The Austin Gas Company received permission to install new gas mains on Nelson Street, and a specific building line was established for private property located on the north side of Fifth Street and west side of Brazos Street.

422 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 26, 1928. The Meeting was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. L. L. Hoge, representing the local order of the Knights of Pythias, asked that the Mayor deliver an address of welcome to their convention which meets in this city on May 8, 9, and 10, and also that the Council request the business men of the city to have the flags displayed at this time. Mayor McFadden accepted the invitation to make the welcoming address, and moved that the Council request the business men of the city to have the flags displayed on this occasion, Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Dr. T. W. Currie appeared before the Council in the matter of taxation of the property owned by the Austin Presbyterian Theological Seminary. He was requested to reduce his request to writing and submit same to the Council for consideration. Mayor McFadden laid before the Council the following resolution: WHEREAS, Misses Ida Gevers and Emma Gevers, owners of property in Lot 12, Block 56, located on the north side of Fifth Street and the west side of Braz08 Street, have presented data to the City Council of Austin, Texas, showing the existing conditions and have requested the City Council of Austin, Texas, to establish a building line; and WHEREAS, said data and a report from the City Engineer have been considered; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the building line for the north side of Fifth Street, beginning at the west line of Brazos Street and extending westerly a distance of 160 feet, be established as follows: That said line shall be approximately an easterly prolongation of that line which now exists as the south face of the buildings in this block, said line being more particularly described as follows: BEGINNING at a point which is on the west line of Brazos Street, which point is 38.95 feet north of the established center line of Fifth Street, and running westerly for a distance of 160 feet to a point which is 38.95 feet north of the established center line of Fifth Street. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct its gas main in and under Nelson Street from the north line of West 9th Street to the south line of West 8th Street, the center of said main to be 12 reet east of the west line of Nelson Street and parallel thereto. THAT the work and laying of said gas main, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden Councilmen Müeller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The following report of the City Engineer was submitted: "April 20, 1928. 423 To The Honorable Mayor and City Council of the City of Austin, Texas: I herewith submit to you my report as to proposed improvements upon the ten alleys listed as follows: : (1) The Alley lying between Second Street and Third Street and Brazos Street and San Jacinto Street; (2) The alley lying between Fifth Street and Sixth Street and Neches Street and Red River Street; (3) The alley lying between Sixth Street and Seventh Street and Brazos Street and San Jacinto Street; (4) The alley lying between Seventh Street and Eighth Street and Lavaca Street and Colorado Street; (5) The alley lying between Eighth Street and Ninth Street and Colorado Street and Lavaca Street, in Block 99, Original City. Metcalre, City Engineer. # 427 The Mayor laid before the Council the following resolution: RESOLUTION APPROVING THE CITY ENGINEER'S REPORT CONCERNING IMPROVEMENTS ON THE CERTAIN ALLEYS NAMED IN THIS RESOLUTION IN THE CITY OF AUSTIN, TEXAS, DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST THE OWNERS OF PROPERTY ABUTTING ON SAID ALLEYS AND AGAINST THEIR PROPERTY; DIRECTING A HEARING OF PROPERTY OWNERS CONCERNING THE ASSESSMENT OF A PART OF THE COST OF SUCH IMPROVEMENTS AGAINST SUCH PROPERTY OWNERS AND THEIR PROPERTY; FIXING A TIME FOR SAID HEARING, AND DIRECTING THAT NOTICE BE GIVEN TO SAID PROPERTY OWNERS CONCERNING SAID HEARING. WHEREAS, the City Council of the City of Austin has heretofore determined to improve the certain alleys hereinafter named, within the limits hereinafter named, in the City of Austin, Texas, by paving the same with six inch reinforced concrete pavement, and has adopted specifications for said work, and has entered into contract for said work with Dozier Construction Company; and WHEREAS, the City Engineer of the City of Austin has filed his report in writing with the City Council, showing the total costs of said improvements, on and upon each of said alleys, the amount per front foot of abutting property to be paid by the owner thereof, the names of the owners of the property abutting said improvements, the description of said property, and a statement of the total amount payable by each of said owners for said improvements; and and WHEREAS, the City Council has examined said report and has found same correct; WHEREAS, the necessity exists that a portion of the costs of said improvements should be assessed against said property owners and their property, subject to the terms of the charter of the City of Austin and the ordinance in such cases made and provided, and after the notice and hearing provided by said charter and ordinances; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: SECTION 1. THAT said report of the City Engineer be and the same is hereby approved and adopted, and ordered spread upon the minutes of the City Council. SECTION 2. THAT a portion of the cost of making said improvement shall be assessed against the owners of property and against the property abutting on said alleys respectively, all situated in the City of Austin, Texas; that said assessment shall be made at the rate hereinafter named per front or linear foot of each such property. for paving, in accordance with