605 McFadden, Councilmen Mueller and Steck, 3; nays, none, Councilmen Pannell and Reed absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, on the 4th day of October, A. D. 1928, the bids of Janes Contracting Company were accepted for the storm sewer work proposed. for Contract #1 and Contract #2, in the amounts respectively of $74,684.01, and $102,829.50; and WHEREAS, the Janes Contracting Company has entered into contract for the performance of same, as evidenced by its written contracts therefor; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said written contracts entitled, Contract #1 and Contract #2, are hereby approved and the bond executed by said Company assuring the performance of said contracts is hereby approved, and the City Manager is hereby authorized and directed to execute said contracts in behalf of the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Steck, 3; naye, none, Councilmen Pannell and Reed absent. Councilman Steck moved that the Council recess, subject to call of the Mayor. The Council then recessed. REGULAR MEETING OF THE CITY COUNCIL: eden Mayor. Austin, Texas, October 25th, 1928. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; absent, none The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same as read. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The bid of Rogers-Wade Company and the joint proposals of Swann-Schulle Furniture Company, C. A. Dahlich, and Home Furniture Company for equipment for the new unit to the City Hospital were rejected and the City Manager was authorized to call for new bids. A petition signed by property owners, asking that the City permanently pave West 29th Street from Guadalupe to San Gabriel Streets, 606 was read, and Councilman Mueller moved that the petition be received and filed with other petitions for permanent paving. Motion was seconded by Mayor McFadden, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Austin Gas Company be, and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A4 inch gas main on W. 43rd Street, beginning at a cross in the present 4 inch main on Avenue A, said cross being 24 feet south of and 25 feet east of the intersection of the north line of W. 43rd Street and the west line of Avenue "A"; Thence westerly 100 feet along a line 24 feet distant from and parallel to the north line of W. 43rd Street, said gas line to have a cover of not less than 1 1/2 feet. Before construction is started, ed, the Austin Gas Company is required to have this line shown its workmen by the Engineering Department of the City of Austin. (2) A4 inch gas main on East 12th Street, beginning at a cross on the present line on E. 12th Street, said cross being 18 feet north of and 15 feet cast of the intersection of the south line of E. 12th Street and the east line of Trinity Street. Thence easterly along a line 18 feet distant from and parallel to the south line of E. 12th Street to a point 117 feet west of the west line of Neches Street, said gas main to have a cover of not less than 1 1/2 feet. This assignment places line 2 feet south of the south curb. (3) A 4 inch gas main on Canterbury Street, beginning at a point 19.5 feet west of and 18 feet south of the intersection of the east line of Mildred Street and the north line of Canterbury Street. Thence westerly along a line 18 feet distant from and parallel to the north line of Canterbury Street to a point 140 feet west of the west line of Mildred Street, said gas main to have a cover of not less than 1 1/2 feet. (4) A4 inch gas main on Chicon Street, beginning at the end of present line on Chicon Street, this point being 25 feet south of and 21 feet west of the intersection of the south line of East 2nd Street and the east line of Chicon Street. Thence northerly along a line 21 feet distant from and parallel to the east line of Chicon Street, to a point 35 feet north of and 21 feet west of the intersection of the south line of E. 2nd Street and the east line of Chicon Street. (5) A 4 inch gas main on East 2nd Street, beginning at a point 35 feet north of and 21 feet west of the intersection of the south line of E. 2nd Street and the east line of Chioon Street. Thence easterly 221 feet along a line 35 feet distant from and parallel to the south line of Chicon Street, said gas main to have a cover of not less than 1 1/2 feet. (6) A 4 inch gas main on Eva Street, beginning at a point 15 feet south of and 19 feet west of the intersection of the north line of West Johanna Street and the east line of Eva Street. Thence northerly along a line 19 feet distant from and parallel to the east line of Eva Street to a point 18 feet north of the north line of Mary Street, said gas main to have a cover of not less than 1 1/2 feet. (7) A4 inch gas main on Mary Street, beginning at a point on the Eva Street line, the assignment for which is given in item No. 6, said point being 17.5 feet south of and 19 feet west of the intersection of the east line of Eva Street and the north line of Mary Street. Thence westerly along a line 17.5 feet distant from and parallel to the north line of Mary Street to a point 243 feet west of the west line of Eva Street, said gas main to have