440 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, November 27, 1929. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed, 1. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same as read. Motion prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent, 1. A committee of interested citizens appeared before the Council with reference to having the I&GN Railroad Company place a crossing at Paul Street. The matter was referred to the City Manager and Oity Attorney for further investigation. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Forty-five Thousand Dollars ($45,000.00) be and the same i18 hereby appropriated out of the Water and Light Fund, for the purpose of placing same to the Job Account of the U. G. I. Contracting Company, to be used for the payment of labor and materials in connection with the construction at the Water and Light Plant, under terms of the contract between the City and said Company. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase, in the name of the City of Austin, from Ralph Breazeale and wife, for the consideration of Two Hundred Fifty ($250.00) Dollars, the following described property, said property to be used by the City of Austin for sanitary sewer purposes, to-wit: A part of Outlot No. 73 in Division "E" of the City of Austin, Travis County, Texaв, and more particularly described by metes and bounds as follows: Beginning at a point, said point being the northwest corner of a tract 100 feet by 128 feet sold by E. C. Bartholomew to Joe Sanka, by deed dated the 14th day of May, A. D. 1904, said Sanka tract as now under fence and which above mentioned corner is established by said fence; thence in a southerly direction along the west line of the said Sanka tract and along the west line of a tract 50 feet by 128 feet sold under contract of sale to Miss Edith Stokes, 150 feet to the southwest corner of the tract above mentioned sold to Miss Edith Stokes, for the southeast corner of the tract herein conveyed; thence in a weaterly direction along a line parallel with the south line of River Street to a point in the west line of the tract conveyed to E. C. Bartholomew by Josephus Cummings, by deed dated May 7, 1895, and recorded in Book No. 133, Page No. 4, of the Deed Records of Travis County, Texas, to which deed and the record thereof reference is here made for all pertinent purpoвев, for the southwest corner of the tract herein conveyed; thence in a northerly direction along the west line of the tract conveyed to E. C. Bartholomew by deed executed by Josephus Cummings and mentioned above, to a point in the south line of River Street, for the northwest corner of the tract herein conveyed; thence in an easterly direction along the south line of River Street, to the place of beginning, The above mentioned tract herein conveyed faces north on River Street 100 feet, more or less, and runs back in a southerly direction about 150 feet. BE IT FURTHER RESOLVED: THAT the sum of Two Hundred and Fifty ($250.00) Dollars be and the same is hereby appropriated out of the Sanitary Sewer Bond Fund, for the purpose of paying said owners for said property, and that a warrant in said amount issue therefor and be delivered to said parties after approval of title to said land by the City Attorney, and the delivery by said parties of their general warranty deed to said land, free from all liens and incumbrances. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent, 1. Mayor McFadden laid before the Council the following resolution: WHEREAS, the City of Austin has heretofore filed condemnation proceedings against John M. Monk, and others, as the owners of certain land, situated in the Spear League Survey, in the City of Austin, across which the City proposes to construct its sanitary sewer line, for an easement and right-of-way for such purpose, and the Commissioners appointed to assess the damages to said property and owners on account of the condemnation of such easement and right-of-way have awarded the sum of One Hundred and Fifty ($150.00) Dollars to said owners; and WHEREAS, it is necessary for the Oity to enter said land immediately, in pursuance of its said purpose, and the law requires that before taking such step a sum of money in double the amount of the award be deposited in the registry of the Court, and in addition that the City shall make bond in said amount, conditioned on its payment of all costs and damages that may be adjudged against it on account of its entry and occupation of said land in a final judgment in said proceedings; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be authorized and directed to execute the bond above mentioned, and the sum of Three Hundred ($300.00) Dollars be and the same is hereby appropriated out of the Sanitary Sewer Bond Fund for the purposes of said deposit, and that a warrant issue therefor, payable to Fred O. Malone, Clerk of the County Court of Travis County, Texas. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, when the budget for the year 1929 was prepared it was estimated that the Street and Bridge Division of the Engineering Department would collect from other Departments and sources for services performed therefor the sum of Eight Thousand Dollars ($8000.00) during the year 1929; and WHEREAS, the Street and Bridge Department has to the present date actually earned and collected from extraneous sources in excess of Thirty Thousand Dollars ($30,000.00) leaving in the General Fund of the City of , 441 442 Austin more than Twenty-two Thousand Dollars ($22,000.00) over and above the amount originally estimated; and WHEREAS, the cost of these extra services has now been paid and charged against the appropriations of the Street and Bridge Department, causing them to appear overdrawn; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Fifty-five Hundred Dollars ($5500.00) be and the same is hereby appropriated, without actual transfer of funds, for the purpose of liquidating the deficit balances in the operating accounts of the Street and Bridge Division, as follows: Sand, Gravel, etc- Lumber, Brick and dement Wire, Steel and Hardware Gasoline and 011 - - 600.00 $1,000.00 2,400.00 1.500.00 $5,500.00 The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent,1. The above resolution was adopted by the following vote: Ayes, Mayor Moradden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent, 1. Mayor McFadden laid before the Council the following resolution: WHEREAS, on the 14th day of November, 1929, the City of Austin passed a resolution assigning house numbers for various premises situated on the south side of Twenty-third Street between Rio Grande Street and San Gabriel Street in accordance with a plan numbered 2-0-174; and WHEREAS, said resolution was recorded in the Minutes of the City Council in Minute Book No. 11, page 432; and WHEREAS, the City Council has reviewed the numbers and plan heretofore adopted and has decided upon a different plan of numbering which will better 444 suit the convenience of the residents of the houses affected; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT its action of November 14, 1929, as recorded in Minute Book No. 11, page 432, is hereby rescinded; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the various premises situated on the south side of Twenty-third Street between Rio Grande and San Gabriel Streets shall hereafter be numbered according to the attached plan numbered 2-0-174A, as designated by new numbers; said plan 2-0-174A 1s hereto attached and made a part of this resolution. