REGULAR MEETING OF THE CITY COUNCIL: 105 Austin, Texas, February 28,1929. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Mofadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; absent, none. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same as read. Motion was seconded by Councilman Pannell and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The following bids for the erection of fire stations at 19th and East Avenue and 43rd and Speedway were opened and read: Ernest Parker; Brydson Bros; B. M. Spears; A. A. Mundt; H.E. Wattinger; Claude Traweek; Rundell-Reich Construction Co.; Carl E. Quick; J. J. Wattinger; Jno. R. Bingham; J. R. Blackmore; Wm. Kutalek Also, the following bids for the plumbing and wiring for said stations: J. O. Andrewartha Co.; Fox-Sohmidt; Jno. Wattinger; Chas. Spreen; Bacon; Harper & Linscomb Jno. L. Martin; The above bids were referred to the Architect, A. W. Harris, for tabulation and report to the Council later in the meeting. A petition signed by the business firms on East 5th Street, asking that the one hour parking law apply to East 5th Street from the alley east to Brazos Street, was read and Councilman Mueller moved that the City Attorney be directed to draw an ordinance covering same. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor HoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The following report of R. F. Rockwood, Fire Marshal, was read and ordered spread upon the Minutes: "Austin, Texas, Feb. 25,1929. Hon. P. W. McFadden, Kayor, and Councilmen: Gentlemen: This is to advise that the undersi ned has inspected, and was present at the testing of the Fire Escape on the addition to the Brackenridge Hospital, as furnished and erected by Heiermen Industries of this City, and find some meets with both City and State requirements, and is therefore acceptable to the City. Yours very truly, R. F. Rockwood, Fire Marshal." Mayor licFadden laid before the Council the following resolution: WHEREAS, the City Council has transferred, at various times, from the Water & Light Fund, the General Fund, and the Sanitary Sewer Bond Fund, to the various Bond funds hereinafter named, certain sume of money, which transfers aggregate the amounts 106 hereinafter severally set out opposite the partioulnr Bond fund to which said money was transferred, said transfers having been made ne advancements to said Bond funde for the purpose of prosecuting the public works for which said Bonds were respectively sold, and in anticipation of the proceeds from such sale; and it was resolved that said moneys should be returned to sald Water & Light Fund, General Fund, and Sanitary Sewer Bond Fund, respectively, upon the receipt of the proceeds from said Bonds sale; and WHEREAS, the proceeds from the sale of said Bonds have now been received into the City Treasury; and in pursuance of the purpose of the re-payment to the proper Funds of the advancements aforesaid, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. That the sum of One Hundred and Thirteen Thousand ($113,000.00) Dollars be and the same is hereby transferred from the Street Improvement Bond Fund to the Water & Light Fund. 2. That the sum of Twenty-one Thousand, Five Hundred ($21,500.00) Dollars be and the same is hereby transferred from the Sanitary Sewer Bond Fund to the Water & Light Fund. 3. That the sum of Twenty-two Thousand ($22,000.00) Dollars be and the same is hereby transferred from the Parke & Playgrounds Bond Fund to the Water & Light Fund. 4. That the sum of Thirty-eight Thousand ($38,000.00) Dollars be and the same is hereby transferred from Fire Stations Bond Fund to Water & Light Fund. 5. That the sum of Sixty-two Thousand ($62,000.00) Dollars be and the same is hereby transferred from Airport Bond Fund to the Water & Light Fund. 6. That the sum of Twenty-three Thousand, Five Hundred ($23,500.00) Dollars be and the same is hereby transferred from the Hospital Bond Fund to the Water & Light Fund. 7. That the sum of Sixty-five Hundred ($6500.00) Dollars be and the same is hereby transferred from the Street Improvement Bond Fund to the General Fund. 8. That the sum of Twenty-five Thousand ($25,000.00) Dollars be and the same is hereby transferred from the Street Improvement Bond. Fund to the Sanitary Sewer Bond Fund. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council the following resolution: WHEREAS, there has heretofore been filed for record a plat of "EDGEMONT", an Addition to the City of Austin, which plat is recorded in Plat Book Number 3, at page 131, of the Plat Records of Travis County, Texas, which plat contains a dedication to the public of all streets and ways shown on said plat; and there appears on said plat a passageway or street desirmated as "Split Rock Way", which is a strip of land, approximately twenty (20) feet wide, and lying between Lote Numbers Five (5) and Six (6) in Block One (1), in said Addition, and extending from Split Rock Avenue to the edge of the bluff of Shoal Creek; and , WHEREAS, said Split Fock Way has never been actually opened for public use; and on account of the precipitous bluff at the end of said way, it is impossible for the public to utilize same for general travel, and the owners of the property lying on both sides of said way desire same to be closed; therefore, i BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the dedication for public use of said passageway, designated on said plat as "Split Rock Way", be and the same is hereby refused, and that said way be and the same is hereby vacated, and that the City of Austin hereby waives its right, under the terms of said dedication, to open and control said way as a passageway for the public. