584 The Council then recessed. Approved Mayor. REGULAR MEETING OF THE CITY COUNCIL: : Austin, Texas, March 6, 1930. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed, 1. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following amended ordinance: AN ORDINANCE REGULATING TRAFFIC ON SIXTH STREET OF THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PRESORIBING PENALTIES. The above ordinance was read the first time and laid over. A large delegation of business men appeared before the Council and presented written protests signed by the business firms on West Sixth Street from Congress Avenue to Rio Grande Street protesting against the passage of the above ordinance. The petitions were read and ordered filed. Committees from the various civic organizations appeared before the Council and asked that Dam Boulevard and other streets tying into the scenic loop be improved with some kind of hard-surface pavement as soon as possible. The Council took the matter under advisement. Judge James R. Hamilton appeared before the Council and requested that the paving width of Nueces Street in the 2400 block be narrowed sufficiently to avoid cutting the large trees in front of his premises. The Council took the matter under advisement. A report of Tom Neal, Traffic Police Captain, recommending that U turns be allowed at Eleventh and Rio Grande Streets, was read and ordered filed. Councilman Mueller moved that in accordance with the recommendation of T. B. Marshall, Tax Assessor and Collector, the valuation placed on Lot 9, Block 2, Charles Johnson Addition, Plat 100, be reduced to $25.00 for the years 1928 and 1929, and that the Tax Assessor and Collector be authorized to change his rolls accordingly. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: WHEREAS, A. E. Schutze and C. B. Sterzing have requested the City of Austin to accept a strip of land 50 feet wide out of Lot 3, Goodrich Subdivision of Isaac Decker League for street purposes; and WHEREAS, the City Manager and City Engineer have recommended that said street be accepted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the dedication of said street be accepted. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent. A communication from Mrs. B. M. Spears and Mrs. M. M. Johnson, President and Secretary of the P. T. A. Fulmore School, requesting that the City install a traffic light at the intersection of South Congress Avenue and Johanna Street, was read and ordered filed. The Mayor laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: A telephone pole line in Grooms Street from East Thirty-fifth Street to East Thirty-seventh Street, the center line of which pole line is to be 12 feet cast of the west line of said Grooms Street; Be it understood that all damages whatever caused to existing untilities during the course of construction or maintenance of the pole line described above shall be paid for out of funds appropriated for pole line construction and maintenance. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor Moradden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch low pressure gas main in Chicon Street beginning at a point on the north line of East Twenty-first Street, which point of beginning is 21 feet west of the intersection of the east line of Chicon Street and said north line of East Twenty-first Street; 585 586 ة ال Thence in a northerly direction 21 feet west of and parallel to the east line of Chicon Street a distance of approximately 1/2 block to connect with the dead end of an existing gas main. Said gas main described above shall have a cover of not less than 2 feet. (2) A 4 inch low pressure gas main in Speedway beginning at a point on an existing 2 inch low pressure gas main in East Forty-fourth Street, which point of beginning is 22 feet north of and 31 feet west of the intersection of the south line of East Fortyfourth Street and the east line of Speedway; Thence in a southerly direction 31 feet west of and parallel to the east line of Speedway a distance of approximately 70 feet to the into the dead end of an existing 4 inch low pressure gas main. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated, does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said mape or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch low pressure gas main in Enfield Road beginning at the end of an existing 4 inch low pressure gas main, which point of beginning is 26 feet south of and approximately 150 feet east of the intersection of the east line of Woodlawn Boulevard and the north line of Enfield Road; Thence in a westerly direction 26 feet south of and parallel to the north line of Enfield Road to the west line of Hartford Road. Said gas main described above shall have a cover of not less than 22 feet. (2) A 4 inch low pressure gas main on Woodlawn Boulevard beginning at a point 26 feet south of and 20 feet east of the intersection of the north line of Enfield Road and the west line of Woodlawn Boulevard; Thence in a northerly direction 20 feet east of and parallel to the west line of Woodlawn Boulevard a distance of approximately 1/2 block to the end of an existing 4 inch low pressure gas main. Said gas main described above shall have a cover of not less than 22 feet. (3) A 4 inch low pressure gas main in Hillside Avenue, beginning at a point on an existing 4 inch low pressure gas main, which point of beginning is 15 feet north