Street from the east line of Navasota Street to the east line of East Avenue, the center of said main to be 24 feet south of and parallel to the north line of 16th Street and to have not less than 18 inches of cover. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Councilman Pannell moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor. McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilmar Reed absent. The Council then recessed. REGULAR MEETING OF THE CITY COUNCIL: 403 Approved den Mayor. Austin, Texas, April 5th, 1928. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5; absent, none. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. A committee, composed of Messrs. Ralph Goeth, E. P. Cravens, H. H. Luedecke, and Chas. B. Cook, appeared before the Council and requested that the date of the bond election be set for May 18th next. The Council assured the Committee that their request would be granted, and also expressed their thanks to said Committee for the splendid assistance being rendered in the campaign for the bond issues. H. W. Mills was heard with reference to the erection of a lumber yard on Guadalupe Street adjacent to the North Austin Fire Station. The Council expressed themselves as being favorable to this request. Mayor McFadden called up for its third reading the following ordinance: AN ORDINANCE PROHIBITING THE STANDING OF INTERURBAN MOTOR BUSSES UPON THE STREETS AND PUBLIC PLACES OF THE CITY OF AUSTIN, AND PROVIDING A PENALTY. The ordinance was read the third time and Councilman Pennell moved the adoption of same. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following communication from the City Engineer: Mr. Adam R. Johnson, City Manager, Austin, Teхав. City Council of the City of Austin, Texas. Gentlemen: "Austin, Texas, April 5, 1928. Dr. Z. T. Scott and nis architect, Mr. George Louis Walling, have personally requested me to have a building line established for the corner of 7th and Brazов Streets. About 14 years ago the City of Austin established center lines for both 7th and Brazos Streets. I would like to see all established center lines used as the basis for all new buildings, but in previous instances, the present Council has adopted the policy of making practical adjustments respecting the present use of the City streets as evidenced by existing buildings. In accordance with this policy, I recommend that the building line for the west side of Brazos Street shall be established as 40 feet distant from and parallel to the established line of Brazos Street, and that the building line be established on the north side of 7th Street, the same to be an extension of the building line as now evidenced by the Stephen F. Austin Hotel. For the purpose of explaining the existing conditions, Dr. Scott has had a private surveyor prepare maps which are presented for your consideration at this time. I have also prepared a map showing the line which I recommend as an extension of the Stephen F.. Austin Hotel building line, together with comparisons of the amount of land which the property owners will gain and the amount of the street which the City will lose. In the event the property owner should attempt to contend that he has established limitation rights in this street, I recommend that this matter be referred to the City Attorney, granting him ample time to make a study of the legal phases of the conditions as presented. Councilman Reed moved that the recommendations of the City Engineer, as submitted, be approved and the City Attorney be directed to draw a resolution covering the matter. Mayor McFadden laid before the Council the following report of the Safety Committee: 11 Austin, Texas, April 4,1928. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: The Safety Committee wishes to report that an inspection of the temporary bracing of the plaster ceilings in annex rooms previously inspected at the Baker School has been made and that same seems to be satisfactory, and that no further collapse is likely to take place between now and the termination of the school year providing care is taken to see that none of the supports are moved and that wooden blocks at the base of supports are kept tightly wedged. We are informed by Mr. Mueller of the School Board that immediately upon the termination of the school year, steps will be taken to provide ample anchor age of the metal lathe and plaster to ceiling joists and render the ceilings safe in all respects. It seems that this is a satisfactory way of handling the matter and at the same time allow school activities to continue uninterrupted for the remainder of the school year. Bailey for the year 1927 at a valuation of $3,185.00 and , WHEREAS it appears from attached Petition #37 of