180 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, September 18, 1930. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor Mofadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; absent, none. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor Mofadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. nance: The Mayor laid before the Council for its second reading the following ordiAN ORDINANCE REGULAT ING TRAFFIC ON LAVACA STREET, BETWEEN ITS INTERSECTION WITH SEVENTH STREET AND ITS INTERSECTION WITH NINTH STREET, IN THE CITY OF AUSTIN, OUMULATIVE OF OER- TAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ORDINANCES IN CONFLICT, AND PRESCRIBING PENALTIES. The above ordinance was read the second time and laid over. The Mayor laid before the Council the following resolution: WHEREAS, Claude Pollard, represented by his agent and contractor, Frank R. Rundell, has requested that the City grant him a permit to construct a rock ourb on the gutter line adjacent to his property known as Lot 4 of Sunset Hill Addition at the corner of Windsor and Poquonock Roads; and WHEREAS, the City Council has considered said request; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Claude Pollard is hereby granted a permit to construct a rock curb, prоvided same is constructed in accordance with the plan and specifications hereto attached as shown on plan marked 2-0-285, and also subject to Claude Pollard constructing a concrete apron or gutter adjacent to said rook ourb, all of same to be constructed in accordance with lines and grades to be furnished by the City Engineering Department. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, on the 14th day of August the City Council of the City of Austin assigned space for a gas main in West Mary Street from South Third Street to South Fourth Street, the enter line of which gas main was assigned 18 feet south of the north line of said West Mary Street and parallel thereto; and WHEREAS, during the course of construction of said gas main it was found that other utilities were already in place on the space assigned for gas mains; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the action assigning space for a 4 inch high pressure gas main in West Mary Street from South Third Street to South Fourth Street as recorded in Minute Book 12, Page 157, be rescinded, and J 0 181 BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Texas Public Service Company be granted permission to construct a 4-inch high pressure gas main in West Mary Street from South Third Street to South Fourth Street the center line of which gas main shall be 19 feet north of and parallel to the south line of said West Mary Street. The above resolution was adopted by the following vote: Ayes, Mayor Mofadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of a regulator pit in the street in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its regulator pit in the following described street: (1) A regulator pit in the Post Road, center line of same to be 18 feet west of the east line of the said Post Road and 125 feet south of the north line of Live Oak Street. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervale during the course of backfilling of the ditches. THAT the work and laying of said regulator pit, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: 182 (1) A gas main in Park Place from Red River Street through the Weise Resubdivision, approximately 350 feet from Red River Street west, the center line of the gas main to be 9 feet south of the center line of said street. The gas company shall be specifically put upon notice that Park Place is a curved street a portion of the way and that accurate lines should be secured from the City Engineering Department before placing the main in the curved portion of the street. The Texas Public Service Company is hereby put upon notice that the Oity of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. A letter from Uncas Johnson, Adjutant Travis Post #76, American Legion, expressing the thanks of said organization for the co-operation and assistance rendered them by the City during their recent State Convention, was read and ordered filed. Councilman Reed moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steok, 5; naye, none.