of and 39 feet east of the intersection of the south line of Academy Drive and the west line produced of Hillside Avenue; 1 Thence in a northerly direction 39 feet east of and parallel to the west line of Hillside Avenue to a point 29 feet north of the south line of an east and west street that lies between Riverside Drive and Academy Drive. Thence in a westerly direction 29 feet north of and parallel to said south line of an east and west street that lies between Riverside Drive and Academy Drive a distance of approximately 60 feet to a point 5 feet west of the east line of a street that has not been dedicated to public use; Thence in a northerly direction 5 feet west of and parallel to the east line produced of said street that has not been dedicated to public use, a distance of approximately 21 feet to the north line of said cast and west street that lies between Riverside Drive and Academy Drive. It is suggested that the assignment be carried on in a straight line from this point, a distance of approximately 145 feet. Said gas main described above is to have a cover of not less than 22 feet. A petition signed by the property owners on South Congrese Avenue, protesting against the paving width of South Congress Avenue from the Deaf and Dumb Institute to the bridge being reduced to seventy-six feet, was read and ordered filed. The Mayor laid before the Council for its second reading the following ordinance: ORDINANCE OF THE CITY OF AUSTIN, TEXAS, ORDERING THE IMPROVEMENT OF FIFTH STREET AND SUNDRY OTHER STREETS IN THE CITY OF AUSTIN, AND DEOLARING AN EMERGENCY. The above ordinance was read the second time and Councilman Pannell moved that the rule be suspended and the ordinance passed to its third reading. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none, Councilman Reed absent. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. The Mayor laid before the Council the following resolution: RESOLUTION OF THE CITY OF AUSTIN APPROVING SPECIFICATIONS FOR THE IMPROVEMENT OF FIFTH STREET AND SUNDRY OTHER STREETS, IN THE CITY OF AUSTIN, AND INSTRUCTING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR SAID WORK. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Whereas by an ordinance heretofore passed by the City Council of the City of Austin, all that portion of Fifth Street and sundry other streets defined and designated in said ordinance as Districts Nos. 23 to 42, inclusive, were ordered improved; and WHEREAS, by the terms of said ordinance specifications were ordered to be made by the Consulting Engineer for the improvement of said streets, as provided by said ordinance; and WHEREAS, said specifications have been prepared and are now submitted to the City Council for approval and adoption; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the specifications so presented to the City Council by the Consulting Engineer and prepared by him for the improvement of said portion of Fifth Street and sundry other streets defined and designated in said ordinance as Districts Nos. 23 to. 42, inclusive, having been carefully considered by the City Council, be and the same are hereby approved and adopted as the specifications for the improvement of said portion of said streets; Further, : BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: , THAT the City Manager be and is hereby instructed upon the passage of thie resolution, to at once advertise for bids for the construction of such improvements provided by such specifications, such advertisement to be published in The Austin American-Statesman, a newspaper of general circulation in the City of Austin, notless than one insertion, which shall be not less than five days before the date fixed for receiving bids. That this resolution shall take effect and be in full force and effect from and after its passage. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase in the name of the City of Austin from Augusta Otto Wende and Emma Otto, for the cash consideration of Three Thousand ($3,000.00) Dollars, the following described property, to be used in the straightening of Waller Creek Channel, towit: 9923.47 square feet of land, a part of Lots One (1) and Two (2), of Block Thirteen (13), of the Original City of Austin, in Travis County, Texas, and described by metes and bounds, as follows: Beginning at an iron pipe stake, the northeast corner of Lot 2, Block 13, of the City of Austin; thence 8. 19° W. 128 feet along the east line of said Lot 2, Block 13, to an iron pipe stake; thence N. 71° W. 138 feet along the south line of Lots 1 and 2, Block 13, to an iron pipe stake; thence N. 19° E. 45 feet along the west line of Lot 1, Block 13, to an iron pipe stake; thence S. 716 W. 48.51 feet to ! an iron pipe stake; thence N. 66°09' E. 122.05 feet to the place of beginning) provided that evidence of good title be shown to said described property in said parties, free from all liens and encumbrances, upon examination by the City Attorney. BE IT FURTHER RESOLVED: THAT the sum of Three Thousand ($3000.00) Dollars be and the same is hereby appropriated out of the Street Improvement Bond Fund, for the purpose of paying said first named parties for said property, and that a warrant in said amount issue therefor and be delivered to said parties after approval of title to said property by the City Attorney, and the delivery by said parties of their general warranty deed to said property.