the "FRONT FOOT RULE OR PLAN" and in proportion to the frontage in that block to be paved; provided that if said rule of apportionment shall appear to the City Council to be unjust or unequal in any particular case or to result in an assessment in excess of the benefits received through said improvements by any owner or his property, the City Council shall adopt such rule of apportionment as shall effect substantial equality and justice between said property-owners, considering benefits received by and burdens imposed upon said owners; and that in no event shall any assessment be made in excess of the actual benefits received by the owners of said property through the enhanced value thereof by means of said improvements; the certain alleys to be improved, the names of the owners of property abutting respectively thereon, the description of said property, the number of front feet owned by each said person, the amount contemplated to be assessed against each lot or parcel of property, and its owner, being as follows, to-wit: 428 The Alley lying between Second Street and Third Street and Brazos Street and Ban Jacinto Street. M. at the City Hall in the City of Austin, Texas, at which hearing said property owners, their agents or attorneys snall be fully and fairly heard as to all matters concerning the said improvements, or any irregularity or invalidity in the proceedings with reference thereto, or as to the benefits thereof, if any, to their property and as to the assessments proposed to be made against them and their property, and as to any other matter or thing connected therewith, at which hearing said owners shall nave the right to produce witnesses and testimony and which hearing may be adjourned from time to time and from day to day , until all are fully heard, and all matters in connection with said improvements and assessments are fully ascertained; that after said hearing shall be closed the City Council will proceed to assess against the owners all property upon said alleys and against the property, who shall agree with the City Council upon the said assessments, such sums as may be so agreed upon and determined, as provided by the City onarter and said ordinances; that as to any such property owners, who may not so agree, the City Council will, after said hearing, take the necessary legal steps for the appointment of a commission to determine said assessments, and will take such further steps in the ascertainment thereof as are provided by the City Charter and pertinent ordinances. SECTION 4. THAT the City Manager of the City of Austin is hereby directed to give notice hereof το said property owners, their agents and attorneys, by publication of a copy of this resolution, not less than twice in the Austin Statesman, a daily newspaper of general circulation in the City of Austin, the first publication to be not less than five days prior to the date of said nearing, which notice being published snall be a sufficient and legal notice. The Mayor laid before the Council the following: *TO THE HONORABLE CITY COUNCIL OF AUSTIN, TEXAS, City Hall, Austin, Texas. Gentlemen: It is my desire to install an additional gasoline storage tank, not to exceed 18,000 gallons capacity, and necessary equipment including pump, for the sale and transportation of gasoline, on the following described lot in the City of Austin, Travis County, TТехав: Beginning at the southeast corner of Lot #55, "Central Row"; thence westward along the south lines of Lots 55, 54, and 53, of "Central Row" 74 feet; thence northward at a right angle thereto, 65 feet to a point 8.5 feet south of Lessor's Leitnecker track; thence northeastward parallel with said tracks, 75 feet; thence southward, along east line of Lot 55, 87 feet to beginning. Said property having been formerly occupied by Sinclair and by the Austin Oil Company. It lies directly east and adjoining tract occupied by the Cities Service Oil Company and west of Texas Oil Company warehouse. I, therefore, apply to your Honorable Body to grant a permit for the installation of the above described storage tank and equipment. I desire to further call your attention to the fact that there is already installed on this property a warehouse for the storage of oil, and it is at present being used for oil storage; also one gasoline storage tank. Stewart asking permission to install and operate a wholesale gasoline station at 1216-20 East 4th Street, make the following report: We, the committee, recommend that this permission be granted, subject to the following conditions: 1. That building plans be approved by the City Building Inspector. 2. That gasoline storage tanks and pumps, and equipment used in connection therewith shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 431 432 3. That electric lights only shall be used for lighting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline stations and shall be approved by the Oity Electrical Department. 4. That "No Smoking" signs shall be displayed at all times, and no person shall be permitted to smoke or to have any open flame on premises where gasoline is sold or stored. 5. That there shall be kept in an accessible place at all times a chemical fire extinguisher for emergency use. Connections to be made under the 6. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. supervision of the City Engineering Department. 7. That permission shall be granted subject to the above conditions, and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating wholesale gasoline stations, and said permission shall be held to be granted and accepted subject to all neceввагу, reasonable, and proper present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said J. Hamby, came up for discussion, and Councilman Mueller moved that the matter be referred to the City Manager and City Engineer for adjustment. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Councilman Pannell moved that the Council recess, subject to call of the Mayor.
