  • Expanded Gas Infrastructure & Special Census:

    Approved a significant expansion of Austin Gas Company's network, allowing new gas mains to be laid across multiple city streets. The city also authorized a $1,500 special census to update population figures.
  • Public Protests & Property Tax Adjustments:

    Citizens voiced opposition to a proposed city limits expansion (LaPrelle Place) and the removal of the Protection Fire Hall. The city also adjusted several property tax valuations for residents who showed overvaluation or non-existent improvements.
  • New Business Safety & Traffic Flow:

    Permits were granted for two new gasoline filling stations with strict conditions on safety, construction, and waste disposal. New traffic regulations were implemented for East Seventh Street, and a parking restriction on Brazos Street was repealed.

Councilman Reed moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Council then recessed. REGULAR MEETING OF THE CITY COUNCIL: 489 Approved en Mayor. Austin, Texas, July 26, 1928. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; absent, none. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Talbot LaPrelle appeared before the Council to protest against the inclusion of LaPrelle Place in the proposed extension of the city limits. The Council took the matter under advisement. A petition signed by the property owners on Lavaca Street in the vicinity of Protection Fire Hall, protesting against the removal of said fire station from its present location, was read, and Councilman Pannell moved that the protest be received and filed. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Steck moved that the City Manager be authorized to arrange with the United States Government officials for the taking of a special census for the City of Austin, at a cost of $1500.00, and that said amount be appropriated out of the Water and Light Fund for this purpose. Motion was seconded by Councilman Reed, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following resolution: THEREAS, the Austin Gas Company has heretfore been granted permission to cut the pavement on West Sixth Street from West Lynn Street to Rio Grande Street for the purpose of making necessary repairs to their gas mains; and WHEREAS, they now make application to extend these repairs east from Rio Grande Street to Congress Avenue on Sixth Street; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: THAT the said Austin Gas Company be and they are hereby granted permission 490 to cut the pavement in accordance with their application of July 20th, 1928, subject to the repairs of the street being in compliance with the City Ordinance and to the satisfaction of the City Engineer, and City Manajer. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilzen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Reed was excused from the Council Chamber. Mayor McFadden laid before the Council the following resolution: WHEREAS, the improvements on 12 feet of Lot 3, and all of Lots 4 and 5, Block 18, Hyde Park #1, owned by Richard A. Hittson, were assessed for the year 1926 at a valuation of $1500.00; and WHEREAS, it appears from the attached affidavit of said Richard A. Hittson that only about $400.00 worth of said improvements were located on said lots on January 1st, 1926; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, in view of the above facts, the improvements on said 12 feet of Lot 3 and all of Lots 4 and 5, Block 18, Hyde Park #1 be and the seme are hereby reduced from $1500.00 to $400.00, and the Assessor and Collector is hereby authorized to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, the improvements on Lot 4, Block 4, Travis Heights, owned by George Barnhart, were assessed for the year 1927 at a valuation of $255.00; and WHEREAS, it appears from the attached affidavit of said George Barnhart that these improvements did not exist on the 1st day of January, 1927; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said improvements on Lot 4, Block 4, Travis Heights, amounting to $265.00, be and the same are hereby stricken from the tax rolls for the year 1927, and the Assessor and Collector is hereby authorized to change his books accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, the improvements on 50x208 feet of Lot H, Block 1-0, J. E. Bouldin Addition, owned by Alene Brocker, were assessed for the year 1927 at a valuation of $1130.00; and WHEREAS, it appears from the attached affidavit of said Alene Brocker that these improvements are old and of very cheap construction, having neither sewerage nor electric lights, and that the valuation as placed on same is excessive; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, in view of the above facts, the valuation on said improvements be and the same is hereby changed from $1130.00 to $700.00 for the year 1927, and the Assessor and Collector is hereby authorized to change his rolls accordingly. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct gas mains in and under the following streets: (1) A 4 inch gas main on Leon Street beginning at a point 18 feet west of and 68 feet south of the intersection of the south line of W. 23rd Street and the east line of Leon Street. Thence southerly along a line 18 feet distant from and parallel to the east line of Leon Street to the north line of W. 22nd Street, said gas line to have a cover of not less than 2 feet. (2) A 4 inch gas main on W. 224 Street, beginning at point on the 4 inch gas line on Leon Street, the assignment for which is given above, said point being lo feet south of the north line of W. 222 Street and 18 feet west of the east line of Leon Street. Thence westerly 85 feet along a line lb feet distant from and parallel to the north line of W. 22 Street to a 4 inch gas main now in place, said gas main to have not less than 2 feet of cover. (3) A 2 inch high pressure gas main on Brooklyn Avenue, beginning at a point 17 feet south of and 13.5 feet west of the intersection of the north line of Live Oak and the