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council the following resolution: WHEREAS, Austin Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Austin Gas Company be and the same is hereby permitted to lay and construct gas mains in and under the following streets: (1) A 4 inch gas main on Gaston Avenue, beginning at a point on the Spear League line, said point being 12 feet south of the center line of Gaston Avenue, and from which point the original northeast corner of the J. W. Harris 189-acre tract of land out of the Spear League, as now evidenced by a concrete monument, bears N. 30° E 811.47 feet. Thence N. 51°56' W. 280 feet along a line 12 feet distant from and parallel to the tangent center line of Gaston Avenue to a point of angle in the gas line, this point being in the intersection of Gaston Avenue and Wooldridge Drive. Thence S. 61°32' W 205 feet on Wooldridge Drive along a line & feet distant from and parallel to the tangent cinter line of Wooldridge Drive to the end of the existing Wooldridge Drive Main, said gas main to have a cover of not less than 3 feet. A "Y" is to be placed at the point of angle described above in the intersection of Geston Avenue and Wooldridge Drive, the dead end of the pipe to be in line with the Wooldridge Drive extension, it being the intention of this paragraph to provide for the future extension of the gas main north on Wooldridge Drive. Before starting construction of this line, the Austin Gas Company is required to have this line shown its workmen by the City Engineer's Office, making request for instruction three days before commencing construction. (2) A 4 inch gas main on E. 32nd Street, beginning at a point 135 feet east of and 19 feet south of the intersection of the east line of Fairfax Walk and the north line of E. 32nd Street. Thence easterly 100 feet along a line 19 feet distant from and parallel to the north line of East 32nd Street, said gas main to have a cover of not less than 1 1/2 feet. (3) A 4 inch high pressure gas main on Alice Avenue, beginning at a point 274 feet south of and 15 feet west of the intersection of the south line of W. 39th Street and the east line of Alice Avenue. Thence westerly 5 feet along a line 274 feet distant from and parallel to the south line of West 29th Street to a point of angle in gas line.' Thence northerly on Alice Avenue along a line 20 feet distant from and parallel to the east line of Alice Avenue to the south line of W. 40th Street, said gas main to have a cover of not less than 1 1/2 feet. (4) A 4 inch high pressure gas main on Marathon Boulevard, beginning at a point on the south line of W. 40th Street, said point being 27 feet west of the east line of Marathon Boulevard. Thence northerly on Marathon Boulevard along a line 27 feet distant from and parallel to the east line of Marathon Boulevard to the south line of W. 42nd Street, said gas main to have a cover of not less than 1 1/2 feet. (5) A 4 inch high pressure gas main on W. 42nd Street, berjinning at a point 27 feet west of and 15 feet south of the intersection of the west line of Marathon Boulevard and the north line of W. 42nd Street. Thence westerly on W. 42nd Street along a line 15 feet distant from and parallel to the north line of W. 42nd Street to the west line of Bellvue Street, said gas main to have a cover of not less than 1 1/2 feet. & 107 108 (6) A 4 inch high pressure gas main on Bellvue Street, beginning at a point 15 feet west of and 15 feet south of the intersection of the east line of Bellvue Street and the north line of West 42nd Street. Thence northerly on Bellvue Street along a line 15 feet distant from and parallel to the east line of Bellvue Street to the south line of West 45th Street, sald gas main to have a cover of not less than 1 1/2 feet. (7) A 4 inch high pressure gas main on West 40th Street, beginning at a point on the Alice Avenue or Marathon Boulevard main, said point being 27 feet west of and 20 feet south of the intersection of the east line of Marathon Boulevard and the north line of W. 40th Street. Thence westerly 78 feet along a line 20 feet distant from and parallel to the north line of West 40th Street, said gas main to have a cover of not less than 1 1/2 feet. (8) A 4 inch high pressure gas main on Georgetown Road, beginning at a point 20 feet south of and 25 feet west of the intersection of the north line of West 4oth Street and the east line of Georgetown Road. Thence northerly along a line 25 feet distant from and parallel to the east line of Georgetown Road to the south line of W. 42nd Street, said gas main to have a cover of not less than 1 1/2 feet. Before starting construction of this line, the Austin Gas Company is required to have this line shown its workmen by the City Engineer's office, this request for instruction to be made three days before the beginning of construction. