REGULAR MEETING OF THE CITY COUNCIL: 337 Austin, Texas, August 15, 1929. The Council was called to order by the Mayor Pro tem. Roll call showed following members present: Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; absent, Mayor McFadden and Councilman Mueller, 2. The Minutes of the last meeting were read and Councilman Reed moved the adoption of same as read. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; naye, none, Mayor McFadden and Councilman Mueller absent. The application of Clyde Hailey Company to erect a gasoline filling station at East 1st Street and East Avenue was read and laid over. A communication from Orin E. Metcalfe, City Engineer, with reference to the closing of the alley in the block where the Negro Junior High School Building is being erected, was read and referred to the City Attorney for proper resolution. Mayor Pro tem Pannell laid before the Council the following report of H. R. F. Helland, Consulting Engineer: "Austin, Texas, August 14, 1929. Mr. Adam R. Johnson, Oity Manager, Austin, Texas. Dear Sir: This is to advise that the Southwest Bitulithic Company has completed the paving and other improvements on First Street from the west line of Congress Avenue to the west line of Guadalupe Street, according to the plans and specifications adopted for said improvements. I, therefore, recommend the acceptance of this improvement. Yours very truly, (Sgd) H. R. F. Helland, Consulting Engineer" Mayor Pro tem Pannell then laid before the Council the following resolution RESOLUTION ACCEPTING STREET IMPROVEMENTS CONSTRUCTED BY SOUTHWEST BITULITHIC COMPANY ON A PORTION OF WEST FIRST 1 , STREET IN THE CITY OF AUSTIN. PROVIDING FOR PAYMENT OF ANY BALANCE DUE BY THE CITY FOR ITS PORTION OF THE COSTS OF SAID IMPROVEMENTS AND FOR THE DELIVERY OF CERTIFICATES OF ASSESSMENTS AGAINST ABUTTING PROPERTY AND ITS OWNERS. WHEREAS, on the 19th day of April, 1929, the City of Austin entered into a contract with Southwest Bitulithic Company whereby said company agreed to construct street improvements upon various portions of streets in the City of Austin, Texas, among which portions of streets was the following, to-wit: WEST FIRST STREET from the west property line of Congress Avenue to the west property line of Guadalupe Street, known and designated as Unit or District No. 1; and WHEREAS, said contractor has fully completed the street improvements upon said unit or district of improvement above described in accordance with its contract and the plans and specifications made a part thereof and said improvements have been found satisfactory and approved by the Consulting Engineer of the city, and have been found satisfactory and in accordance with the contract by the City Council of said city, 4. 338 Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That the street improvements constructed by Southwest Bitulithio Company upon said portion of West First Street hereinbefore described be and the same are hereby in all things approved and accepted by the City of Austin. II. That any balance of the portion of cost of said improvements agreed to be paid by the City of Austin be forthwith paid to said contractor, and that the Mayor and Oity Olerk of said City of Austin be and they are hereby directed to execute and deliver to said Southwest Bitulithic Company assignable certificates of assessment against the various parcels of property abutting upon said portion of street and the owners of said property as heretofore provided by the ordinance levying assessmente against said property and the owners thereof. III. That this resolution take effect at once. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; naye, none, Mayor MoFadden and Councilman Mueller absent. Mayor Pro tem Pannell laid before the Council the following report of H. R. F. Helland, Consulting Engineer: Mr. Adam R. Johnson, Oity Manager, Austin, Texas. Dear Sir: "Austin, Texas, August 14,1929. This is to advise you that Kirkwood, Wharton & Lee have completed their sanitary sewer contract No. 1 in accordance with plans and specifications, and I recommend that the project be accepted and final estimate be paid. The total cost of this contract was $22,888.84. Yours very truly, (Sgd) H. R. F. Helland, Consulting Engineer". of Councilman Reed moved that in accordance with the above recommendation the Consulting Engineer, said project be accepted, and the City Manager be authorized to make final payment on same to Kirkwood, Wharton & Lee. Motion was seconded by Councilman Steck and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; naye, none, Mayor McFadden and Councilman Mueller absent. Mayor Pro tem Pannell laid before the Council the following report of H. R. F. Helland, Consulting Engineer: Mr. Adam R. Johnson, City Manager, Austin, Tехав. This is to advise you that Joe Macken has completed his contract No.14A, being the excavation between ellie and James Streets west of South Congress Avenue and the filling of the ravine at Nellie Street and fill along the South Congress dyke. Helland, Consulting Engineer." i Councilman Reed moved that in accordance with the above recommendation of the Consulting Engineer, said project be accepted, and the City Manager be authorized to make final payment on same to Joe Macken. A petition signed by residents on Colorado Street between Seventh and Eighth Streets, asking for one hour parking on this street, was read, and Counoilman Reed moved that the petition be granted and the City Attorney be instructed to have proper ordinance drawn and submit same to the Council for равваgе. