This being the day set for the hearing of owners of abutting property and others interested with reference to street improvements to be constructed in the certain Units or Districts of Improvement, as follows: RED RIVER STREET from the North line of Nineteenth Street to the North line of Twenty-Fourth Street, known and designated as Unit or District No. 43; RED RIVER STREET from the North line of Twenty-fourth Street to the North line of Thirty-second Street, known and designated as Unit or District No. 44; all as awarded to L. E. Whitham & Co. the Mayor thereupon stated that all persons desiring to protest against the levying of assessments against abutting property on the above mentioned street and within the limits above stated, or who desired to be heerd with reference to the improvements proposed to be assessed against said property and the owners thereof, the lien and liability thereof, the special benefits to the property and the owners thereof, or any 102 other matters or things authorized by the provisions of Article XXIV of the Charter of the City of Austin to be urged and considered at this hearing would now be heard from, and thereupon the following property owners were heard: On Red River Street from 19th to 24th Streets: 0. W. Sandstrom asked that the street be paved to a width of forty feet instead of thirty-six feet on account of the volume of traffic that it will carry; and also asked that in order to have a uniform pavement on the street, this portion of said street be paved with Bitulithic instead of Concrete Pavement. C. A. Schutze asked that a uniform type of paving be used. C. M. Browne stated that he was in favor of a forty foot instead of a thirty-six foot street. No other property owners or interested parties desiring to be heard, the Mayor thereupon introduced the following ordinance: ORDINANCE OF THE CITY OF Austin, TEXAS, OLOSING A HEARING GIVEN TO PROPERTY OWNERS ON RED RIVER STREET, IN THE CITY OF AUSTIN, IN, AND DEOLARING AN EMERGENCY. The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The above ordinance was read the first time and Councilman Mueller moved that the rule be suspended and the ordinance passed to its second reading. Councilman Mueller moved that in view of the program that the Council has outlined for the extension of the water and light distribution service for this year, the request of said committee be declined. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of One Hundred and Fifty Dollars ($150.00) be and is hereby appropriated out of the reserved portion of the General Fund to cover expenses of Denver, Colorado, trip by Architect, Hugo F. Kuehne, for City Planning and Zoning purposes. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of Twenty Thousand ($20,000.00) Dollars be and the same is hereby appropriated out of the Water and Light Fund for the purpose of placing same to the job account of the United Engineers & Constructors, Inc., to be used for the payment of labor and materials in connection with construction for the Water, Light and Power Department, under the terms of the contract between the City and said Company. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: WHEREAS, the Park Board has advised the City Council of the City of Austin that in order to complete the playground on the east bank of Shoal Creek immediately west of West Avenue and south of West 10th Street, it will be necessary to purchase .647 of an acre of land located immediately south of the property recently purchased by the City from C. M. Bartholomew, belonging to Lon A. Smith; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be authorized to purchase the above described land from the said Lon A. Smith at a price not to exceed $1,000.00, and that the sum of $1,000.00 be appropriated out of the Parks and Playgrounds Bond Fund for said purpose. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 43; nays, none; Councilman Reed absent. Mayor McFadden moved that the work done under Barton Springs Contract No. "" in the amount of $762.88, by C. A. Maufrais, Contractor, be accepted, in accordance with the recommendation of the Consulting Engineer, and that the City Manager be authorized to pay the final estimate on same. The following bids for the construction of miscellaneous storm sewers, being Contract No. 19, were read: W. G. Cullum, in the amount of Kirkwood, Wharton & Lee in the amount of Dallas Construction Company, in the amount of Dozier Construction Company, in the amount of ----$18,576.50 18,792.30 18,813.13 20,409.00. Councilman Pannell moved that contract be awarded to W. G. Cullum, in the amount of $18,576.50. A communication from T. U. Taylor, requesting that some arrangement be made to protect his trees when San Antonio Street is paved, was read and the matter referred to the Consulting Engineer to determine what relief can be given. The Mayor laid before the Council the following resolution: WHEREAS, the budget originally adopted for the year 1930 did not anticipate mater1al changes in the general accounting system; and WHEREAS, it has since become desirable to make an immediate installation of general cashbook and other books of original entry; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Two Hundred ($200.00) Dollars be and the same is hereby appropriated out of the unappropriated portion of the General Fund for the purpose above stated. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch low pressure gas main in LeGrande Avenue beginning at a point 29 feet north of and 90 feet east of the intersection of the east line produced of that part of Newning Avenue that is north of LeGrande Avenue and the south line of said LeGrande Avenue; Thence in a westerly direction 29 feet north of and parallel to the south line of LeGrande Avenue a distance of approximately 1/2 block to a point where said main will intersect with a line 20 feet south of the north line of that portion of LeGrande Avenue that is west of Hillside Drive; Thence in a westerly direction 20 feet south of and parallel to the north line of LeGrande Avenue a distance of approximately one block to the west line of Melissa Lane. Said gas main described above shall have a cover of not less than 2 feet. (2) A 4 inch low pressure gas main in Chicon Street beginning at a point 27 feet south of and 21 feet west of the intersection of the north line of East Nineteenth Street and the east line of Chioon Street; Thence in a southerly direction 21 feet west of and parallel to the east line of Chicon Street a distance of approximately two blocks to the north line of East Seventeenth Street. Said gas main described above shall have a cover of not less than 22 feet. (3) A 4 inch low pressure gas main in Rainey Street beginning at the end of an existing gas main, which end is 28 feet north of and 17 feet east of the intersection of the north line of River Street and the west line of Rainey Street; Thence in a southerly direction 17 feet east of and parallel to the west line of Rainey Street a distance of approximately 60 feet to a point 32 feet south of the north line of River Street. Said gas main shall have a cover of not less than 3 feet. (4) A 4 inch low pressure ras main in River Street beginning at a point 17 feet east of and 32 feet south of the intersection of the north line of River Street and the west line of Rainey Street; Thence in a westerly direction 32 feet south of and parallel to the north line of River Street a distance of approximately one-half block to a point 26 feet east of the west line of Bierce Street. Said gas main described above shall have a cover of not less than 32 feet. (5) A 4 inch low pressure ras main in Bierce Street, berinning at a point 32 feet south of and 26 feet east of the intersection of the north line of River Street and the west line produced of Bierce Street; Thence in a southerly direction 26 feet east of and parallel to the west line of Bierce Street a distance of approximately one block to the north line of Cummings Street. Said gas main described above shall have a cover of not less than 4 feet. ! si 105 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construc- tion of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Helland, Consulting Engineer, of the revised est1mate for the paving of West Fifth Street from the west line of Nueces Street to the West line of West Avenue, known and designated as Unit or District No. 23, was read and ordered filed. The Mayor then laidbefore the Council the following resolution: 106 RESOLUTION APPROVING AND ADOPTING NEW ESTIMATE OF THE COST OF IMPROVE- MENTS AND OF THE AMOUNTS TO BE ASSESS- ED FOR IMPROVEMENTS ON A PORTION OF WEST FIFTH STREET IN THE CITY OF AUSTIN, TEXAS, FIXING TIME AND PLACE FOR NEW HEARING TO OWNERS OF ABUTTING PROPERTY, AND OTHERS INTERESTED, AND DIRECTING THE CITY MANAGER TO GIVE NOTICE. WHEREAS, the City Council of the City of Austin, Texas, by ordinance of April 3, 1930, ordered that sundry streets and highways be improved by raising, grading, filling and installing concrete curbs and gutters and paving, together with necessary appurtenances, and a contract therefor was made and entered into with Southwest Bitulithic Com- pany; and WHEREAS, it was originally provided that improvements should be constructed on West Fifth Street from the west line of Nueces Street to the west line of West Avenue, known and designated as Unit or District No. 23, to a width of 60 feet between curb lines; and WHEREAS, after an estimate of the cost of said improvements had been filed, a rеsolution passed providing for hearing and a hearing held, but no assessments levied, another ordinance was passed authorizing and providing for a change in the contract so as to provide that said portion of street should be improved with the same kind of improvements provided for in the original contract, except that a change was to be made in the width of the improved area so that unit or district of improvement should be improved to a width of 50 feet between curb lines instead of 60 feet; und WHEREAS, a new estimate of the cost of such improvements on said unit or district of improvement, with the amounts per front foot proposed to be assessed against abutting property and the owners thereof has been prepared and filed, and such estimate has been examined; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: I. That such new estimate be and the same is hereby adopted and approved. That a new hearing be given and held by and before the City Council of the City of Austin, Texas, to