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have laid, shall be under the supervision and direction of the City Manager, and under all pertinent terms and conditions of the certain franchise granted to to' said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of underground conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its underground conduits as follows: (1) An underground conduit on West 2nd Street, beginning at a telephone manhole in the alley between Congress Avenue and Colorado Street. feet Thence Southerly with a curving line, the radius of which curve being 13 to a point on the west line of the alley between Congress Avenue and Colorado Street, said point being 5 feet south of the south face of the north curb on West 2nd Street. Thence Westerly along a line 5 feet distant from and parallel to the south face of the north curb on West 2nd Street to a point 139 feet west of the west line of Colorado Street. THAT the work and laying of said conduit, including the excavation of the streets and the restoration and maintenance of said streets, curbs, walks and lawns after said conduits have been laid, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council the application of Nassour Bros. to operate a drive-in gasoline filling station at 901 East 6th Street; also the following report of the Safety Committee upon same: i "Hon. Mayor and City Council, Gentlemen: We, your Committee on the application of Nassour Bros., asking permission to install and operate a drive-in gasoline filling station at 901 East 6th Street, make the following report: We, the Committee, recommend that this permission be granted subject to the following conditions: 1. That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts, or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. 2. That ceiling of that portion of the building; that extends over driveways shall be covered with metel. Supports for portion extended over driveway to be supported by brick or reinforced concrete pillars. 3. That gasoline storage tanks and pumps and equipment used in connection therewith shall be of an approved type, and shall bear the label of the National Board of Fire Underwriters. All equipment to be installed in compliance with City and State regulations governing such installations. All equipment to be inspected and approved before being placed in service. 4. of a gasoline filling station shall be so located that cars receiving service therefrom will not in any manner obstruct the sidewalk, street or alleyway. The pumps shall be at least ten feet inside the property line. That gasoline pumps and other equipment used in connection with the operation 5. That electric lights only shall be used for 11ghting purposes, and all electrical wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 6. That "NO SMOKING" signs shall be displayed at all times, and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 7. That there shall be kept in an accessible place at all times, a chemical fire extinguisher for emergency use. 8. That provision shall be made to take care of waste oils and water by having the proper connections with storm or sanitary sewer. Connections to be made under the supervision of the City Engineering Department and in accordance with the plan hereto attached marked 2H6. 9. That a plan of the filling station, showing the proposed location of pumps, driveways and methods of draining away waste water and oils hereto attached marked 2H6 shall be followed during construction. १७. That all gasoline pumps, tanks, equipment and piping connected thereto shall be inspected and approved by the City Plumbing Inspector. १०. That all adjacent walks, ramps, gutters and curbs shall be constructed of concrete and all construction shall conform to the attached plan of the development, marked 2H6. 10. That permission shall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating gasoline filling stations, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future, regulations and ordinences of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Nassour Bros. has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. 109 110 A petition signed by the abutting property owners, protesting against the paving of West First Street from Colorado to Guadalupe Streets, and other streets, was read, and Councilman Mueller moved that the petition be filed and the matter taken under advisement. Motion was seconded by Mayor MoFadden, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor McFadden laid before the Council the following resolution: WHEREAS, a street in the City of Austin, being more particularly described as running easterly from the east side of South Congress Avenue to Riverside Drive at the intersection of Blum Creek through the addition formerly known as Fairview Park, a part of the Isaac Decker Survey in Travis County, has been named in a confusing manner, having been known as "The Circle", "Riverside Drive", "Newning Avenue", "East Side Drive", and "Nellie Street"; and WHEREAS, a majority of sixteen residents on the street named have, by petition, signitied that they favor having the street named "Academy Drive"; and WHEREAS, the City Engineering Department has made an investigation and has recommended that the same be named "Academy Drive"; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the street which begins on the east side of South Congress Avenue, a short distance south of Nellie Street, and runs easterly between Blocks 2 and 3, 76 and 72, 68 and 67, 22, 23, 24, and Blocks 64, 63 and 61, in Fairview Park, and all of that street shown as Travis Lane on a map filed in the Travis County Deed Records and known as "Woodlawn", to the intersection of said Travis Lane with Riverside Drive shall hereafter be known as "Academy Drive". BE IT FURTHER RESOLVED: THAT this resolution properly attested to by the Mayor and City Olerk shall be filed in Travis County Deed Records. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. Architect Harris submitted a tabulation of the bids for the erection of the fire stations referred to him earlier in the meeting. Councilman Reed moved that the contract for general construction of the fire station at 21st and East Avenue be awarded to A. A. Mundt, in the amount of $9729.45; the contract for the wiring for said station be awarded to J. O. Andrewartha Company, in the amount of $174.50; and the contract for the plumbing for said station be awarded to Harper & Linscomb, in the amount of $551.00, making a total cost for said fire station of $10,564.95. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell., Reed, and Steck, 5; nays, none. Councilman Reed moved that the contract for general construction of the fire station at 43rd Street and Speedway be awarded to Claude Traweek, in the amount of $7373.50; the contract for the wiring of said station be awarded to Fox-Schmidt, in the amount of $155.00; and the contract for the plumbing of said station be awarded to Bacon, in the amount of $725.00, making a total cost for said fire station of $8,263.50. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Heed, and Steck, 5; nays, none. The application of Mrs. L. A. E. Flack for permit to build a drive-in garage at 305 West 5th Street, was read; Mayor MoFadden then laid before the Council the following; resolution: WHEREAS, Mrs. L. A. E. Flack, by her agent, Enrl E. Simms, owner of property located at the south side of Fifth Street between Guadalupe and Lavaca Streets, has requested permission to operate a drive-in garage at said location; and WHEREAS, said request and a report of the City Engineer have been considered; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the said Mrs. L. A. E. Flack be and she is hereby granted a permit to operate a drive-in garage at the south side of Fifth Street between Guadalupe and Lavaca Streets, the driveways and use of city sidewalk to be in accordance with the plan hereto attached and marked "Exhibit A", all sidewalks, ramp work, and curb work to be constructed of concrete in accordance with the instructions and to the grades to be furnished by the City Engineer. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Mayor MoFadden laid before the Council for its second reading the following ordinance: AN ORDINANCE REGULATING THE STANDING OF VEHICLES ON A CERTAIN PORTION OF WEST EIGHTH STREET, IN THE CITY OF AUSTIN, REPEAL- ING ALL ORDINANCES IN CONFLICT, AND PRESCRIBING A PENALTÝ. The above ordinance was read the second time and Councilman Mueller moved a suspension of the rule and the placing; of the ordinance on its third reading. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck,5; nays, none. The ordinance was read the third time and Councilman Mueller moved that same be finally passed. Mayor MoFadden laid before the Council for its second reading the following ordinance: AN ORDINANCE ORDERING A GENERAL ELECTION FOR THE PURPOSE OF ELECTING FIVE COUNCILMEN OF THE CITY OF AUSTIN, FOR THE TERM OF TWO YEARS BEGINNING MAY 1ST, 1929, DESIGNATING THE POLLING FLACES IN THE VARIOUS WARDS, APPOINTING ELECTION JUDGES AND ELECTION CLERKS, AND PROVIDING THE PROCLAMATION OF SAID ELECTION. The ordinance was read the second time and Councilman Mueller moved that the rule be suspended and the ordinance passed to its third reading. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The ordinance was read the third time, and Councilman Mueller moved that same be finally passed. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. A committee composed of Messrs. Mueller, Drake and Groos, presented a petition to the City Council signed by abutting property owners, asking for the paving of certain streets from the River to West 6th Street and Colorado to Nueces Streets. The petition was received and ordered filed. Mrs. R. L. Penn appeared before the Council to urge that the City extend its sanitary sewer system to Penn Place, and she was given assurance by the Council that this Addition would be included in the first extensions made. A petition signed by a large number of property owners, requesting the paving and improvement of East Avenue, was presented to the Council, and same was ordered filed, and the Mayor thanked the petitioners for their interest and cooperation. A committee from the South Side presented a petition, asking that the first paving on South Congress Avenue extend from Nellie Street to LaPrelle Place, and be ninety (90) feet in width between curbs. Councilman Reed moved that the paving width of South Congress Avenue between curbs be made ninety (90) feet instead of seventy-six (76) feet. Motion was seconded by Mayor McFadden, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none.
