134 REGULAR MEETING OF THE CITY COUNCIL: The Council was called to order by the Mayor. members present: Mayor MoFadden, Councilmen Mueller, absent, none. Austin, Texas, July 24, 1930. Roll call showed the following Pannell, Reed, and Steck, 5; The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same as read. Motion wae seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following ordinance which had been read the first time at the last regular meeting and laid over: ORDINANCE AMENDING AND CHANGING PLANS, METHODS AND CONTRACT FOR THE IMPROVEMENT OF A PORTION OF SOUTH CONGRESS AVENUE IN THE CITY OF AUSTIN, TEXAS, AND PROVIDING THE NECESSARY MATTERS INCIDENTAL THERETO. The above ordinance was read the second time and Councilman Pannell moved a suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck,5; nays, none. The Mayor laid before the Council the application of John Nicholas, Jr. to construct and operate a drive-in garage at Neches Street and Sixth Street Alley, which was read the first time and laid over. The Mayor laid before the Council the application of Treland S. Graves to construct and operate a gasoline filling station at West Nineteenth Street and the alley between Whitis and University Avenues, which was read the first time and laid over. The Mayor laid before the Council application of J. Talbot LaPrelle for tentative approval of site for a gasoline filling station in LaPrelle Courts; also recom- mendation of the Safety Committee for same. Councilman Mueller moved that in accord+ ance with the recommendation of the Safety Committee, the City Council hereby grant tentative approval of Lots 1 and 2, Block 1, LaPrelle Courts, as a proposed gasoline filling station site and the applicant, J. Talbot LaPrelle, be advised to present a layout plan to the Safety Committee for consideration. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Coun- cilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, 135 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Texas Public Service Company be and the same is hereby permitted to lay and construct ite gas mains in and upon the following streets: (1) A 4 inch high pressure gas main in Congress Avenue Alley beginning at the dead end of an existing 4 inch high pressure gas main, which dead end 18 9 feet west of and approximately 100 feet north of the intersection of the north line of Fast Seventh Street and the east line of Congress Avenue Alley; Thence in a northerly direction 9 feet west of and parallel to the east line of said Congress Avenue Alley a distance of approximately 1/2 block to the north line of East Eighth Street. Be it understood that permission for construction of the gas main described above is granted subject to the following conditions: 1. A 6-inch concrete base shall be poured by the Texas Public Service Company composed of 1 part incor cement, 22 parts sand, and 3 parts screened gravel or crushed rock. 2. The City will provide an inspector for this job, but said inspector shall be paid by the Texas Public Service Company. 3. Provisions shall be made to preserve the safety of traffic during the course of construction or maintenance of said gas main. 4. All damages whatever caused to existing utilities during the course of construction or maintenance of the gas main described above shall be paid for by the Texas Public Service Company. The Texas Public Service Company is hereby put upon notice that the Oity of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite infor- mation upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the ex- pense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. That the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditione of the certain franchise granted to said Company by the Oity of Austin. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase in the name of the City of Austin, from H. C. Ramsey, V. R. Ramsey, and Mrs. Sallie F. Scott (formerly Sallie E. Ramsey), a widow, for the cash consideration of Three Thousand ($3,000.00) Dollars, seven-tenths (7/10) of an acre of land, more or less, part of the Isaac Decker League in the City of Austin, Travis County, Texas, and part of Lot 10 in the partition of the James E. Bouldin Estate: Beginning at a point on the S. side of Mary Street where the S. line of said Street intersects the W. boundary line of the right of way of the I. & G. N. R. R.; thence with the S. line of Mary Street 67 varas to a stake in an old rock fence; thence with said fence S. 29-1/2 W. 1.63 varas to an intersection of said fence with W. line of the I. & G. N. right of way; thence with said W. line N. 49 E. 189 varas to the place of beginning; 136 said transaction to be made, provided that good title is shown in said parties to said property; said property to be purchased for the purpose of constructing in part a pass on Mary Street under the track and right of way of the International-Great Northern Railroad Company. BE IT FURTHER RESOLVED: THAT the sum of Three Thousand ($3000.00) Dollars be and the same is hereby appropriated out of the Street Improvement Bond Fund to pay for said property, and that a warrant issue therefor. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Counc 11 men Mueller, Pannell, Reed, and Steck, 5; nays, none. The City Manager was authorized by the City Council to enter into a lease with The Texas Company for the sale of petroleum products at the Robert Mueller Airport. Councilman Reed moved that the vote by which the ordinance entitled: ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING PORTIONS OF WEST SIXTH STREET AND SUNDRY OTHER STREETS IN THE CITY OF AUSTIN, TEXAS, FIXING A CHARGE AND LIEN AGAINST PROPERTY ABUT- TING THEREON AND AGAINST THE OWNERS THEREOF, PROVIDING FOR COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF was passed by the City Council at its meeting on July 17, 1930, be reconsidered. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor then laid before the Council the above named ordinance. Councilman Mueller moved that the City Manager be instructed to purchase the Rabb property adjoining Barton Springs, and, if necessary, to institute condemnation proceedings against same.