all owning or claiming any property abutting upon said portion of street hereinbefore described, as well as all owning or claiming any interest in such property. Such hearing shall be given and held on the 10th day of July, 1930, at 10:30 o'clock A..., in the regular Council meeting room in the City Hall in the City of Austin, Texas, and that the City Manager is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of Article XXIV of the charter of the City of Austin. Such notice shall be by advertisement i 107 inserted at least three times in a newspaper published in the City of Austin, Texas, the first publication to be made at least ten days before the date of said hearing, and said notice shall comply with and be in accordance with the terms and provisions of said Article XXIV of said charter. The Mayor then laid before the Council the following resolution: RESOLUTION APPROVING AND ADOPTING NEW ESTIMATES OF THE COST OF IM- PROVEMENTS AND OF THE AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON PORTIONS OF ENFIELD ROAD AND A PORTION OF PARKWAY STREET IN THE CITY OF AUSTIN, TEXAS, FIXING TIME AND PLACE FOR NEW HEARING TO OWNERS OF ABUTTING PROPERTY AND OTHERS INTERESTED, AND DIRECTING THE CITY MANAGER TO GIVE NOTICE. WHEREAS, the City Council of the City of Austin, Texas, by ordinance of April 3, 1930, ordered that sundry streets and highways be improved by raising, grading, filling and installing concrete curbs and gutters and paving, together with necessary appurtenances, and a contract therefor was made and entered into with Southwest Bitulithic Company; and WHEREAS, it was originally provided that improvements should be constructed on certain portions of streets designated in said ordinance and contract as Unit or District No. 46, and described as Enfield Road and Parkway from the North line of West Twelfth Street to the West line of West Lynn Street, and that such improvements should be made to a width of 40 feet between curb lines; and WHEREAS, after an estimate of the cost of said improvements had been filed, a resolution passed providing for hearing and a hearing held and continued but no asseввments levied, another ordinance wan pacsed authorizing and providing for a change in the contract so as to provide that said etreet area formerly desi nated an Unit or ristrict No. 46 should be divided into three units described as follows: PARKWAY STREET AND ENFIELD ROAD from the North line of West Twelfth Street to the East lines of Lots 29 and 50 in Subdivision known as Enfield "A", known and desiranted as Unit or District No. 46; ENFIELD ROAD from the Fact lines of Lote 29 and 50 in Suboiviston known no Enfield "A" to the Fast lines of Blanco Street and Windsor Road, known and designated as Unit or District No. 46a; ENFIELD ROAD from the Fast lines of Blanco Street and Windsor Road to the West line of West Lynn Street, known and designated as Unit or District No. 46t; and that the same be improved with the came kind of improvemente provided for on to said original Unit or District No. 46, but making changes in the plane with reference to the widths to which such improvements should be made so as to provide that each of said units or districts shall be improved between existing curbs so far as said curbs 108 are found sufficient by the Consulting Engineer of the City. That where there are no curbs or new curbs are required to be installed, said Unit or District No. 46 is to be paved to a width of 40 feet between cur lines. That said Unit or District No. 460 is to be paved so as to leave the space in the center of said street desirnoted as "Park" on the map of the Subdivision known as Enfield "A" unpaved, and so as to pave the area between the existing curbs, and that said Unit or District No. 46b shall be paved between existing curb lines where the curbs are found sufficient by the Consulting Engineer of the City and where new curbs are required to be installed the width between curb lines is to be 40 feet; and WHEREAS, new estimates of the cost of such improvements on said three units or districts of improvements, with the amounts per front foot proposed to be assessed against abutting property and the owners thereof, have been prepared and filed, and such estimates have been examined; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: I. That such new estimates be and the same are hereby adopted and approved. II. That it is hereby found and determined that the cost of such improvements on said unite or districts with the amount or amounts per front foot proposed to be assessed against abutting property and the owners thereof are as follows: ON PARKWAY STREET AND ENFIELD ROAD from the North line of West Twelfth Street to the East lines of Lots 29 and 50 in Subdivision known as Enfield "A", known and desig nated as Unit or District No. 46; the estimated cost of the improvements is $9,000.36; the estimated amount per front foot to be assessed against abutting property and owners thereof for curb and gutter is $.70; the estimated amount per front foot to be assessed against abutting property and owners thereof for improvements exclusive of curb and gutter is $4.031; total estimated amount per front foot to be assessed against abutting property and owners thereof is 34.731.