a cover of not less than 1 1/2 feet. (8) 4 inch high pressure gas main on West 29th Street, beginning at a point 13 feet west of and 17.5 feet south of the intersection of the east line of Salado and the north line of West 29th Street. Thence westerly in a straight line to a point in the east line of Pearl Street and 22 feet south of the north line of West 29th Street. Thence westerly in a straight line to a point in the east line of San Gabriel Street, said point being 12.5 feet south of the north line of West 29th Street. Said gas line to have a cover of not less than 1 1/2 feet. That the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following application: for drive-in gasoline filling station, and the report of the Safety Committee upon same: September 29th, 1928. To the Hon. Board, Commissioners & City Manager, City of Austin. Gentlemen: Petition is hereby made to erect and maintain at Tenth and Lavaca Streets, otherwise known as the old Carrington Place, a combination tire, accessory, gas and oil station. This station to be patterned after the present Firestone place at Fifth and Lavaca Streets. You are earnestly requested to give this matter early attention if I am to obtain a very valuable lease. Respectfully, : (384) Robt. W. Shipp. " "Austin, Texas, Hon. Mayor and City Council, Gentlemen: We, your committee on the application of R. W. Shipp asking permission to install and operate a drive-in gasoline filling station at 10th and Lavaca Streets, Southwest corner, make the following report: We, the committee, recommend that this permission be granted, subject to the following conditions: 1. That all buildings, equipment shall be placed inside of the property line, correct lines to be obtained before construction starts, or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and drivewaya, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways shall be covered with metal. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps, and equipment used in connection therewith shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 607 608 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alleyкау. The pumps shall be at least ten feet inside the property line. 5. That electric lights only shall be used for lighting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at all times a chemical fire extinguisher for emergency use. 8. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department. 9. That a plan of the filling station, showing the proposed location of pumps, driveways and methods of draining away aw waste water and oils shall be filed with and approved by the City Engineer and the City Council before commencement of construction. 10. That all gasoline pumps, tanks, equipment and piping connected thereto shall be inspected and approved by the City Plumbing Inspector. 11. That standard concrete ourb, driveways, curb returns and gutter shall be constructed before operation as a filling station, in accordance with the plan which must be submitted by the applicant and approved by the City Council. That permission shall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the Oity of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said R. W. Shipp has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. (Sgd) J. E. Shipp, subject to the above recommendations of the Safety Committee. City Manager Johnson submitted to the Council a report of the Tax Assessor & Collector, showing that the property of the Mexican Presbyterian Church, 401 Nueces Street, is used exclusively for religious purposes and therefore should be exempt from taxation. Councilman Mueller moved that the City Manager have resolution drawn placing this property on the exemption roll, in accordance with said report. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. Councilman Pannell moved that permit be granted to Burt Brydson to move a two-story house from 23rd and Speedway to a point on Whitis Avenue about one hundred and fifty feet south of 21st Street, over Speedway to 21st Street and Whitis Avenue, upon the following conditions: That said Brydson make bond payable to the City of Austin, with corporate surety, conditioned that he hold the City of Austin harmless from any and all damages that might occur on account of said moving; and further, that he begin said moving at eleven o'clock P. M., after giving the City Engineer notice thereof, and will consume no more than twelve hours on Speedway and the balance of one hundred and twenty (120) hours on 21st Street and Whitis Avenue, and that he pay the City as liquidated damages Two Hundred and Fifty Dollars ($250.00) per day, or fraction thereof, upon default of the conditions with reference to the time of moving, and that he deposit with the City Seventy-five Dollars ($75.00) to cover all damages to electric light wiring, and other property of the City, in said moving and that he will pay all damages to the property owners and public utilities, and that he will destroy or mutilate no treев except three trees belonging to Mrs. J. J. Terrell on the east side of Whitis Avenue, upon proper compensation to said Mrc. Terrell, and the trees in front of his own premises..
