1 REGULAR MEETING OF THE CITY COUNCIL: 623 Austin, Texas, November 22,1928 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, 3; absent, Councilmen Reed and Steck, 2. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Meyor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council the following report from the Park Board: To the Honorable Mayor and City Council of the City of Austin, Austin, Texas. Gentlemen: "Austin, Texas, November 21,1928 After much talk and a lot of time spent on the deal, your Park Board has gotten a price of $20,000.00 from Mr. И. Н. Отоckett on his piece of land, generally known as Eastwoods, comprising of between eight and nine acres. Your Park Board thinks the above price of $20,000.00 very reasonable for this tract of land and recommends your buying it at once. Respectfully, (Sgd) W. T. Caswell, Chairman City Park Commission" Councilman Mueller moved that the above report of the Park Board be approved and the City Manager be authorized to purchase said tract of land known as Eastwoods from M. H. Crockett for a consideration of $20,000.00. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council for its third reading the following ordinance; AN ORDINANCE REGULATING TRAFFIC ON THE SOUTH SIDE OF EAST FIFTH STREET, BETWEEN CONGRESS AVENUE AND BRAZOS STREET, IN THE CITY OF AUSTIN, REPEALING ALL ORDINANCES IN CONFLICT, AND PRESCRIBING A PENALTY. The ordinance was read the third time and Councilmen Pannell moved that same be finally passed. Motion was seconded by Councilman Yueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, 3; neys, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council for its third reading the following ordinance: AN ORDINANCE REGULATING THE STANDING OF VEHICLES ON COLORADO STREET, BETWEEN SIXTH AND SEVENTH STREETS, IN THE CITY OF AUSTIN, REPEALING ALL ORDINANCES IN CONFLICT, AND PRESCRIBING A PENALTY. 624 The ordinance was read the third time and Councilman Mueller moved that same be finally passed. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase in the name of the City of Austin from Mrs. D. Daugherty, Lot 4, in Block 2, of Outlot 10, Division "D", City of Austin, for the consideration of $1,500.00, to be paid in cash; said transaction to be made, provided that good title is shown upon examination by the City Attorney, and complete abstract of title and warranty deed to said property are delivered to the City of Austin. BE IT FURTHER RESOLVED: , THAT the sum of $1,500.00 be transferred from the Water and Light Fund to the Street Improvement Bond Fund, and that said sum be appropriated out of said last named fund to pay for said property, and that a warrant issue therefor; and that said sum of money be returned to the Water and Light Fund out of proceeds from the sale of Street Improvement Bonds. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Four Thousand Dollars ($4,000.00) be and the same is hereby transferred from the Water & Light Fund and credited to the following bond funds; this amount to be reimbursed to said Water & Light Fund from the proceeds of the sale of bonds to be made at a later date: To Street Improvement Bond Fund --- To Sanitary Sewer Bond Fund Total $2,000.00 - 2,000.00 $4,000.00 The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. The application of Joe Nassour for permit to install a gasoline filling station at 901 East 6th Street was read, and also report of the Safety Committee approving the location. Councilman Mueller moved that the Council tentatively approve the location for said station, but that permit for the erection of same be not granted until formally approved by the Safety Committee. Motion wae seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Cas Company be and the same is hereby permitted to lay and construct its gas mains in and under the following streets: (1) A 4 inch gas main on Fairmont Avenue, beginning at a point 50 feet east of and 20 feet south of the intersection of the west line of Travis Heights Boulevard and the north line of Fairmont Avenue; Thence westerly along a line 20 feet distant from and parallel to the north line of Fairmont Avenue to the east line of Alta Vista, said gas line to have a cover of not less than 1 1/2 feet. (2) A 4 inch gas main on Terrace Drive, beginning at a point on the Newning Avenue line, said point being 19 feet south of the north line of Terrace Drive; Thence easterly along a line 19 feet distant from and parallel to the north line of Terrace Drive to the west line of East Side Drive, said gas line to have a cover of not less than 2 feet below the north curb now in place on Terrace Drive. (3) A4 inch gas main in the alley between Newning Avenue and East Side Drive, beginning at a point 19 feet south of and 3 feet east of the inter section of the north line of Terrace Drive and the east line of Lots 15 and 16, Block 4, Bluebonnet Hills Addition. Thence northerly along a line 3 feet distant from and parallel to the east line of Lots 15 and 16, Block 4, to a point 20 feet south of the north line of Lockhart Drive, said gas line to have a cover of not less than 1 1/2 feet. (4) A 4 inch gas main on East Mary Street, beginning at a point 19 feet east of and 30.5 feet north of the intersection of the west line of Newning Avenue and the south line of East Mary Street. Thence easterly along a line 30.5 feet distant from and parallel to the south line of East Mary Street to a point of angle in gas line, said point of angle being northerly 30.5 feet from the northeast corner of Lot 11, Block 5, Blue Bonnet Hills Addition. Thence easterly along a line 30.5 feet distant from and parallel to the south line of East Mary Street to the weet line of East Side Drive, said gas main to have a cover of not less than 2 feet below the top of curb now in place on the south side of East Mary Street. (5) A4 inch gas main on Avenue "F", beginning at a point 24 feet east of and 34 feet south of the intersection of the west line of Avenue "F", and the south line of 44th Street. Thence northerly along a line 24 feet distant from and parallel to the west line of Avenue "F", to the south line of 45th Street, said gas main to have a cover of not less than 1 1/2 feet. (6) A 10 inch steel gas main on South Congress Avenue beginning at a point which is N 19° E 25' from the north line of Milton Street and 3 71° E. 25' from the center line of South Congrese Avenue. Thence N. 19º E. along a line 25 feet distant from and parallel to the center line of South Congress Avenue to a point which is N. 19º E. 5 feet from the south line of East Nellie Street. Thence N. 71° W. 55 feet to a point which is 30 feet west of the center line of South Congress Avenue. Thence N 190 E 700 feet along a line 30 feet distant from and parallel to the center line of S. Congress Avenue to a point. Thence S. 71° E 42 feet to a point which is 12 feet east of the center line of S. Congress Avenue. Thence N. 19º E. along a line 12 feet distant from and parallel to the center line of S. Congress Avenue to the intersection of the north line of Barton Springs Road. Thence N. 71° W. 32.5 feet to a point which is midway between the existing wooden curb and the guard rail on the west side of South Congress Avenue, said point being 20.5 feet west of the center line of S. Congress Avenue. Thence N. 19º E along a line 20.5 feet distant from and parallel to the center line of S. Congress Avenue to the south end of the Colorado Bridge. Line and grades of pipe are to be given the Austin Gas Company by the City Engineer's office before the beginning of construction. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under all the pertinent terms and conditions of the certain franchise granted to said Company by the City 625 626 of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller and Pannell, 3; nays, none, Councilmen Reed and Steck, absent. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be, and the same is hereby permitted to lay , and construct its gas mains in and upon the following streets: A four inch gas main on Canterbury Street, beginning at a point 19 feet south of and 322 feet west of the intersection of the north line of Canterbury Street and the west line of Anthony Street. Thence easterly along a line 19 feet distant from and parallel to the north line of Canterbury Street to the east line of Canadian Street. That the Gas Company be and the same is hereby required to lay and continuously construct its gac main for the entire length of this assignment. That the work and laying of said gas main, including the excavation in the streets and the restoration and maintenance of said street after said main has been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin.