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent, 1. A communication from Orren Estess, Agent for J. B. Pierce & Bro., offering to sell the City approximately, six acres of land along the Colorado River for an abattoir site, at a price of $20,000.00, was read and ordered filed. A motion was made by Mayor MoFadden and seconded by Councilman Steck that the expense account of the City Manager to Fort Worth, Texas, in attendance upon the International Oity Managers' Convention, November 20th to 23rd, 1929, in the amount of $50.10, be approved and ordered paid. Motion prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Counoilman Reed absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 2-inch high pressure gas main in Leland Street, beginning at a point on the south line of Leland Street produced, which point is 15 feet westerly from the intersection of the south line of said Leland Street and the east line of Brooklyn Avenue; Thence in a northerly direction, perpendicular to the center line of Leland Street a distance of 43 feet to a point, which point is 17 feet southerly from the north line of said Leland Street; Thence in an easterly direction 17 feet south of and parallel to the north line of Leland Street to the west line of East Side Drive, said gas main described above to have a cover of not less than 22 feet. (2) A 4-inch low pressure gas main on West Thirty-first Street, beginning at the dead end of an existing gas main, which dead end is 280 feet east of and 13 feet south of the intersection of the north line of West Thirty-first Street and the east line of San Gabriel Street; Thence in a westerly direction, 13 feet south of and parallel to the north line of West Thirty-first Street a distance of 280 feet to the east line of San Gabriel Street, said gas main described above is to have a cover of not less than 2 feet. (3) A 4-inch low pressure gas main on San Gabriel Street beginning at the end of an existing gas main, which end is 20 feet south of and 15 feet west of the intersection of the north line of West Thirtieth Street and the east line of San Gabriel Street; Thence in a northerly direction 15 feet west of and parallel to the east line of San Gabriel Street to the south line of West Thirty-first Street, said gas main described above to have a cover of not less than 2 feet and to pass under all existing storm sewers. (4) A 4-inch low pressure gas main on West Forty-fourth Street beginning at a point on an existing gas main in Guadalupe Street, which point i8 49 feet west of and 25 feet south of the intersection of the north line of West Forty-fourth Street and the east line of Guadalupe Street; Thence in an easterly direction 25 feet south of and parallel to the north line of West Forty-fourth Street to the west line of Avenue "A", said gas main described above to have a cover of not less than 2 feet. (5) A 4-inch low pressure gas main on Grooms Street, beginning at a point 12 feet south of and 20 feet west of the intersection of the north line of East Thirty-first Street and the east line of Grooms Street; Thence in a northerly direction 20 feet west of and parallel to the east line of Grooms Street a distance of one block to the south line of Moore Boulevard, said gas main described above to have a cover of not less than 2 feet; (6) A 4-inch low pressure gas main on Taylor Street beginning at the dead end of an existing gas main, which dead end is 60 feet east of and 19 feet south of the intersection of the north line of Taylor Street and the east line of East Avenue; Thence in a westerly direction 19 feet south of and parallel to the north line of Taylor Street to a point 30 feet west of and 19 feet south of the intersection of the north line of Taylor Street and the east line of East Avenue, said gas main described above to have a cover of not less than 2 feet; (7). A 4-inch low pressure gas main on East Avenue, beginning at a point 30 feet west of and 19 feet south of the intersection of the north line of Taylor Street and the east line of East Avenue; Thence in a southerly direction 30 feet west of and parallel to the east line of East Avenue a distance of one block to the north line of Holly Street, said gas main described above is to have a cover of not less than 2 feet. Wherefore, be it understood that at least three (3) days' notice must be given the City Engineer before beginning actual construction of the above desoribed gas main on East Avenue in order that center line stakes for вате may be set. (8) A 4-inch low pressure gas main on East Sixteenth Street, beginning at a point 15 feet west of and 24 feet south of the intersection of the north line of East Sixteenth Street, and the east line of that portion of Navasota Street that is north of East Sixteenth Street; Thence in an easterly direction 24 feet south of and parallel to the north line of East Sixteenth Street a distance of approximately 150 feet to the east line produced of that portion of Navasota Street that issouth of East Sixteenth Street, said gas main described above to have a cover of notless than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent, 1. 445 446 The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 2-inch high pressure gas main on West Thirty-second Street, t, beginning at a point on an existing six-inch high pressure gas main, which point is 19 feet west of and 20 feet south of the intersection of the east line of King Street and the north line of West Thirty-second Street; Thence in an easterly direction 20 feet south of and parallel to the north line of West Thirty-second Street a distance of one block to an existing regulator pit. Wherefore, be it understood that said gas main described above shall have a cover of not less than 2 feet; (2) A regulator pit, 5'x7' in San Antonio Street, the center lines of said pit to be 35 feet east of the west line of San Antonio Street and 30 feet north of the north line of West Fifteenth Street produced. Wherefore, be it understood that at least three days' notice must be given the Oity Engineer before beginning actual construction on said regulator pit in order that lines and grades may be given. (3) A regulator pit 5' x 7' in West Forty-second and One-half Street, which pit is to be 15 feet west of the west line of Red River Street produced and 26 feet south of the north line of East Forty-second and One-half Street. Wherefore, be it understood that at least three days' notice must be given the City Engineer before actual construction is started on the above described regulator pit in order that lines and grades may be given. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points.