Dr. J. R. Bailey that said lot is badly cut by a ravine and is inaccessible, Therefore, BE IT PESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the valuation on Lot 1, Outlot 6/9, Division "C" be changed from $3,185.00 to $1,635.00, and the Assessor & Collector be and he is hereby authorized to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Yayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; neys, none, Mayor McFadden laid before the Council the following resolution: WHEREAS, on Assessment #12857, a Ford Touring Car was assessed against W. S. Wilson for the year 1927 at a valuation of $120.00; and WHEREAS, it appears from attached Petition #35 of 7. S. Wilson that this 405 406 is a 1916 model, instead of 1925 model, as listed, and that a valuation of $120.00 is excessive, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the valuation on said Ford car be changed from $120.00 to $35.00, and the Assessor & Collector be and he is hereby instructed to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, on Assessment #6237, Lot 9, Block 5, Sweetman Addition, was assessed against Miss Gertrude Ketchum for the year 1927 at a valuation of $245.00; and WHEREAS, it appears from attached Petition #16, signed by aaid Gertrude Ketchum, that this valuation is excessive, for the reason that a revine runs through this lot, making a portion of it undesirable, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the valuation of Lot 9, Block 5, Sweetman Addition, be changed from $245.00 το $160.00, and the Assessor & Collector be and he is hereby authorized to change his rolls accordingly. Mayor McFadden laid before the Council the following resolution: WHEREAS, on Assessment #11577, a Peckard Six automobile was assessed against the Texan Garage for the year 1927 at a valuation of $300.00; and WHEREAS, it appears from attached Petition #39, signed by L. V. Gold, that said valuation is excessive, for the reason that this car was bought for junk and afterwards converted into a wrecker at a cost of less than one hundred dollars; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said valuation of $300.00 be changed to $75.00, and the Assessor and Collector be and he is hereby instructed to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following recolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its as mains in the alley in the City of Austin hereafter named, and said maps or plans have been considered by the City Council Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct its gas mains in and under the alley which lies between Newning Avenue, Drake Avenue, Turner and Monroe Streets, the center of said main to be 4 feet north of and parallel to the south side of said alley. THAT the work and laying of caid jas gains, including the excavation in the alley and the restoration and maintenance of said alley after said main has been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct its gas mains on Travis Heights Boulevard from Woodland to Fairmont Avenue, the center of said gas main to be 50 feet east of and parallel to the west line of Travis Heights Boulevard and to have not less than 1 1/4 feet of cover below the subgrade. That the work of laying of said gas main shall be so executed that none of the adjacent road gravel and base will be fouled with excavated material and that the new gravel which has not been fully set up and the new base shall be put back into as good a condition as found at the commencement of construction work, and that after all gravel has been replaced same shall be rolled at the expense of the Austin Gas Company. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following report of the City Engineer: Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: "Austin, Texas, March 19,1928. The Dozier Construction Company has excavated and paved the following alley in accordance with their contract and are requesting formal acceptance of same. The alleys are in addition to the ones reported under date of February 2,1928: Between San Antonio and Guadalupe Streets, 22nd to 23rd Streets, Y. M. C. A. alley; Between Lavaca and Guadalupe Streets, 4th to 5th Streets; Between San Antonio and Guadalupe Streets, 23rd to 24th Streets. All work was done under the supervision of our official inspector and has been completed in accordance with plans and specifications for same. I hereby recommend formal acceptance of same by the City Council. Yours very truly, (Sgd) Orin E. Metcalfe, City Engineer. " Councilman Steck moved that the above report be adopted. