383 thence southerly with the west line of West Avenue 50 feet to the place of beginning, together with all appurtenances and improvements thereon situated. The above property is to be purchased for the purpose of widening and extending West Fifth Street at and beyond its intersection with West Avenue; and it may be stipulated that the present owners may remain in possession of said property until June 15, 1931 without charge for rent thereof. , BE IT FURTHER RESOLVED: That the sum of $6100.00 be and the same is hereby appropriated out of the Street Improvement Bond Fund, and that warrant in said amount issue therefor, payable to the Vendors, after approval of title to said land by the City Attorney and delivery by said parties of their general warranty deed to said land. The above resolution was adopted by the following vote: Ayes, Mayor MoFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Mueller moved that the bill of H. F. Kuehne, Architect, in the amount of $625.00 for professional services rendered in connection with the building of the Oity Abattoir, be approved, and the City Manager be authorized to have city warrant issued in payment of same. Motion was seconded by Councilman Pannell and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Pannell made a motion to lay before the Council the certain resolution reciting, among other things, the qualifications of city employeeв. A motion to recess was made by Counoilman Reed in lieu thereof, which motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Reed, and Steck, 3; nays, Councilmen Mueller and Pannell. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same as read. Motion was seconded by Councilman Mueller, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. A communication from T. B. Marshall, Tax Assessor and Collector, recommending that, due to an error having been made, the two-thirds taxable value on the improvements on Lot 3, Block 53, Plat 7, Original City, belonging to Mrs. F. S. Smoot for the year 1930 be placed at $1,340.00, was read, and Councilman Reed moved that the recommendation of the Tax Assessor and Collector be approved and that he be authorized to change his rolls accordingly. Helland, Consulting Engineer, showing a tabulation of bids received on Street Improvement Bond Fund Contract No. 32, being BouldinGreek Cutoff Excavation, was read, and Councilman Reed moved that contract be awarded to Joe Macken, lowest bidder, in the sum of $13,610.00, and that the City Manager be authorized to execute same accordingly. Motion was seconded by Councilman Pannell, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, M. H. Crockett has presented to the City Council a request for a permit | to construct a curb 20 feet back of the proposed standard curb line on Waller Creek Boulevard in front of his property on the north side of Waller Creek Boulevard west of Duval Street; and WHEREAS, the City Engineer has recommended that this request be granted, subject to the following conditions: (1) That the widening of Waller Creek Boulevard be carried out in accordance to the accompanying plan marked 2-H-144, which plan shall become a part of this resolution, and that all walks, ramps, curbe, and that area which lies between the standard gutter and the proposed new concrete curb shall be constructed of concrete at the expense of the applicant. (2) That all such widened area of parking between gutter and ourb line shall be constructed of concrete, which concrete shall be not less than 6" in thickness, and of the same proportion and to have the same strength as the concrete which will be placed as paving on Waller Creek Boulevard and to have a vertical curb which shall be constructed not less than 6" high between such widened area and the sidewalk space; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That M. H. Crockett be granted a permit to construct a curb 20 feet back of the proposed standard curb line on Waller Creek Boulevard in front of his property on the north side of Waller Oreek Boulevard west of Duval Street subject to the following conditions: , (1) That the widening of Waller Creek Boulevard be carried out in accordance to the ! accompanying plan marked 2-H-144, which plan shall become a part of this resolution, and that all walks, ramps, curbs, and that area which lies between the standard gutter and the proposed new concrete curb shall be constructed of concrete at the expense of the applicant. , (2) That all such widened area of parking between gutter and curb line shall be constructed of concrete which concrete shall be not less than 6" in thickness, and of the same proportion and to have the same strength as the concrete which will be placed as paving on Waller Creek Boulevard, and to have a vertical curb, which shall be constructed not less than 6" high between such widened area and the sidewalk space. Q. Andrewartha has presented to the City Council a request for the installation of a 32" x 32" grease trap in the alley lying between East Sixth Street and East Seventh Street at the rear of Lot 4, Block 66 of the Original Oity of Austin; and WHEREAS, said request has been reviewed by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. G. Andrewartha be permitted to lay and construct a 32" x 32" grease trap in the alley between East Sixth Street and East Seventh Street at the rear of Lot 4, Block 66 of the original City of Austin, the center of which grease trap shall be 12 feet north of and 27 feet west of the intersection of the south line of said alley and the west line of Neches Street. BE IT UNDERSTOOD THAT W. G. Andrewartha shall bear the expense of reconditioning the alley after said grease trap has been installed, and that said grease trap shall have a manhole ring and cover of a type approved by the Oity Engineer, the top of said cover to be flush with surface of alley. W. G. Andrewartha is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities but is based upon the best records we have at hand. When W. G. Andrewartha requires definite information upon the ground as to excavations or working points from which to base the location of his assignment, he shall apply to the City Engineering Department not less than three (3) days beforeе such information is required. The work of laying and constructing said grease trap shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, the Mackey Telegraph Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Mackey Telegraph Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) A telegraph pole line in Chicon Street from East Third Street to East Sixth Street, the center line of which pole line shall be 20 feet west of and parallel to the center line of said Chicon Street. That the work and construction of said pole line, including the excavation of the streets and the restoration and maintenance of said streets after said pole line has been constructed, shall be under the supervision and direction of the Otty Manager. