REGULAR MEETING OF THE CITY COUNCIL: 455 Austin, Texas, May 31, 1928. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, 3; absent, Councilmen Reed and Steck, 2. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Mayor McFadden, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none Councilmen Reed and Steck absent. After a discussion of the matter with Hugo Kuehne, Architect, Councilman Mueller moved that the following work be authorized to be done at the City Hospital: Encasing Oil Tank with concrete at a cost of approximately $225.00; Changing the electrical connection of the Elevator, at a cost of $139.00; Replacing 2" with 4" water pipe, changing location of Water Main and reconnecting present fire line in Hospital, at an approximate cost of $172.44. Motion was seconded by Councilman Pannell and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilman Reed and Steck absent. A committee, composed of Fred Morse and others, presented a petition, signed by the property owners, asking that Duval Street between 264 and 43rd Streets be included in the paving program soon to be commenced by the City and that same be paved with a permanent type of paving. Councilman Mueller moved that the petition be received and filed and assurance be given the Committee that this street will be included in the early paving program. Motion was seconded by Councilman Pannell and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden moved that the City Attorney be directed to prepare an ordinance creating the Parks and Playgrounds Commission and defining their duties and submit same to the Council at its next regular meeting. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden called up for its second reading the following ordinance: AN ORDINANCE REGULATING TRAFFIC IN ALLEYS, AND IN THE STREET INTERSECTIONS THEREOF, IN THE CITY OF AUSTIN, AND PRESCRIBING PENALTIES. The ordinance was read the second time and laid over. Mayor McFadden laid before the Council for its second reading the following ordinance: AN ORDINANCE REGULATING TRAFFIC ON WEST EIGHTH STREET, IN THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETO- FORE ORDAINED, REPEALING ORDINANCES IN CONFLICT AND PRESCRIBING PENALTIES. , The ordinance was read the second time and laid over. Mayor McFadden laid before the Council the following: Mr. Adam R. Johnson, City Manager, Dear Sir: Austin, Texas. "Austin, Texas, May 28,1928 We, Severn Bros., Agents for the Pierce Petroleum Corporation, request trat we be granted a permit for the installation of one gasoline pump and underground 456 tank at Campbell's Service Station located at First Street and Congress Avenue. Yours truly, SEVERN BROTHERS, By (Sgd) H. F. Severn." "Hon. Mayor and City Council, Gentlemen: We, your committee on the application of Severn Bros., asking permission to install and operate a drive-in gasoline filling station at 1st and Congress Avenue, make the following report: We, the Committee, recommend that this permission be granted subject to the following conditions: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways shall be covered with metal. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. shall be of an approved type and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. That gasoline storage tanks and pumps and equipment used in connection therewith 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alleyway. The pumps shall be at least ten feet inside the property line. 5. That electric lights only shall be used for lighting purposes and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. ٥٠ That "NO SMOKING" signs shall be displayed at all times, and no person snall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at alltimes a chemical fire extinguisher for emergency use. 8. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department. , 9. That a plan of the filling station showing the proposed location of pumps, driveways and methods of draining away waste water and oils shall be filed with and approved by the City Engineer before the commencement of construction. 10. That permission shall be grented subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said Severn Brothers have failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Mayor McFadden laid before the Council the following ordinance: AN ORDINANCE PROHIBITING NEGLIGENT COLLISIONS, DEFINING NEGLIGENCE, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. Sullivan, who requests permission to install a plant to be used for the reclaiming of crank case oil, said plant to be located at 400 West Monroe Street, in South Austin, make the following recommendations: We, the Committee, recommend that this permission be granted, subject to the following conditions: 1. That all buildings and equipment to be used in connection with the operation of this plant shall be placed inside of the property line. 2. That any buildings that may be erected shall be constructed in accordance with the requirements of the building regulations governing construction of buildings to be occupied for purpose of refining or filtering oils. That lighting shall be done with electric lights only and all electric wiring for lighting or power purposes shall be done under the direction of the City Electrical Department. 4. That tanks and other equipment to be used in the process of reclaiming said crank case oil snall be of substantial construction, and shall be kept in good repair at all times. 5. That proper drainage shall be provided to care for any waste oils. 6. That premises shall be kept free of accumulations of waste oil, or other materials that may create a fire hazard, or which may create conditions that may be objectionable to adjoining property owners. 7. That plant shall be used only for the purpose of reclaiming crank case oil, as stated in the application. 8. That the City Council shall retain the right to revoke said permit at any time that the holder of same uses said plant for any purpose other than that stated in the application (reclaiming crank case oils), or small violate any of the conditions stated above. K. Hudson, in such manner as he deems best. City Manager Johnson advised the Council that he had appointed the following as members of the Building Code Committee: Frank R. Rundell; Munsey Wilson; H. F. Kuehne; C. W. Moore; Edwin C. Kreisle. Crockett that he be reimbursed for the fill which he has made, abutting on the Congress Avenue and Barton Springs Road Dykes, amounting to 5511 cubic yards, at 20 per cubic yard, making the sum of $1,000.00, be accepted; and the sum of $1,000.00 is hereby appropriated out of the General Fund for the purpose of paying said M. H. Crockett, and a warrent in his favor is directed to be issued therefor.
