48 REGULAR MEETING OF THE OITY COUNCIL: Austin, Texas, May 15, 1930. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Mofadden, Counoilmen Mueller, Pannell, Reed, and Steck, 5; absent, none. Councilman Pannell moved that the reading of the Minutes of the last meetings be deferred until the next meeting. Motion was seconded by Councilman Steck, and same prevailed by the following vote, Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following ordinance: ORDINANCE OF THE CITY OF AUSTIN, TEXAS, DETERMINING THE NECESSITY FOR LEVYING AN ASSESSMENT AGAINST THE PROPERTY AND THE OWNERS THEREOF ON PORTIONS OF GUADA- LUPE STREET AND SUNDRY OTHER STREETS IN THE CITY OF AUSTIN, FOR A PART OF THE COST OF IMPROVING SAID STREETS, AND FIXING A TIME FOR A HEARING OF THE OWNERS OR AGENTS OF SAID OWNERS OF BAID PROPer- TY, OR OF ANY PERSONS INTERESTED IN SAID IMPROVEMENTS, AS PROVIDED BY THE CHARTER OF THE CITY OF AUSTIN, AND DIRECTING THE CITY MANAGER TO GIVE NOTICE OF SAID HEARING AND EXAMINING AND APPROVING THE ROLL OR STATEMENT OF THE CONSULTING ENGINEER, AND DECLARING AN EMERGENCY. The above ordinance was' read the first time and Councilman Mueller moved that the rule be suspended and the ordinance passed to its second reading . The ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilman Mueller moved that same be finally passed. The Mayor declared that the hearing of property owners and other interested parties with reference to the improvement of the following streets: NUECES STREET from the north line of West Nineteenth Street to the south line of West Twenty-fourth Street, known and designated as Unit or District No. 27; ΒΑΝ ΑΝΤΟΝIO STREET from the north line of West Nineteenth Street to the south line of West Twenty-fourth Street, known and designated as Unit or District No. 28; which was continued from the last meeting would now be opened. ing to protest, the Mayor introduced the following ordinance: ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING PORTIONS OF NUECES STREET AND SUNDRY OTHER STREETS IN THE CITY OF AUSTIN, TEXAS, FIXING A CHARGE AND LIEN AGAINST PROPERTY ABUTTING THEREON AND AGAINST THE OWNERS THEREOF, PROVID- ING FOR THE COLLECTION OF SUCH ASSESS- MENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF. The Mayor laid before the Council the following report of the Zoning Commission: "To the Hon. City Council of Austin, Teхав. Gentlemen: This is to advise you that the Zoning Commission of the City of Austin has completed a survey of the City and has tentatively subdivided the City into Use Districts, or zones, and Height and Area Districts, or zones, and have prepared maps showing same. The Zoning Commission also found it necessary to have the technical portion of the Zoning Ordinance formulated before it could intelligently complete the zoning map and this portion of the Zoning Commission's work took more time than the study of the zones. In accordance with the provisions of a portion of Section 4 of the Zoning Ordinance, the Zoning Commission herewith presents to the City Council of the City of Austin this preliminary report consisting of one Zoning Use District Map, one Height and Area District Map, the technical portions of a proposed Zoning Ordinance, and this communication. The two zoning maps are so large that it is impractical to bring same to the Council Chamber and said maps are hanging on the wall of the office of the Superintendent of the Electrical Department. According to the Zoning Ordinance, this preliminary report must be made, but no City Council action is required at this time. The Zoning Commission proposes to continue its work in accordance with the provisions of the Zoning Ordi- nance. Respectfully submitted, HUGO F. KUEHNE, Chairman, Zoning Commission. By: (Sgd) Orin E. F.Helland, Consulting Engineer, showing the estimated cost of improvements on East Nineteenth Street from the east property line of Congress Avenue to the west property line of East Avenue, known and designated as Unit or District No. 41, was read and ordered filed. The Mayor then laid before the Council the following resolution: RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A POR- TION OF EAST NINETEENTH , STREET IN THE CITY OF AUSTIN, TEXAS, FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY, AND DIRECT- ING THE CITY MANAGER TO GIVE NOTICE. WHEREAS, the City Council of the City of Austin has heretofore ordered that the hereinbelow mentioned portion of highway be improved by raising, grading, H 49 50 and filling, and installing concrete curbs and gutters, and by paving with two inch Warrenite Bitulithic Wearing Surface on a five inch concrete base, with necessary appurtenances, and contract therefor has been made and entered into with Southwest Bitulithic Company; and WHEREAS, the City Council has caused the City Engineer to prepare and file estimates of the cost of such improvements, and estimate of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined. Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That such estimates be and they are adopted and approved. II. That it is hereby found and determined that the cost of improvements on such portion of highway, with the amount or amounts per front foot proposed to be assеввед for such improvemente against the abutting property and owners thereof, on such portion of street or highway are as follows, to-wit: EAST NINETEENTH STREET from the East property line of Congress Avenue to the west property line of East Avenue, known and designated as Unit or District No. 41, estimated cost of improvements is $31005.96. Estimated amount per front foot to be assessed for curb and gutter is $ .70 (70%). Estimated amount per front foot to be assessed against abutting property and its owners for improvements exclusive of curb and gutter 18 $4.481. Total estimated amount per front foot to be assessed against abutting property and its owners ів $5.181. III. That a hearing be given and held by and before the City Council of the Oity of Austin, Texas, to all owning or claiming any property abutting upon any of said portion of street and highway, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the 29th day of May, 1930, at ten o'clock A. M., in the regular Council meeting room in the City Hall in the City of Austin, Texas, and the City Manager is hereby directed to give notice of the time and place of such hearing, and of other matters and facts, in accordance with the terme and provisions of Article XXIV of the Charter of the City of Austin, which Article was added by amendment adopted at an election held on November 24th, 1928. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Austin, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Article XXIV. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. The report of H. R. F. SAN JACINTO STREET from the North property line of East First Street to the South property line of East Fifth Street, known and designated as Unit or District No. 33. SAN JACINTO STREET from the North property line of East Ninth Street to the South property line of East Thirteenth Street, known and designated as Unit or District No. 36. Estimated cost of improvements is $26,391.40. Estimated amount per front foot to be assessed for curb and gutter is $ .70 (704). Estimated amount per front foot to be assessed against abutting property and its owners for improvements exclusive of curb and gutter is $6.269. Total estimated amount per front foot to be assessed against abutting property and its owners is $6.969. SAN JACINTO STREET from the South property line of East Thirteenth Street to the North property line of East Fifteenth Street, known and designated as Unit or District No. 37. Estimated cost of improvements is $15,023.90. Estimated amount per front foot to be assessed for ourb and gutter is $.70 (70g). Estimated amount per front foot to be assessed against abutting property and its owners for improvements exclusive of curb and gutter is $6.269. Total estimated amount per 51