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, during the year 1930 various insured properties which were used by the Street and Bridge Division of the Engineering Department of the City of Austin were destroyed by fire and the City has since collected the sum of Three Thousand 386 Thirty-one Dollars and Twenty-five Cents ($3031.25) from insurance companies, and WHEREAS, said money has been placed to the credit of the General Fund; and WHEREAS, it has become necessary to replace the destroyed improvements and no appropriation has been set forth for same in the 1931 budget; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the sum of Three Thousand and Thirty-one Dollars and Twenty-five Cents ($3031.25) be and the same is hereby appropriated out of the unappropriated portion of the General Fund for the purpose of reconstructing stables and incidental permanent improvements. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the City Counc11; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: A gae main in Meriden Lane from Enfield Road to Quarry Road, the center line of which gas main shall be 21 feet east of and parallel to the west line of said Meriden Lane. Said gas main described above shall have a cover of not less than 2 feet. Be it understood that three (3) days notice must be given the City Engineer before beginning actual construction of the gas main described above in order that lines and grades for same may be given. The Texas Public Service Company is hereby put upon notice that the Oity of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repaire от replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have beeni laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; Therefore, 387 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4 inch gas main in Comal Street from East Firet Street to East Seventh Street the center line of which gas main shall be 22 feet east of and parallel to the center line of said Comal Street. Said gas main described above shall have a cover of not less than 22 feet. (2) A 4 inch gas main in East Second Street beginning at a point 22 feet east of and 10 feet north of the intersection of the center line of East Second Street and the center line of Comal Street. Thence in a westerly direction, 10 feet north of and parallel to the center line of said East Second Street, a distance of approximately one block to Nayasota Street. Said gas main described above shall have a cover of not less than 22 feet. (3) A 4 inch gas main in that portion of East Third Street that is west of Comal Street, beginning at a point 6 feet south of and 22 feet east of the intersection of the center line of Comal Street and the center line of said East Third Street. Thence in a westerly direction 6 feet south of and parallel to the center line of said East Third Street a distance of approximately one block to Navasota Street. Said gas main described above shall have a cover of not less than 22 feet. (4) A 4 inch gas main in that portion of East Third Street that is east of Oomal Street beginning at a point 22 feet east of and 9 feet south of the intersection of the center line of Comal Street and the center line of said East Third Street. Thence in an easterly direction 9 feet south of and parallel to the center line of said East Third Street, a distance of approximately one block to Chalmers Street. Said gas main described above shall have a cover of not less than 2 feet. (5) A 4 inch gas main in East Fourth Street from Navasota Street to Chalmers Street the center line of which gas main shall be 5 feet south of and parallel to the center line of said East Fourth Street. Said gas main described above shall have a cover of not less than 22 feet. (6) A 4 inch gas main in East Seventh Street from Chicon Street to Navasota Street te the center line of which gas main shall be 10 feet north of and parallel to the center line of said East Seventh Street. Said gas main described above shall have a cover of not less than 22 feet. Be it understood that right angle bends shall be used in making connections with existing mains at East Sixth Street. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. The Mayor laid before the Council the following ordinance: ORDINANCE OF THE CITY OF AUSTIN, TEXAS, DETERMINING THE NECESSITY FOR LEVYING AN ASSESSMENT AGAINST THE PROPERTY AND THE OWNERS THEREOF ON ALLEY IN BLOCK NO. 134, AND SUNDRY OTHER ALLEYS, IN THE CITY OF AUSTIN, FOR A PART OF THE COST OF IMPROVING SAID ALLEYS, AND FIXING A TIME FOR A HEARING OF THE OWNERS OR AGENTS OF SAID OWNERS OF SAID PROPERTY, OR OF ANY PERSONS INTERESTED IN SAID IMPROVEMENTS, AS PROVIDED BY THE CHARTER OF THE CITY OF AUSTIN AND DIRECTING THE CITY MANAGER TO GIVE NOTICE OF SAID HEAR- ING AND EXAMINING AND APPROVING THE ROLL OR STATEMENT OF THE CONSULTING ENGINEER, AND DECLARING AN EMERGENCY. The above ordinance was read the first time and Councilman Pannell moved a suspension of the rule and the placing of the ordinance on its second reading. Motion was seconded by Councilman Reed, and same prevailed by the following vote: Ayeв, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The ordinance was read the second time and Councilman Pannell moved a further suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; naye, none. The ordinance was read the third time and Councilman Pannell moved that same be finally passed. Motion was seconded by Councilman Reed and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. The Mayor laid before the Council the following ordinance: ORDINANCE OF THE CITY OF AUSTIN, TEXAS ORDERING THE IMPROVEMENT OF EAST SECOND STREET AND SUNDRY OTHER STREETS, IN THE CITY OF AUSTIN, AND DEOLARING AN EMER- GENCY. The above ordinance was read the first time and laid over. The Mayor laid before the Council the following resolution: WHEREAS, H. F. Ritter has presented to the City Council a request for a curb set-back adjacent to his property on Cameron Road north of Manor Road; said property being legally described as Outlot 27, Division "0" of the Government Outlots of the City of Austin; and WHEREAS, the City Engineer has recommended that said request be granted subject to the curb's being set back and the pavement on Manor Road extended according to the revised plan 2-H-24; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That H. F. Ritter be granted permission to make curb set-back adjacent to his property on Cameron Road north of Manor Road; said property being legally described as Outlot 27, Division "C" of the Government Outlots of the City of Austin. Said curb set-back and additional pavement on Manor Road to be made in accordance with the revised plan 2-H-24Aattached herewith and which is hereby made a part of this resolution. The above resolution was adopted by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. !
