REGULAR MEETING OF THE CITY COUNCIL: 299 Austin, Texas, December 26, 1930. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; absent, Councilman Reed, 1. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same as read. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent, 1. A report of H. R. F. Helland, Consulting Engineer, showing a tabulation of bids received for the construction of a culvert on East Avenue between Tenth and Eleventh Streets, being Street Improvement Bond Fund Contract No. 28, was read, and Councilman Mueller moved that the bid of W. G. Cullum & Company, in the amount of $2190.00, be accepted as the lowest and best bid, and that the City Manager be authorized to enter into contract with said firm for said work. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and steck, 4; naye, none; Councilman Reed absent, 1. A report of H. R. F. Helland, Consulting Engineer, showing a tabulation of bids received for the construction of a culvert on Little Shoal Oreek between Fourth and Fifth Streets, being Street Improvement Bond Fund Contract No. 29, was read. Councilman Mueller moved that the bid of W. G. Cullum & Company, in the amount of $10,439.80, be accepted as the lowest and best bid, and that the City Manager be authorized to enter into contract with said firm for said work. A report of H. R. F. Councilman Mueller moved that the bid.of L. E. Whitham & Company, in the amount of $1,625.00, be accepted as the lowest and best bid and that the City Manager be authorized to enter into contract with said firm for said work. Motion "as seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent, 1. , The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch low pressure gaa main in Poquito Street beginning at a point 3 feet north of and 5 feet west of the intersection of the center line of Manor Road and the center line of Poquito Street. 300 Thence in a southerly direction, 5 feet west of and parallel to the center line of said Poquito Street, a distance of approximately one block to the north line of East Twenty-second Street. Said gas main described above shall have a cover of notless than 3 feet. (2) A 4 inch low pressure gas main in Alamo Street beginning at a point 3 feet north of and 5 feet west of the intersection of the center line of Manor Road and the center line of said Alamo Street. Thence in a southerly direction, 5 feet west of and parallel to the center line of said Alamo Street a distance of approximately one block to the north line of East ! Twenty-second Street. Said gas main described above shall have a cover of not less than 3 feet. (3) A 4 inch low pressure gas main in Coleto Street, beginning at a point 3 feet north of and 10 feet west of the intersection of the center line of Manor Road and the center line of Coleto Street. Thence in a southerly direction, 10 feet west of and parallel to the center line of Coleto Street a distance of approximately one block to the north line of East Twenty-second Street. Said gas main described above shall have a cover of not lees than 3 feet. (4) A 4 inch low pressure gas main in Oldham Street beginning at a point 18 feet south of and 12 feet west of the intersection of the north line of East Twenty-second Street and the center line of Oldham Street. Thence in a northerly direction, 12 feet west of and parallel to the center line of said Oldham Street, a distance of approximately one block to a point 15 feet south of the north line of East Twenty-third Street. Said gas main described above shall have a cover of not less than 2 feet. (5) A 4 inch low pressure gas main in Eva Street Alley beginning at a point 22 feet south of and 4 feet east of the intersection of the north line of Milton Street and the west line of said Eva Street Alley. Thence in a southerly direction, 4 feet east of and parallel to the west line of said alley a distance of approximately one block to the south line of Annie Street. Said gas main described above shall have a cover of not less than 2 feet. The alley described above is under fence between Mary Street and Annie Street and it is probable that the Texas Public Service Company will have to obtain an eaвеment before entering that portion of the alley that is under fence, and in case an easement is obtained, it is suggested that you follow the same assignment as given in the blook north of Annie Street. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department | not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terme and conditions of the certain franchise granted to said Company by the City of Austin. The above resolution wae adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 43; nays, none; Councilman Reed absent, 1. The Mayor announced that the hearing on East Fifteenth Street from Red River to Sabine Streets and from Sabine Street to East Avenue which was continued from the last regular meeting would now be opened. No property owners or interested parties appearing to be heard, the Mayor thereupon laid before the Council the following ordinance: ORDINANCE CLOSING HEARING AND LEVY- ING ASSESSMENTS FOR PART OF THE COST OF IMPROVING PORTIONS OF FIFTEENTH STREET IN THE CITY OF AUSTIN, TEXAS, FIXING A CHARGE AND LIEN AGAINST PROPERTY ABUTTING THEREON AND AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE OER- TIFICATES IN EVIDENCE THEREOF. The above ordinance was read the first time and Councilman Pannell moved that the rule be suspended and the ordinance passed to its second reading. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, and Steck, 4; naye, none; Councilman Reed absent, 1. The ordinance was read the second time and Councilman Pannell moved a further suspension of the rule and the placing of the ordinance on its third reading and final passage. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayee, Mayor MoFadden, Councilmen Mueller, Pannell, and Steck,4; nays, none; Councilman Reed absent, 1. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. The application of J. M. Driner to erect a gasoline filling station at 2108 East 13th Street was read and laid over for one week. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager is hereby authorized to grant to Schwarzer & Lorey, Contractors, permit to use a portion of Congress Avenue and the portion of Fourth Street which is opposite Lot No. 6, Block No. 30, Original City of Austin, for the purpose of storage of materials and building operations in connection with the work of wrecking a building and constructing a filling station in accordance with the conditions and descriptions set forth in the attached permit form. The above resolution was adopted by the following vote: Ayes, Mayor Moradden, Councilmen Mueller, Pannell, and Steck, 4; nays, none; Councilman Reed absent. Councilman Pannell moved that the Council recess, subject to call of the Mayor.
