of Austin; it being understood, however, that the sum of Two Hundred and Fifty ($250.00) Dollars is to be paid for the real estate, on the basis of $1,000.00 per acre, and One Hundred Twenty-five ($125.00) Dollars for one pecan tree which it becomes necessary to appropriate and destroy in pursuance of the above mentioned purpose. BE IT FURTHER RESOLVED: That the sum of Three Hundred and Seventy-five ($375.00) Dollars be and the same is hereby appropriated out of the Street Improvement Bond Fund for the purpose of paying said first named party for said property and said damages, and that a warrant in said amount issue therefor and to be delivered to said party after approval of title to said land by the City Attorney and the delivery by said party of his general warranty deed to said land, free from all liens and incumbrances. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. Councilman Mueller moved that the Council recess, subject to call of the Mayor. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same as read. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor Mofadden, Councilmen Mueller, and Steck, 3; nays, none; Councilmen Pannell and Reed absent. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to immediately advertise in the Bond Buyer of New York, the Dallas News, the Austin Statesman and the Austin News for bids for the purchase of the Bonds of the City of Austin, for the purposes and in the amounts hereinafter stated, to be issued under authority of the election held on May 18, 1928, said bids to be received and opened on December 16, 1929, to-wit: 437 438 ! Street Improvement Bonds Sanitary Sewer Sewer Bonds - - Parks & Playgrounds Bonds Abattoir Bonds - - $600,000.00 175,000.00 150,000.00 and 75,000.00 Such advertisement shall state that said bonds will be issued in denominations of $1,000.00 each, with serial maturities over a period of thirty years on a level tax basis, bidders for said bonds to name the rate of interest, provided that such rate shall be a multiple of one-fourth of one percent, and that all bonds must bear the same rate of interest, both principal and interest payable at the office of the City Treasurer at Austin, Texas, and at the Seaboard National Bank of New York City; that only bids for the entire One Million Dollars of bonde will be accepted; that a certified or cashier's check in the amount of Twenty Thousand Dollars shall accompany each bid, conditioned on the satisfactory performance of the bid; that such bonds will be sold and purchased upon the approving opinion of Thomson, Wood & Hoffman, Attorneys of New York, the costs of opinion and printing of bonds to be paid by the purchaser; that delivery of bonds to purchaser will be made at Austin, Texas; and that the City will reserve the right to reject any or all bids. The Mayor laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said mape or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: Four (4) poles on West Twenty-fourth Street, beginning at a point on the west line of Leon Street produced, which point is 22 feet north of the intersection of the center line of West Twenty-fourth Street and the west line of said Leon Street; Thence in a westerly direction 22 feet north of and parallel to the center line of West Twenty-fourth Street a distance of one block to the east line of Longview Street. Wherefore, be it understood that the measurements for locating the pole line described above must be taken from the center line of West Twenty-fourth Street as the fences in this neighborhood are not on the true property lines. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Steck, 3; nays, none; Councilman Pannell and Reed absent, 2. The Mayor laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: Two (2) poles on Reagan Terrace beginning at a point & feet north of the intersection of the south line of Reagan Terrace and the east line of Travis Heights Boulevard; Thence in an easterly direction & feet distant from and parallel to the south line of Reagan Terrace, a distance of approximately 250 feet. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Steck, 3; nays, none; Councilmen Pannell and Reed absent, 2. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said mape or plane have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE OITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: A low pressure gas main on Crockett Street, beginning at the dead end of an existing gas main which dead end is 112 feet north of and 22 feet east of the intersection of the north line of West Fourth Street and the west line of Crockett Street, to-wit: Thence in a southerly direction, 22 feet distant from and parallel to the west line of Crockett Street, to the north line of West Fourth Street, said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, and Steck, 3; naye, none; Councilmen Pannell and Reed absent, 2. Councilman Mueller moved that the Council recess, subject to call of the Mayor.
