City Manager Johnson was directed by the Council to confer with the Park Commission relative to the purchase of the property at 19th and East Avenue for street purposes, pending the application of Grayburg 011 Company for permit to erect a filling station at this location. Mayor Pro tem Pannell laid before the Council the following: "Austin, Texas, August 13, 1928. To the Mayor and City Commissioners, City. Honorable Sirs: We would thank you for permission to replace the two 10 gallon pumps now at our filling station, located at 1900 Guadalupe Street with two new gasoline pumps of the same design and with thanks for your kind consideration, remain, Yours very truly, THE TEXAS COMPANY, By R. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways shall be covered with metal. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 4. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Austin Gas Company be and the same is hereby permitted to lay and construct ite gas mains in and upon the following streets: (1) A 4 inch gas main on East 32nd Street, beginning at a point 23 feet west of and 23 feet south of the intersection of the north line of East 32nd Street and the east line of Duval Street; Thence easterly along a line 23 feet distant from and parallel to the north line of East 32nd Street to the west line of Harris Park Avenue, said gas line to have a cover of not less than 1 1/2 feet. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, Reed, and Steck, 4; nays, none, Mayor McFadden absent. 517 518 Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of underground conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its underground conduits as follows: (1) An underground conduit across Congress Avenue at the intersection of Congress Avenue and 14th Street, said conduit to begin at a point 23 feet west of and 9 feet north of the intersection of the west line of Congress Avenue and the south line of 14th Street.. Thence easterly along a line 10 feet north of and parallel to the south line of 14th Street to a point 30 feet west of and 9 feet north of the intersection of the cast line of Congress Avenue and the south line of 14th Street. This assignment places conduit 10 feet south of the face of the curb on the south side of 14th Street. That the work and laying of said conduit, including the excavation of the streets and the restoration and maintenance of said streets, curbs, walks and lawns after said conduits have been laid, shall be under the supervision and direction of the City Manager. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) A pole and guy on 14th Street, said pole to be 23 feet west of and 10 feet north of the intersection of the south line of 14th Street and the west line of Congress Avenue; The guy for this pole is to enter the ground 27 feet east of pole, this point being 4 feet east of the west line of Congress Avenue. (2) A pole and guy on 14th Street, said pole to be 30 feet east of and 10 feet north of the intersection of the east line of Congress Avenue and the south line of 14th Street. The guy for pole is to enter ground 30 feet west of pole. The assignments in (1) and (2) place the poles 9 feet south of the face of the curb on the south side of 14th Street. (3) A pole and guy onlath Street, said pole to be 127 feet east of the face of the east curb on Congress Avenue and approximately 3 feet north of the face of the north curb on 18th Street. This pole is to be in line with the present pole line on 18th Street and the guy for said pole is to enter ground 30 feet west of pole. (4) A pole and guy on 18th Street, said pole to be 70 feet west of the face of the west curb on Congress Avenue and approximately 3 feet north of the face of the north curb on 18th Street. This pole is to be placed in line with the present pole line on 18th Street and the guy for said pole is to enter ground 30 feet east of pole. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. 519 The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, Reed, and Steck, 4; nays, none. Mayor Pro tem Pannell laid before the Council for final consideration the following report of the Parks and Playgrounds Commission which was submitted to the Council at its last regular meeting: To the Honorable Council of the City of Austin, Gentlemen: "Austin, Texas, August 9,1928 We hereby beg to submit the first report of the Parks and Playgrounds Board, after a number of meetings of careful deliberations and investigations, with the request that the same be given your earnest consideration and approval We recommend the adoption of the following items: (1) The completion of the parking of East Avenue. A statement of the cost is hereto attached. This statement covers the completion of the parking, with the exception of three sections which, on account of their rugged topography, require special treatment, and for this we request the authority to employ an expert landscape architect for the preparation of the detailed plans for the development of these sections. We beg to request that this work be done at once as the same is simple, inexpensive, and the completion of the policy already begun. This property consists of Lots 1, 2 (2) We further recommend the purchase of the property north of Winn School for the purpose of a neighborhood playground as a part of the general playground system for the City of Austin and 3, being 46 feet by 128 feet, Lot 14, being 23 feet by 120 feet, and Lots 15, 16, and 17, being 46 feet by 120 feet. There are two houses on this property, one a six room house and the other a four room house. The price requested for this property is $10,500.00, but we believe that it may be purchased for a lesser sum. We further respectfully request the Council for a grant of such clerical aid and filing space, for the preservation of the minutes and records of the Board, as may be necessary for the work of the Board. Councilman Reed moved that the above report of the Park Commission, relative to the parking of East Avenue and the employment of such clerical aid and filing space as needed, be adopted, and the City Manager be directed to carry out these recommendations, and that the City Manager be further instructed to ascertain if the services of Koch & Fowler would be available under their contract existing with the city for the landscape work requested in said report, and also to confer with the owners of the property adjacent to Winn School and report to the Council the lowest price at which this property can be purchased. The Council agreed to the recommendation of the City Manager for an extension of the lignite contracts for $1.98 per ton delivered, for a period of sixty days, pending the test on natural gas now being made at the Plant. The Council agreed to the arrangement made by the City Manager with the owners of Greyhound Bus Station for parallel parking of northbound busses in front of their station on Brazos Street for the loading and unloading of passengers only, and for the parking in the alley adjacent to their station of southbound 520 busses and for making left turn onto Brazos Street by southbound busses when the north red signal light is showing at 6th and Brazos Streets. Councilman Mueller moved that the City Manager be authorized to install a fire escape at the new unit of the City Hospital, at an approximate cost of $425.00. Motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, Reed, and Steck, 4; nays, none, Mayor McFadden absent. A petition, signed by August Schenck and others, protesting against the inclusion of a part of Ridgetop in the proposed city limits extension, was read and ordered filed and the petitioners were given assurance that the matter would be taken under advisement. M. O. Rhody appeared before the Council relative to the erection of a filling station on the property owned by him at 19th and East Avenue. Action on the matter was held in abeyance, pending a further conference of the City Manager with the Park Board. City Manager Johnson laid before the Council letter from Stanley S. Smith protesting against the valuation of $2765.00 for the year 1927 placed on Lot 5, Block 2, Outlot 69, Division "D", owned by him, and also letter from S. W. Mabry, Finance Director, showing that this property is equalized with adjoining property. Councilman Reed moved that in view of the facts as presented to the Council, the claim of said Stanley S. Smith for a reduction in his assessment be not allowed, and the City Manager be directed to so advise said Stanley S. Smith.
