169 AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said Company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Pannell, Reed, and Steck, 4; nays, none; Councilman Mueller absent. A petition signed by the business firms on Colorado Street between Fourth and Fifth Streets, asking that the one hour parking limit be applied to this street, was read and the matter referred to the City Manager and City Attorney to have proper ordinance drawn. An ordinance relative to zoning was submitted to the Council by the Zoning Commission and the City Attorney was instructed to prepare a resolution accepting same. Judge R. E. Cofer, representing Mrs. Lee Fulton, stated that they were not opposed to paving, but thought the assessment too high on account of the location of the street; Councilman Pannell moved that the hearing on this street be continued until the next regular meeting and the City Manager and Consulting Engineer be authorized to consult with the property owners, looking to an adjustment of the cost. On Nueces Street from 24th to 27th Streets: G. F. Joseph, through his attorney, W. R. Smith, requested that the City not compel him to move the wall being built by him in front of his property in Edgemont, and which enoroaches upon city property, back to his property line. The Mayor laid before the Council the following resolution: WHEREAS, the City Manager of the City of Austin has recommended additional improvements at the Robt. Mueller Municipal Airport, said improvements to consist of grading and shaping of approximately 50 acres of land, and the estimated cost of said improvements is $2,981.35; and WHEREAS, the recommendation of the City Manager has been reviewed and approved by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of $2,981.35 is hereby appropriated out of the Airport Bond Fund for the purpose of grading and improving approximately 50 acres of the Robt. Caswell and R. Severn for permit to use all of the sidewalk area in front of their property at corner of Twenty-ninth and Guadalupe Streets for the parking of cars and that they be not required to construct ourbs opposite their property, was read. Councilman Mueller moved that the request be denied for the reason that the proposed change does not cover the entire block, thus making an offset which would create a hazard. The Mayor laid before the Council the following: "Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: We, the members of the Safety Committee of the City of Austin, have investigated the application of Scott & Gregg as presented by 2. T. Scott for a permit to construct a commercial driveway across the sidewalk on 7th Street between Congress Ave- nue and Brazos Street, a short distance west of Brazos Street, said commercial driveway to be used for the purpose of establishing a cab stand. We, the Safety Committee, recommend that said permit be granted, subject to the following conditions: 1. 2. That no buildings or gasoline equipment shall be constructed upon said property. That lines and grades for the construction of the ramp shall be obtained from the City Engineering Department, for entrances and driveways. 3. 4. That no gasoline or oils shall be stored upon or sold from the property. That electric lights only shall be used for lighting purposes, and all electric wiring shall be done in compliance with regulations governing the wiring of gasoline filling stations, and shall be approved by the City Electrical Department. 5. That "No Smoking" signs shall be displayed at all times and no person shall be permitted to smoke or have any open flame on premises where gasoline is sold or stored. 6. That there shall be kept in an accessible place at all times, a chemical fire extinguisher for emergency use. 7. That the applicant shall construct all ramps, gutters and curb returns in accordance with plan Number 2-H-113, which plan is hereby made a part of this resolut ion.