east line of Brooklyn Avenue. Thence northerly along a line 13.5 feet distant from and parallel to the east line of Brooklyn Avenue to the south line of Leland Street, said gas main to have not less than 2 feet of cover. (4) A 4 inch gas main on Tom Green Street, beginning at a point 10 feet south of and 22 feet west of the intersection of the south line of the alley between E. 35th Street and E. 38th Street, and the east line of Tom Green Street. Thence southerly 450 feet along a line 22 feet distant from and parallel to the east line of Tom Green Street to a 4 inch gas main now in place, said gas line to have not less than 2 feet of cover. (5) A 4 inch gas main on West 38th Street, beginning at a point in the east line of San Gabriel Street, said point being 31 feet north of the intersection of the south line of West 38th Street and the east line of San Gabriel Street. Thence westerly along a line 31 feet distant from and parallel to the south line of West 38th Street to the west line of Alice Avenue. The Austin Gas Company is hereby given notice that this line must be shown its workmen by the Engineering Department of the City of Austin, Texas, before the commencement of any construction. (6) A 4 inch gas main on Alice Avenue, beginning at a point on the 4 inch gas main on West 38th Street, the assignment for which is given above, said point being 15 feet west of the east line of Alice Avenue. Thence northerly along a line 15 feet distant from and parallel to the east line of Alice Avenue to the south line of Julia Street, said gas line to have a cover of not less than 2 feet at all points except at the West 38th Street intersection where it will be necessary to pass under an existing storm sewer pipe on the north side of West 38th Street. (7) A 4 inch gas main on San Gabriel Street beginning at a point 10 feet west of and 31 feet north of the intersection of the south line of West 38th Street and the east line of San Gabriel Street. Thence southerly along a line 10 feet west of and parallel to the east line of San Gabriel Street to the north line of West 37th Street, said gas line to have a cover of not less than 2 feet. (8) A 4 inch gas main on Duval Street, beginning at a point 11.5 feet west of and 18 feet north of the intersection of the east line of Duval Street, and the north line of East 43rd Street. Thence northerly along a line 11.5 feet distant from and parallel to the east line of Duval Street to the south line of East 44th Street, said gas line to have a cover of not less than 3 feet. 491 492 (9) A 4 inch gas main on Canterbury Street, beginning at a point 193 feet east of and 18 feet south of the intersection of the east line of Waller Street and the north line of Canterbury Street. Thence westerly along a line 18 feet distant from and parallel to the north line of Canterbury Street to the west line of Waller Street, said gas line to have a cover of not less than 2 feet. (10) A 4 inch gas main on Waller Street, eet, beginning at a point 18 feet south of and 17 feet west of the intersection of the north line of Canterbury Street and the east line of Waller Street. Thence northerly along a line 17 feet distant from and parallel to the east line of Waller Street to the south line of Willow Street, said gas line to have a cover of not less than 2 feet. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. Mayor McFadden laid before the Council the following: "July 25th, 1928. Hon. City Council, City of Austin, Austin, Texas. Chairman: I hereby make application for installing another pump at my filling station located at 27th and Guadalupe Streets, Austin, Texas. Yours truly, (Sgd) Louie Dunbar." "Hon. Mayor and City Council, Gentlemen: We, your committee on the application of Louie Dunbar asking permission to install and operate a drive-in gasoline filling station at 27th and Guadalupe Streets, make the following report. We, the committee, recommend that this permission be granted subject to the following conditions: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts, or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways shall be covered with metal. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type, and snall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alleyway. The pumps snall be at least ten feet inside the property line. 5. That electric lights only snalı be used for lignting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at all times a chemical fire extinguisner for emergency use. 8. That provision saall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department. 1 9.a. That a plan of the filling station, showing the proposed location of pumps, driveways and methods of draining away waste water and oils shall be filed with and approved by the City Engineer before the commencement of construction. १.७. That all gasoline pumps, tanks, equipment and piping connected thereto shall be inspected and approved by the City Plumbing Inspector. 10. That permission snall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Louie Dunbar has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Mayor McFadden laid before the Council the following: "Austin, Texas, July 20, 1928. City Manager of Austin, Texas. Dear Sir: I am now making an application for a filling station at 2117 East Avenue, known as the A. K. Black Station, and has been operated by him. We expect to use same tank and pipes that have been used by the Magnolia Petroleum Company and make no changes whatever, only different pumps. Please advise if it will be agreeable I am, > Yours respectfully, (Sgd) J. G. Gemel. " "Austin, Texas, Hon. Mayor and City Council, Gentlemen: We, your committee on the application of J. G. The ordinance was read the first time and Councilman Mueller moved that the rule be suspended and the ordinance placed on its second reading. Motion was seconded by Councilman Steck, and sare prevailed by the following vote: Ayes, Kayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilman Mueller moved that same be finally passed.
