REGULAR MEETING OF THE CITY COUNCIL: 627 Austin, Texas, November 28,1925 The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller and Pannell, 3; absent, Councilmen Reed and Steck, 2. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same. Motion was seconded by Mayor McFadden and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Pannell, 3; nays, none, Councilmen Reed and Steck absent. Councilmen Reed and Steck entered the Council Chamber. Mayor MoFadden announced that the time was up for submitting bide for $750,000.00 of Austin City Bonds, and the following bids were then opened and read: Bid of Illinois Merchants Trust Company, Harris Trust Company, Garrett & Company, by H. B. Garrett, Dallas, Texas; Bid of Austin National Bank, Amen & Emerich & Company, Lehman Brothers, Northern Trust Company, First National Company of Detroit, Dallas Union Trust Company, J. E. Mayor McFadden laid before the Council the application of The Texas Company for the installation of a gasoline filling station at the southeast corner of 26th and Guadalupe Streets, and also the following recommen- dations of the Safety Committee upon same: "Austin, Texas, November 26,1928. Hon. Mayor and City Council, Austin, Texas. Gentlemen: We, your committee on the application of THE TEXAS COMPANY asking permission to install and operate a drive-in gasoline filling station at the southeast corner of West 26th and Guadalupe Streets, make the following report: We, the committee, recommend that this permission be granted subject to the following conditione: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts, or equip- ment is installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building that extends over driveways chall be covered with metal. Supports for portion extended over drive- way to be supported by brick or reinforced concrete pillare. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 628 4. That gasoline pumps and other equipment used in connection with the operation of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street cr alleyway. The pumps shall be at least ten feet inside the property line. 5. That electric lights only shall be used for lighting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at all times a chemical fire extinguisher for emergency use. 8. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department. 9. That an 8 inch drain line shall be constructed at the expense of the applicant by the Street Department, connecting the nearest storm sewer with an outlet pipe on the west property line of the applicant, it being understood that the cost of this installation will be cost of labor and material plus ten per cent (10%), a deposit to be made in escrow with the City Finance Director based upon an estimate furnished by the City Engineer. 10. That a plan of the filling station, lon, hereto attached, marked Exhibit "A" indicates the layout of the driveways and the use of the City street and sidewalk which must be followed during construction. That the 8 inch pipe and catch basin as shown on the plan, n, so constructed that all waste water and oils and wash water from the station shall concentrate into said catch basin shall be followed in the construction of this station. That all curbs, sidewalks, ramps and a gutter adjacent to the curbs shall be constructed at the expense of the applicant. 11. That all gasoline pumps, tanks, equipment and piping connected thereto shall be inspected and approved by the City Plumbing Inspector. 12. That the Electrical Superintendent shall be given a reasonable notice before the excavation of any concrete curb or gutter in which there is any electric cable now existing. 13. That permission shall be granted, subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted, subject to all necessary, reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said TEXAS COMPANY has failed and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Councilman Pannell moved that permit be granted to said Texas Company, subject to the above recommendations of the Safety Committee. Motion wac seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Kueller moved that the Council accept with thanks the invitation of A. C. Bull to the Council to sit in the reviewing stand for the parade to be given by the Aam Cadets on Thanksgiving morning at ten o'clock. Motion was seconded by Mayor McFadden, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following report of the Board of Equalization: "Austin, Texas, November 28,1928. To the Honorable Mayor and Members of the City Council, Austin, Texas. We, the members of the Board of Equalization, appointed by your Honorable Body to equalize all property values, both real and personal, within the City of Austin for the year 1928, beg leave to report: That we passed on five or six hundred complaintsand visited every piece 629 of property that wae complained of where we could not make adjustment otherwise. We made a number of adjustments, changes and corrections not com- plained of, so as to equalize properties. All parties that came before the Board were given all the time and attention they wanted to state their cases, and we treated all alike without fear or favor. We did all the work that we could possibly do in the time allowed by the City Charter. He could further state that the Board could sit indefinitely and never fully adjust equalization. The Board adjourned November 16, 1928. We wish to extend our thanks to the office force of the Tax Department for the valuable assistance rendered the Board. Respectfully submitted, (Sgd) C. P. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council a map showing the proposed location of a gas main on Travis Heights Boulevard from Fairmount Avenue to a point 295 feet south of the south line of Fairmount Avenue; and WHEREAS, a resolution was passed by the City Council of the City of Austin, Texas, on the 1st day of November, 1928, which resolution was recorded in Minute Book 10, pages 611-612, said resolution assigning space 50 feet east of the west line of Travis Heights Boulevard and requiring that the Austin Gas Company construct the line to the south line of Mariposa Drive; and WHEREAS, it has been decided upon further consideration that the Austin Gas Company will not be required to construct this line for the full length of the block; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Austin Gas Company be and the same is hereby permitted to lay and construct its gas main as follows: A 4 inch gas main on Travis Heights Boulevard, beginning at a point 60 feet south of and 50 feet east of the intersection of the south line of Fairmount Avenue and the west line of Trevis Heights Boulevard. Thence southerly 235 feet along a line 50 feet distant from and parallel to the west line of Fairmount Avenue, said gas line to have a cover of notless than 1 1/2 feet. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed and Steck, 5; nays, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plens have been con630 sidered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Austin Gas Company be, and the same is hereby permitted to lay and construct its gas mains in and under the following streets: (1) A 4 inch gas main on Willow Street beginning at a point 22 feet south of and 152 feet west of the intersection of the north line of Willow Street and the west line of Chicon Street. Thence easterly along a line 22 feet distant from and parallel to the north line of Willow Street to a point 23 feet west of the east line of Chicon Street, said gas main to have a cover of not less than 1 1/2 feet. (2) A4 inch high pressure gas main on East 9th Street, beginning at a point 33.5 feet east of and 22 feet south of the intersection of the west line of East Avenue and the north line of East 9th Street. Thence westerly along a line 22 feet distant from and parallel to the north line of East 9th Street to the east line of Red River Street, said gas main to have a cover of not less than 1 1/2 feet. Before starting construction, this line is to be shown the workmen of the Austin Gas Company by the City Engineering Department. (3) A 4 inch gas main on Cedar Street, beginning at a point 15 feet east of and 35 feet north of the intersection of the west line of Cedar Street and the north line of West 34th Street. Thence southerly 55 feet along a line 15 feet distant from and parallel to the west line of Cedar Street, said gas main to have a cover of not less than 1 1/2 feet. (4) A4 inch gas main on West 34th Street beginning at a point 20 feet south of and 15 feet east of the intersection of the north line of West 34th Street and the west line of Cedar Street. Thence easterly along a line 20 feet distant from and parallel to the north line of West 34th Street to a point 22 feet west of the east line of Speedway, said gas main to have a cover of not less than 1 1/2 feet. (5)A A 4 inch gas main on Fairmount Avenue, beginning at a point 30 feet west of and 20 feet south of the intersection of the east line of Travis Heights Boulevard and the north line of Fairmount Avenue Thence easterly along a line 20 feet distant from and parallel to the north line of Fairmount Avenue to the east line of Kenwood Avenue, said gas main to have a cover of not less than 1 1/2 feet. (6) A4 inch gas main on Kenwood Avenue, beginning at a point 20 feet south of and 20 feet west of the intersection of the north line of Fairmount Avenue and the east line of Kenwood Avenue. Thence southerly along a line 20 feet distant from and parallel to the east line of Kenwood Avenue to the north line of Mariposa Drive, said gas main to have a cover of not less than 1 1/2 feet. (7) ▲ 2 inch gas main on Trinity Street, beginning at a point 15.5 feet west of and 18 feet north of the intersection of the east line of Trinity Street and the south line of East 12th Street. Thence southerly 125 feet along a line 15.5 feet distant from and parallel to the east line of Trinity Street to a point. Thence westerly 7.5 feet along a line 107 feet distant from and parallel to the south line of East 12th Street to a point on the existing 2 inch main on Trinity Street, said gas main to have a cover of not less than 1 1/2 feet. (8) a 4 inch gas main in the alley between Travis Heights Boulevard and Alta Vista Avenue, beginning at a point on the south line of Woodland Avenue, said point being 5 feet west of the east alley line. Thence southerly along a line 5 feet distant from and parallel to the east alley line to the north line of Mariposa Drive, said gas main to have a cover of not less than 1 1/2 feet. (9) A 4 inch gas main on Test 31st Street, beginning at a point 13 feet east of and 16 feet south of the intersection of the west line of King Street and the north line of West 31st Street. Thence southerly along a line 13 feet distant from and parallel to the west line of King Street, to a point 12 feet north of the south line of west 31st Street, said point being 4.5 feet north of a curt in place on the south side of West 3let Street. Thence easterly 