Austin, Texas, December 26, 1929. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Pannell and Steck, 3; absent, Councilmen Mueller and Reed, 2. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same as read. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Pannell and Steck, 3; nays, none; Councilmen Mueller and Reed absent, 2. Councilman Pannell moved that the City Manager be authorized to secure bids for the building of a Drill Tower for the Fire Department in accordance with the plans for same submitted by Architect Kuehne. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Pannell and Steck, 3; nays, none; Councilmen Mueller and Reed absent, 2. A letter from Ed W. Giesen, offering to sell the City eight acres of land in Evergreen Heights as a site for the abattoir, was read and same was referred to Councilman Pannell for investigation and report. A communication from M. H. Crockett, asking that the City reconsider its action in refusing to grant him a permit for the erection of a filling station at Duval Street and the proposed Boulevard, was read, and Councilman Pannell moved that definite action upon the matter be postponed and that same be filed for future consideration. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Pannell, and Steck, 3; nays, none; Councilmen Mueller and Reed absent, 2. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase from Miss Bessie Taylor, in the name of the City of Austin, for a cash consideration of Five Hundred Dollars ($500.00) certain plans, specifications, blue prints and reports of the Austin Dam made by The City Water Power Company, Lamar Lynden, Consulting Engineer, and Frank S. Taylor, Resident Engineer. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Pannell, and Steck, 3; nays, none; Councilmen Mueller and Reed absent, 2. 478 The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4" high pressure gas main in East Seventh Street beginning at a point in Congress Avenue Alley 24 feet south of the center line of East Seventh Street; Thence westerly 24 feet south of and parallel to the center line of East Seventh Street to the existing gas main on the west side of Congress Avenue, which existing gas main is about 24 feet east of the west line of Congress Avenue. (2) A regulator pit to be placed on East Seventh Street 20 feet east of the east line of Congress Avenue and 24 feet south of the center line of East Seventh Street. These permits and assignments of space are granted subject to the construction program being so planned that a 16 foot passageway for vehicles travelling north and south on Congress Avenue shall be maintained at all times, and that the construction work shall be continued both day and night until the completion thereof. That the streets shall be repaired by the placing of concrete base of not less than 7 inches in thickness to be composed of one part quick-set cement, two parts sand and four parts gravel. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said strecte after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Councilman Pannell moved that the above resolution be adopted, subject to the following amendment: That all work under this permit shall be done under the strict supervision of the Engineering Department and that quick-setting cement be used. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor Mofadden, Councilmen Pannell and Steck, 3; nays, none; Councilmen Mueller and Reed absent, 2. The Mayor declared that the hearing of the property owners and other interested persons with reference to the paving of Guadalupe Street from Fifth to Sixth Streets was now open. Thereupon the following written protests of property owners were read and ordered filed: 479 F. M. Covert; Clarence Covert; Rosa Gilfillan; Joseph Fischer; Enfield Realty & Home Building 00; E. L. R. Wroe; Mrs. Elizabeth MoCrummen and husband, T. D. Modrummen. Councilman Pannell moved that the hearing on the above street be held open and continued until the next regular meeting, January 2, 1930. The Mayor laid before the Council the following resolution: WHEREAS, the tax rolls of the City of Austin, Assessment No. R-13278-1150, show that eight acres, more or less, in the J. E. Bouldin 8B Division "C", Wendlandt Estate, was assessed in the amount of $1,600.00 for the full value and $1,065.00 as the two-thirds value; and WHEREAS, upon a resurvey of said property it was found that there are only 6.44 acres of land in this tract; and WHEREAS, the O. Wendlandt Estate has paid the taxes on this tract of land as eight acres instead of 6.44 acres, which is the correct acreage, and have overpaid the sum of $4.30 as taxes; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That in view of the above facts, the said C. Wendlandt Estate be refunded the said sum of $4.30 overpaid as taxes, and that such amount be appropriated