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: A 4 inch gas main on Angelina Street, beginning at the present gas main in Rosewood Avenue; Thence in a southerly direction 18 feet west of and parallel to the east line of Angelina Street to the north line of Mesquite Street. Said gas main described above is to have a cover of not less than 3 feet in Rosewood Avenue and not less than 2 feet at all other points. The Texas Public Service Company is hereby put upon notice that the Oity of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; nays, none, Mayor MoFadden and Councilman Mueller absent. 339 340 Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) Four (4) poles on Florence Street, beginning at West Twenty-seventh Street, and eight feet west of the east line of Florence Street; Thence in a northerly direction, eight feet distant from and parallel to the east line of Florence Street to the south line of West Twenty-ninth Street. (2) Three (3) poles in alley between Avenue "Q" and Avenue "H", beginning at East Thirty-eighth Street and it feet west of the east line of said alley. Thence in a northerly direction, It feet distant from and parallel to the east line of said alley lying between Avenue "G" and Avenue "H" to the south line of East Thirty-ninth Street. (3) Three (3) poles on Alta Vista Avenue, beginning on north side of E. Monroe Street and eight feet east of the west line of Alta Vista; Thence in a southerly direction eight feet distant from and parallel to the west line of Alta Vista Avenue, a distance of one block. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed shall be under the supervision and direction of the City Manager. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4-inch low pressure gas main on East Twenty-first Street, beginning at a point 53 feet east of and 23 feet south of the intersection of the west line of East Avenue and the north line of East Twenty-first Street, said point being on an existing 4-inch low pressure gas main on East Avenue; Thence in a westerly direction 23 feet distant from and parallel to the north line of East Twenty-first Street to the east line of Oldham Street; Said gas main described above is to have a cover of not less than 3 feet in East Avenue and not less than 2 feet in all other places. (2) A 4-inch low pressure gas main on Willow Street, beginning at a point on the west line of Perdenales Street and 19 feet 6 inches south of the north line of Willow Street; Thence in an easterly direction 19 feet 6 inches distant from and parallel to the north line of Willow Street to the west line of San Saba Street. Said gas main described above is to have a cover of not less than two feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole linee in the following streets: (1) Four (4) poles in Academy Drive Alley, or the alley lying between Riverside Drive and Academy Drive, commencing at Biokler Road and two feet north of the south line of said alley; Thence in a westerly direction on said Academy Drive alley, two feet distant from and parallel to the south line of alley, a distance of approximately 350 feet. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell Councilmen Reed and Steck, 3; nays, none, Mayor MoFadden and Councilman Mueller absent. Mayor Pro tem Pannell laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4-inch high pressure gas main on West Seventh Street, beginning at a point 15 feet south of and 13 feet west of the intersection of the north line of West Seventh Street and the east line of the east portion of Deep Eddy Avenue which is south of West Seventh Street, said point being the dead end of an existing 3-inch high pressure gas main; Thence in a westerly direction 15 feet distant from and parallel to the north line of West Seventh Street to a point 15 feet west of and 15 feet south of the intersection of the north line of West Seventh Street and the east line of the west portion of Deep Eddy Avenue which is north of West Seventh 342 Street, said gas main described above to have a cover of not less than 2 feet. (2) A 2-inch high pressure gas main on Deep Eddy Avenue north of West Seventh Street, beginning at a point 15 feet west of and 15 feet south of the intersection of the north line of West Seventh Street and the