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmer. Mueller, Pannell, Reed, and Steck, 5; nays, none. The City Attorney was directed to prepare resolution appropriating $150.00 out of the Water & Light Fund, payable to G. M. Shipe, President K&T Land Company, as a refund of deposit for the construction of sanitary sewers, as per contract dated August 4th, 1913, between the City of Austin and MK&T Land Company Mayor McFadden laid before the Council the following resolution: WHEREAS, on Assessment #7497, the improvements on Lot 1, Eck Heights, were assessed against J. A. McCutcheon for the year 1927 at a valuation of $890.00; and 407 408 WHEREAS, it appears from attached petition #30 of J. A. McCutcheon that these improvements are in a dilapidated condition and at an inaccessible location, and for this reason the above valuation is excessive, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said improvements be changed from $590.00 to $500.00, and the Tax Assessor and Collector be and he is hereby instructed to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. this Mayor McFadden laid before the Council affidavit of B. H. Sherman, SecretaryTreasurer of the Austin Labor Temple, stating that at the time he paid the 1925-1926 taxes on the property owned by said Association, he did not know there were any delinquent taxes on said property for the year 1924, and, therefore, should be entitled to a refund of the interest and penalty accruing on these taxes for said year. Councilman Reed moved that in view of fact, the penalty on the 1924 taxes, amounting to $17.62 and the interest on the 1924 taxes from July 16, 1926, the date the 1925 taxes were paid, to September 1, 1927, amounting to $30.92, be remitted. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFedden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. , Mayor McFadden laid before the Council the following resolution: ORDERING THE IMPROVEMENT OF THE CERTAIN ALLEYS HEREINAFTER NAMED, IN THE CITY OF AUSTIN, TEXAS; APPROVING AND ADOPTING BID CONTRACT AND BOND THEREFOR; AND APPORTIONING THE COSTS OF SUCH IMPROVEMENTS. WHEREAS, it is deemed necessary to improve the following alleys of and within the City of Austin, within the following limits, towit: (1) The alley lying between Second and Third Streets, and Brazos Street and San Jacinto Street; (2) The alley lying between Sixth Street and Seventh Street and Brazos Street and San Jacinto Street; (3) The alley lying between Seventh Street and Eighth Street and Lavaca Street and Colcrado Street; (4) The alley lying between Eighth Street and Ninth Street and Colorado Street and Lavaca Street, in Block 99, Original City. (5) The alley lying between Fourth Street and Fifth Street and Lavaca Street and Guadalupe Street; (6) The alley lying between Fifth Street and Sixth Street and Lavaca Street and Guadalupe Street; (7) The alley lying between Tenth Street and Eleventh Street and Levaca Street and Guadalupe Street; (8) The alley lying between Eighth Street and Ninth Street and Guadalupe Street and San Antonio Street; and (9) The alley lying between Guadalupe Street and San Antonio Street and Twenty-third Street and Twenty-fourth Street; and WHEREAS, the City Engineer has heretofore filed with the City Council complete specifications for the performance of said work, by paving said alleys with six inch (6") reinforced concrete pavement; and WHEREAS, Dozier Construction Company and other parties have heretofore filed with the City Council their bids to do said work, in accordance with said specification and the bid of said Dozier Construction Company for said work is at the following prices, towit: EXCAVATION Solid rock excavation for Two Dollars ($2.00) per cucic yard. Unclassified excavation to include loading into wagon or free haul up to 250 linear feet for Fifty Cents (504) per cubic yard. Excavation hauled not to exceed 1500 linear feet for Seven Cents (74) per cubic yard. Excavation hauled extra quarter mile in excess of first 1500 linear feet for Six Cents (.06) per cubic yard. ALLEY PAVING. One course concrete pavement complete in place for One and 62/100 Dollars ($1.62) per square yard. Excavation hauled each extra quarter mile further than the first 1500 feet for Eight Cents (.084) per cubic yard per quarter. Longitudinal expansion joints furnished complete in place for Ten Cents (.104) per linear ft. Solid rock excavation for Two Dollars ($2.00) per cubic yard. Steel reinforcement mesh furnished and placed for Eight and One-half Cents ($.08) per pound. Steel reinforcing bars furnished and placed for Four and One-half Cents ($.0444) per pound; and WHEREAS, all of said bids for said work were formerly opened by the City Council on October 13, 1927, and thereafter on October 15, 1927, the bid of Dozier Construction Company, as above set out, was found to be the lowest and best bid therefor, and same was fuly accepted by the City Council; and WHEREAS, the