City Manager Johnson advised the Council that he had appointed A. L. Love as Assistant City Attorney. City Manager Johnson was authorized by the Council to contract with the Austin Gas Company for gas connection to the boilers at the Power Plant, at an approximate cost of $7200.00, such amount not to be paid, however, until it is proven, after a thorough test, that this mode of heating is economically efficient. , Councilman Steck moved that the Council recess, subject to call of the Mayor, Motion was seconded by Mayor McFadden and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council for final passage the following ordinance, which had previously passed its third reading: AN ORDINANCE CREATING THE OFFICE OF CITY GAS INSPECTOR, AND DEFINING THE DUTIES OF SUCH OFFICE; CREATING A BOARD FOR THE EXAMINATION OF GAS-FITTERS, AND PROVIDING FOR THE EXAMINATION AND LICENSE OF GAS-FITTERS; PROVIDING FOR THE INSPECTION OF GAS AND GAS METERS; PRESCRIBING RULES AND REGULATIONS FOR THE QUALITY, PRESSURE AND MEASURE OF GAS SUPPLIED TO CONSUMERS, AND FOR THE ENFORCEMENT THEREOF; PROVIDING RULES AND REGULATIONS FOR THE INSTALLATION AND MAINTENANCE OF GAS PIPING AND FIX- TURES; AND PROVIDING PENALTIES FOR THE VIOLATION OF THE ORDINANCE. Dear Mr. Johnson: We herewith request permission to change location of two of our gasoline pumps at our #2 Station, located at 100 Congress Avenue. Attached you will find a sketch of our station, showing how the pumps are located at present. You will notice that our #4 pump is located right next to the sidewalk on ·'1st Street and we want to move that pump to the middle aisle, as indicated by arrow, but by doing this we will have to move our #3 pump over about between three or four feet, which will put it within about six feet from the sidewalk. I understand however, that a pump should be ten feet or more from the property line, but by granting us permission to move these two pumps as suggested, it will eliminate our #4 pump being right next to the sidewalk, as it is now. Dear Sir: We have received a request from the Grayburg 011 Company for a permit to change the location of two of their gasoline pumps, making the observation that one of their pumps is now adjacent to the street line. Under the proposed new arrangement, there would be two pumps in position contrary to the standards adopted by the Safety Committee and as approved by the City Council on former occasions. The present pump is so inconveniently located that the public is not tempted very much to use same and therefore the law in regard to being upon sidewalk area while being filled is violated less under present arrangement than would be under proposed arrangement. Gentlemen: I hereby make application to install a gasoline pump and tank, 550 gallon capacity, at my filling station located at 1201 East llth Street. Yours very truly, (Sgd) J. C. Stark. " Hon. Mayor and City Council, Gentlemen: We, your committee on the application of J. C. Stark, asking permission to install and operate a drive-in gasoline filling station at 1201 East 11th Street, make the following report. We, the committee, recommend that this permission be granted subject to the following conditions: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment installed. Ines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways shall be covered with metal. Supports for portion extended over drive- ways to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State Regulations governing such installations. equipment to be inspected and approved before being placed in service. All 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street, or alleyway. The pumps shall be at least ten feet inside the property line. 5. That electric lights only shall be used for lighting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at all times, a chemical fire extinguisher for emergency use. 8. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department. 9. That a plan of the filling station, showing the proposed location of pumps, driveways and methods of draining away waste water and oils shall be filed with and approved by the City Engineer before the commencement of construction. 10. That permission shall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessaгу reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said J. Gentlemen: I am at present operating a gasoline filling station at 1301 South Congress Avenue and my gasoline dispensing equipment consists of one underground storage tank with necessary connections for two gasoline pumps. I respectfully request a permit to replace my old model pumping equipment with two late model pumps. The only underground work that will be required will be the replacing of check valves and possibly a few nipples. I would greatly appreciate your favorable action on this matter. Yours very truly, (Sgd) A. W. Wustenhausen." "Austin, Texas, July 18, 1928. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: Mr. A. W. Wustenhausen, a lessee of Mr. Tom Short, has made a request for permit to install a new underground storage tank at 1301 South Congress Avenue. This station is now being operated contrary to city ordinances, as his pumps, tanks, and building are upon city property. They are out in both Congress Avenue and waht is known as the Circle. We recommend that the matter be referred to the City Attorney, and that the proper parties be notified to remove their station in such a way that there is no violation of present ordinances or encroachment upon city property. Councilman Mueller moved that the City Manager be authorized to proceed with the purchase of a strip of ground, 20x210 feet, south of Spence Street and west of Waller Street, for the purpose of widening Spence Street, the consideration for same not to exceed Five Hundred Dollars ($500.00). A petition signed by the property owners on Lavaca Street in the vicinity of Protection Fire Hall, protesting against the removal of said fire station from its present location, was read, and Councilman Pannell moved that the protest be received and filed. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Steck moved that the City Manager be authorized to arrange with the United States Government officials for the taking of a special census for the City of Austin, at a cost of $1500.00, and that said amount be appropriated out of the Water and Light Fund for this purpose. Mayor McFadden laid before the Council the following resolution: THEREAS, the Austin Gas Company has heretfore been granted permission to cut the pavement on West Sixth Street from West Lynn Street to Rio Grande Street for the purpose of making necessary repairs to their gas mains; and WHEREAS, they now make application to extend these repairs east from Rio Grande Street to Congress Avenue on Sixth Street; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: THAT the said Austin Gas Company be and they are hereby granted permission