east line of the west portion of Deep Eddy Avenue north of West Seventh Street; Thence in a northerly direction, 15 feet distant from and parallel to the east line of Deep Eddy Avenue, a distance of approximately 440 feet to the south line of the first street south of Capitol Avenue, said gas line to have a cover of not less than 22 feet. (3) A 4-inch low pressure gas main on East First Street beginning at a point 19 feet south of the intersection of the north line of East First Street and the east line of San Saba Street, said point being on the east line of San Saba Street produced; Thenge in a southerly direction following the east line of San Saba Street to a point 2 feet north of the south line of East First Street; Thence in an easterly direction & feet distant from and parallel to the south line of East First Street to the west line of Del Valle Road, said gas main to have a cover of not less than 3 fest. (4) A 4-inch low pressure gas main across East First Street, beginning at a point on a produced portion of the south line of East First Street and 17 feet west of the intersection of the east line of Mildred Street and the south line of East Ist Street; Thence across East First Street at right angles to the center line of said: street to a point 18 feet south of the north line of street, said point being on an existing 4-inch low pressure gas main. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best recorde we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working pointe from which to base the location of their assignments, they shall apply to the Oity Engineering Department not less than three (3) days before such information is required. Mayor Pro tem Pannell laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Ten Thousand Dollars ($10,000.00) be and the same is hereby appropriated out of the Water and Light Fund for the purpose of placing same to the Job Account of the U. G. I. Contracting Company, to be used for the payment of labor and materials in connection with the construction at the Water and Light Plant, under the terms of the contract between the City and said Company. The above resolution was adopted by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; nays, none, Mayor McFadden and Councilman Mueller absent. ! The application of W. T. Caswell for permit to erect a drive-in fender repair shop at 110 East Ist Street was read the first time and laid over. The application of Charles Rogan for permit to install a gasoline pump and tank at 2104 East Avenue was read first time and laid over. Councilman Reed moved that, in view of the affidavit of W. B. Loveless, former owner of the property, showing that same was over-assessed for the year 1926, and the recommendation of George G. Grant, Finance Director, that same be reduced, the taxes on Lot 2, Block G, J. E. Bouldin Addition, Plat 116, be reduced from $1800.00 to $670.00 for the year 1926, and that Eli Mederis, present owner of said property, be allowed to make settlement of the taxes due in the amount of $17.72, including interest and penalty, provided such payment is made within five days from the date hereof. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Councilmen Reed and Steck, 2; nays, Mayor Pro tem Pannell; absent, Mayor McFadden, and Councilman Mueller. Mayor Pro tem Pannell laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase from Mrs. Auguste Klein for a cash consideration of Three Thousand Dollars ($3000.00), and upon showing of good and merchantable title in said owner at the time of conveyance, and free from all liens and incumbrances, as determined by the City Attorney, and after accurate survey thereof, if deemed necessary by the City Manager, and upon delivery to the City of the owner's general warranty deed, the following described property: Lots Nos. 3 and 4 in Block No. 166, City of Austin, Travis County, Texas; BE IT FURTHER RESOLVED: That the sum of Three Thousand Dollars ($3000.00) be and the same is hereby appropriated out of the Parks and Playgrounds Bond Fund for the purpose mentioned above, and that a warrant in said amount issue therefor, payable to Mrs. Auguste Klein and to be delivered to said party after approval of title to said land by the City Attorney and delivery by said party of her general warranty deed to said property. Tydlaska to erect a gasoline filling station at 810 East 23rd Street was read first time and laid over. Mayor Pro tem Pannell laid before the Council the following report of the Safety Committee upon the application of Frank A. Rieger, Jr., to erect an automobile repair shop at 504-6 Rio Grande Street, which had been read at the last regular meeting and laid over: Hon. Mayor and City Council, Austin, Tехав. Gentlemen: "Austin, Texas, August 15, 1929. We, the Safety Committee of the City of Austin, have investigated the request of Frank A. Rieger, Jr., for a permit to have sidewalk crossings at 504-6 Rio