150 feet along a line 12 feet distant from and parallel to the south line of West 31st Street, said sas main to have a cover of not less than 1 1/2 feet. (10) A4 inch gas main on Navasota Street, beginning at a point 24 feet south of and 15 feet west of the intersection of the north line of East 16th Street and the east line of Navasota Street. Thence northerly along a line 15 feet distant from and parallel to the east line of Navasota Street to the south line of East 19th Street, said gas main to have a cover of not less than 1 1/2 feet. In constructing this line, take measurements from the fence line marking the east line of Navasota Street. (11) A4 inch gas main on Chicon Street, beginning at a point 35 feet north of and 21 feet east of the intersection of the south line of East 2nd Street and the east line of Chicon Street. Thence westerly 3 feet along a line 35 feet distant from and parallel to the south line of East 2nd Street to a point. Thence northerly along a line 24 feet west of and parallel to the east line of Chicon Street to the north line of East 4th Street, said gas main to have a cover of not less than 1 1/2 feet. (12) A regulator pit at the intersection of East 4th Street and Chicon Street, the center of said pit to be 5 feet south of and 24 feet west of the intersection of the south line of East 4th Street and the east line of Chicon Street, this pit to be placed with the long side parallel to the east line of Chicon Street. That the work and laying of said gae mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden appointed Councilmen Pannell and Steck as a committee to canvass the returns of the special election held in the City of Austin on November 24th, 1928, for the purpose of adopting certain amendments to the City Charter, and the committee having reported that same were found to be correct, the following resolution was laid before the Council: WHEREAS, on the 20th day of September, A. D. 1928, according to law, a resolution was duly passed by the City Council, giving notice of its intention to pass an ordinance providing for the submission to the qualified voters of the City of Austin, Texas, at an election to be held for such purpose, of twenty-three certain propositions to adopt the certain twenty-three amendments to the existing charter of said City, therein respectively contained; and WHEREAS, in accordance with law, notice of intention to submit such propositions at such election was given by publication in the Austin Statesman, a newspaper published in the City of Austin, which notice was published in said newspaper concecutively for ten days on, to-wit, September 21st to September 30th, A. D. 1928, both dates inclusive, the first of said publications being twenty days before the passage of said ordinance; and WHEREAS, under and by virtue of the terms of the certain ordinance passed by the City Council and approved by the Mayor of said City, on the 12th day of October, A.D. 1928, a special election was held in said City, according to law, on the 24th day of November, A. That each of the propositions to adopt the amendment thereunder proposed at said election was sustained, and that at such election each and all of said amendments were approved and adopted by a majority of the qualified voters of said City voting at said election, and that each of said charter amendments thereby became and is now hereby recognized and declared to be a part of the city charter of the City of Austin, Texas, and it is so ordered. 2. That the Mayor and the City Manager be and they are hereby directed to certify to the Secretary of State of the State of Texas an authenticated copy of said amendments, under the seal of the City of Austin, showing the approval of and by the qualified voters at said election of said amendmente, and that the Secretary of State be requested to file and record the same in a separate book to be kept in his office for such purpose. 3. That the City Clerk be and is hereby directed to record at length upon the records of the City of Austin, Texas, in a separate book to be kept for such purpose, all of said amendments so adopted. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye none. , Councilman Reed moved that the Council recess until 4:00P.M. AFTERNOON SESSION OF THE CITY COUNCIL: Austin, Texas, November 28, 1928. The Council was called to order by the Mayor. Mabry, Finance Director, submitted a tabulation of the bids for the purchase of $750,000.00 of Austin Bonds submitted to him at the morning session. Councilman Reed moved that, it appearing that the bid of B. J. Van Ingen & Company, B. F. Dittmar Company, by R. C. McIntyre, Representative, same being for $543,000.00 of Bonds maturing July 1, 1929, to July 1, 1953, inclusive, at 42% and $207,000.00 of Bonds maturing July 1, 1954, to July 1, 1958, inclusive, at 44%, par and accrued interest from date of Bonds to date of delivery at Austin, Texas, plus a cash premium of $165.00, they agreeing to pay for the cost of printing bonde and attorneys' fees, was the highest and best bid submitted, same be accepted, and said B. J. Van Ingen & Company and E. F. Dittmar Company be awarded the sale of said bonds. Motion was seconded by Council- man Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden; Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. 635 The bid of said B. J. Van Ingen & Company, B. F. Dittmar Company, by R. C. McIntyre, Representative, as accepted by the City Council is as follows: *HONORABLE MAYOR AND CITY COUNCIL, AUSTIN, Tехав.