City Attorney has prepared the contract for said work between the City of Austin and said Dozier Construction Company and also a bond for the proper construction of said work by said Dozier Construction Company, with National Surety Company, as surety, and in accordance with the authority of the City Council, the City Manager and said Dozier Construction Company have execute said contract, and said Dozier Construction Company and National Surety Company have executed said bond, and same has been tendered to the City by said Company; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: (1) That each of the said alleys hereinabove mentioned and within the limits hereinabove specified, be improved by paving the same with reinforced concrete pavement, of six inch thickness, with necessary excavations in said alleys, as set forth in said specifications: (2) That said specifications for said work, as prepared by the City Engineer, be and the same are hereby adopted and confirmed, and that the bid of Dozier Construction Company to perform said work be and the came is hereby accepted and ratified, and said work be let to said Company; and that the contract, as prepared and submitted by the City Attorney for the performance of said work, and as executed by the City Manager and said Company, be and the same is hereby approved and adopted; and that the bond as submitted by the City Attorney and executed by said Company and National Surety Company, as surety, be and the same is hereby approved and National Surety Company is accepted as the surety thercon. (3) That the cost of said improvements in and on said alleys hereinabove mentioned shall be paid as follows, towit: The City of Austin shall pay to said Dozier Construction Company the whole cost of excavation in said allcys, preparatory to the pavement thereof, and the remainder of the cost of said improvements shall be paid by the owners of the property abutting on said 409 410 alleys, and such costs shall be assessed against said owners in accordance with the charter and ordinances of the City of Austin, provided, that no assessment shall be made against any owner or his property in excess of the actual benefits to said property in enhanced value by means of said improvements, nor until after notice and hearing to said owner, as provided by said chorter and ordinances. (4) That the payments to said Dozier Construction Company for the performance of said work hereinabove specified, shall be made in accordance with the terms of the certain contract hereinabove mentioned. (5) That this resolution shall remain on file with the City Clerk for public inspection for one week before the final passage or adoption thereof, and shall then be finally adopted. The above resolution was read and laid over. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE ORDERING AN ELECTION TO ΟΒΤΑΙΝ THE CONSENT OF THE QUALIFIED VOTERS OF THE CITY OF AUSTIN, TEXAS, TO THE ISSUANCE OF BONDS BY THE CITY COUNCIL FOR THE PURPOSES OF: (1) THE PERMANENT IMPROVEMENT OF THE STREETS OF THE CITY, INCLUDING PAVING AND RESURFACING OF SAME, AND THE CONSTRUCTION OF BRIDGES, STORM SEWERS AND DRAINS; (2) THE CONSTRUCTION OF SANITARY SEWERS; (3) THE ESTABLISHMENT AND DEVELPPMENT OF PUBLIC PARKS AND PUBLIC PLAYGROUNDS, AND THE PURCHASE OF SITES THEREFOR; (4) THE CONSTRUCTION AND REPAIR OF FIRE STATIONS, AND THE PURCHASE OF SITES AND EQUIPMENT THEREFOR; (5) THE CONSTRUCTION AND IMPROVEMENT OF PUBLIC FREE SCHOOL BUILDINGS; AND THE PURCHASE OF EQUIPMENT AND GROUNDS THEREFOR; (6) THE CONSTRUCTION, IMPROVEMENT AND REPAIR OF HOSPITAL BUILDINGS, AND THE PURCHASE OF EQUIPMENT THEREFOR; (7) THE CONSTRUCTION OF A MUNICIPAL ABATTOIR, AND THE PURCHASE OF SITE AND EQUIPMENT THEREFOR; (8) THE CONSTRUCTION OF A PUBLIC FREE LIBRARY BUILDING, AND THE PURCHASE OF EQUIPMENT THEREFOR; (9) THE CONSTRUCTION OF A PUBLIC MARKET, AND THE PURCHASE OF EQUIPMENT THEOTFOR; AND (10) THE PURCHASE OF A PUBLIC SITE FOR THE LANDING AND ACCOMMODATION OF AIRPLANES, THE CONSTRUCTION OF NECESSARY BUILDINGS THEREON, AND THE PURCHASE OF EQUIPMENT THEREFOR. The above ordinance was read the first time and Councilman Mueller moved that the rule be suspended and the ordinance placed on its second reading. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilmen Mueller moved that came be finally passed. Councilman Mueller moved that the permit be granted and that a resolution covering the matter be prepared and presented to the Council at its next regular meeting. Consideration of the various bids for the construction of the new unit to the City Hospital was had, and the following bids were accepted, same being the lowest and best bids for the particular work which each proposed, and awards made accordingly: ΤΟ Η.