Grande Street and to construct and operate an automobile repair shop, and make the following report: 343 344 We, the Committee, have investigated the conditions and believe that it would be all right to grant this permit, but consider that before we make our final report we should be furnished a plat of the ground showing the proposed location of the building in relation to the lot lines and the proposed driveways. CITY SAFETY COMMITTEE. (Sgd) Geo.F.Krueger, Acting Fire Marshal. Orin E. Metcalfe, City Engineer; Tom Neal, Traffic Police Captain Councilman Reed moved that the above recommendations of the Safety Committee be approved and that permit be granted to said Frank A. Rieger, Jr., when said applicant has submitted a plat of the ground showing the proposed location of the building in relation to lot lines and proposed driveways and same has been approved by the Safety Committee. Motion was seconded by Counoilman Steck and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Councilmen Reed and Steck, 3; nays, none; Mayor McFadden, and Councilman Mueller absent. Mayor Pro tem Pannell laid before the Council the application of Colonial Gardens, Inc., to erect a drive-in refreshment center on the east side of Guadalupe Street between Twenty-eighth and Twenty-ninth Streets; also the following report of the Safety Committee upon same: Hon. Mayor and City Council, Austin, Texas. Gentlemen: "Austin, Texas, August 15,1929. We, the Safety Committee of the City of Austin, on the application of Colonial Gardens, Inc., by Morris Stern, President, lessee of property owned by the Austin Ice Company, to erect and operate a drive-in refreshment center to be located on the east side of Guadalupe Street between Twenty-eighth and Twenty-ninth Streets, make the following report: We, the Committee, recommend that this permission be granted subject to the following conditions: (1) That a plan of the proposed property hereto attached marked 2-0-252, which shows the location of driveways across the sidewalk area shall be followed during construction and that the curbs, sidewalks, gutters and driveway ramps shall be constructed of concrete before the refreshment station is put in operation. (2) That the Colonial Gardens, Inc., shall put their lease on record in the Travis County Olerk's office before this permit is granted. That the length of the permit shall not extend beyond the date of the term of the lease of the Colonial Gardens, Inc. (3) That permission shall be granted subject to the above conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, applying to or regulating drive-in service stations. That said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations, and the right of revocation is retained, if after hearing it is found by the City Council that the Colonial Gardens, Inc., has failed and refused and will continue to fall and refuse any such conditions, regulations and ordinances. The Council took the Mayor Pro tem Pannell laid before the Council the following ordinance: ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING PORTIONS OF GUADALUPE STREET AND SUNDRY OTHER STREETS IN THE CITY OF AUSTIN, TEXAS, FIXING A CHARGE AND LIEN AGAINST PROPERTY ABUTTING THEREON AND AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF. • The above ordinance was read the first time and laid over. Mayor Pro tem Pannell laid before the Council the following ordinance: ORDINANCE DECLARING THE NECESSITY FOR AND ORDERING AND PROVIDING FOR THE IMPROVEMENT OF A PORTION OF GUADALUPE STREET IN THE CITY OF AUSTIN, TEXAS, LETTING CONTRACT THEREFOR, APPROVING FORM OF CONTRACT AND BOND, AND PRO- VIDING FOR THE PAYMENT OF THE COST THEREOF. The above ordinance was read the first time and laid over. A communication from T. H. McGregor, asking that West Avenue from 30th to 34th Streets. be included in the street paving program, was read and ordered filed. Mayor Pro tem Pannell called up for its second reading the following ordinance, which had been read the first time previously on May 30th, 1929, and laid over: ORDINANCE OF THE CITY OF AUSTIN, TEXAS, DECLARING THE NECESSITY FOR AND ORDERING AND PROVIDING FOR THE IMPROVEMENT OF ELMWOOD STREET FROM THE EAST LINE OF DUVAL STREET TO THE WEST LINE OF HARRIS PARK AVENUE, IN THE CITY OF AUSTIN. LETTING CONTRACT THEREFOR, APPROVING CONTRACT AND BOND, AND PROVIDING FOR THE PAYMENT OF THE COST THEREOF, AND DECLARING AN EMERGENCY. The above ordinance was read the second time and laid over. In view of a number of protests having been submitted against the erection of a gasoline filling station and garage at Forty-third and Duval Streets by P. C. Wolff, the Council instructed the City Manager to hold up permit for same until further investigation could be made. Councilman Steck moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor Pro tem Pannell, Jouncilmen Reed and Steck, 3; nays, none; Mayor McFadden and Councilman Mueller absent.
