Councilman Mueller moved that the City Manager be authorized to install a fire escape at the new unit of the City Hospital, at an approximate cost of $425.00. Motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, Reed, and Steck, 4; nays, none, Mayor McFadden absent. A petition, signed by August Schenck and others, protesting against the inclusion of a part of Ridgetop in the proposed city limits extension, was read and ordered filed and the petitioners were given assurance that the matter would be taken under advisement. M. O. Rhody appeared before the Council relative to the erection of a filling station on the property owned by him at 19th and East Avenue. Action on the matter was held in abeyance, pending a further conference of the City Manager with the Park Board. City Manager Johnson laid before the Council letter from Stanley S. Smith protesting against the valuation of $2765.00 for the year 1927 placed on Lot 5, Block 2, Outlot 69, Division "D", owned by him, and also letter from S. W. Mabry, Finance Director, showing that this property is equalized with adjoining property. Councilman Reed moved that in view of the facts as presented to the Council, the claim of said Stanley S. Smith for a reduction in his assessment be not allowed, and the City Manager be directed to so advise said Stanley S. Smith. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, and Reed; absent, Mayor McFadden and Councilman Steck, 2; nays, none. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, the General Budget of the City of Austin for the year 1928 provides an appropriation of $3,000.00 for Public Liability Insurance, Account No. 77403; and WHEREAS, it having been ascertained from an audit of the pay rolls of the city by the Zurich General Accident and Liability Insurance Company that there is an additional premium of $479.82 due on said policy for the year 1927; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Four Hundred, Seventy-nine Dollars and Eighty-two Centa ($479.82) be and the same is hereby transferred from the Item of "Reserve for Contingencies" in the budget for the Water, Light and Power Department for the year 1928, and credited to Account No. 77403-Public Liability Insurance, in payment of said additional premium for the year 1927. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch gas main on West 10th Street, beginning at a point 79 feet east of and 19.25 feet north of the intersection of the south line of West 10th Street and the east line of Baylor Street. Thence westerly along a line 19.25 feet distant from and parallel to the south line of West 10th Street to the east line of Baylor Street, said gas main to have a cover of not less than 1 1/2 feet. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Mueller, and Reed, 3; nays, none, Mayor McFadden and Councilman Steck absent. A petition from the Augustana Association of Charities of the Техав Evangelical Lutheran Augustana Synod of North America, asking that Lots 1, 2, 3, 4, and 5, in the W. A. Harper Re-Subdivision of Blocks 5 to 8, inclusive, of the Ward Addition to the City of Austin, be exempted from taxation on account of same being held for charitable purposes, was read, and Councilman Reed moved that so long as this property is held as a site for a charitable institution, the Tax Assessor and Collector be instructed to allow the taxes against same to accrue, and in the event that a building is erected thereon for said purpose, the taxes so accrued shall be remitted; but, in the event 521 522 that this property is later disposed of and not used for charitable purposes, the taxes so accrued against same shall be collectible. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alleyway. The pumps shall be at least ten feet inside the property line. 5. That all driveways on the city streets and the gutter opposite said driveways, together with all curbs, opposite the filling station, shall be built of concrete in accordance with the standard city specifications for concrete sidewalk work. 10. That permission shall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessary reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said J. That all equipment shall be properly installed and all machines shall be fastened securely to the floor. 2. That all piping shall be protected so that same will not be subject to any injury that may cause leaking of cleaning fluid. 3. That all connections to machines or other equipment shall be properly made, as shall all pipe connections, all joints to be leak proof. 4. That all piping and connections, machines and their working parts shall be kept in proper repair at all times. 5. That all electrical connections to motors or other electrical equipment shall be made in accordance with regulations, and subject to the approval of the city electrical inspectors. 6. That all premises occupied by dry cleaning plants shall be kept free of trash or other accumulations that may cause or promote fire. 7. That there shall be provided a chemical fire extinguisher for emergency use. 8. That "GASOLINE SHALL NOT BE USED" at any time for cleaning or for any other purpose on premises occupied and operated as a dry cleaning plant. That only nonexplosive cleaning fluid shall be used. , 9.
