REGULAR MEETING OF THE CITY COUNCIL: 399 0 Austin, Texas, February 26,1931. The Council was called to order by the Mayor. Roll call showed the following members present: Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steok, 5; absent, none. The regular order of business was suspended for the opening of bids on street paving, in accordance with advertised notice of same, and the following bids were opened and read: L. E. Whitham & Co.; Brown & Root; Southwest Bitulithic Co. The above bids were then referred to H. R. F. Helland, Consulting Engineer, for tabulation and report to the Council. The Minutes of the last meeting were read and Councilman Pannell moved the adoption of same as read. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. • Mrs. L. O. Chilton appeared before the Council and asked for a reduction in the valuation placed on her property in Evergreen Heights and gave reasons why same was overaввеssеd Couno11man Pannell moved that the matter be referred to the Tax Department and C. HORST ADDITION, DIVISION"D"between Twentieth and Twentyfirst Streets, known and designated as Unit or District No. P-103; ALLEY IN BLOCK 67 between San Jacinto and Trinity Streets, known and designated as Unit or District No. P-105; ALLEY IN BLOCK 113 between San Jacinto and Trinity Streets, known and designated as Unit or District No. P-106; the Mayor thereupon stated that all persons desiring to protest against the levying of assessments against abutting property on the above mentioned alleys and within the limits above stated, or who desired to be heard with reference to the improvements 400 proposed to be assessed against said property and the owners thereof, the lion and liability thereof, the special benefits to the property and the owners thereof, or any other matters or things authorized by the provisions of Article XXIV of the Charter of the City of Austin to be urged and considered at this hearing, would now be heard from, and thereupon the following protests were heard: Alley in Block 157 between Lavaca Street and Guadalupe Street: Miss Susie Meyer stated that she was not financially able to pay for the paving at this time; Alley in Outlot 35, Division "D" between Eighteenth and Nineteenth Streets and Lavaca and Guadalupe Streets: J. W. Hawkins and Joe 8. Wooten, by written protest, stated that there was no demand for the paving of this alley, and to do so would be a confiscation of the adjacent property owners' money without due return in revenue or enhancement in value of the property; Alley in Block 20, L. Horst Addition, Division "D" between Nineteenth and Twentieth Streeta: Burt Brydson stated that the paving would not enhance the value of the property; that in his judgment Whitis Avenue instead of the alley should be paved; Alley in Block 21, L. Horet Addition, Division "D" between Twentieth and TwentyFirst Streets: Fred Becker, Agent, J. E. Ponton, R. C. Wilde, Mrs. J.J. Terrell, Burt Brydson, Mrs. A. E. Stelfox, and Horace Barnhart, by written protest submitted by said Horace Bernhart, objected to paving of above alley unless necessary storm sewer were laid to take care of large amount of drain water. No other property owners or interested persons appearing to be heard, the Mayor thereupon laid before the Council the following ordinance: ORDINANCE OF THE CITY OF AUSTIN, TEXAS, CLOSING A HEARING GIVEN TO PROPERTY OWNERS ON ALLEY IN BLOCK NO. 134 AND SUNDRY OTHER ALLEYS IN THE CITY OF AUSTIN, AND DECLARING AN EMERGENCY. WHEREAS, development of business property on West Seventh Street, between Congress Avenue and Colorado Street, has brought about a necessity for renumbering the premises abutting the north and south sides of said West Seventh Street; and WHEREAS, the City Engineer has made a study of the situation and prepared a map showing the recommended scheme of numbering said premises and said map has been reviewed by the City Council; 403 Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the premises abutting the north and south sides of West Seventh Street shall be numbered in accordance with the recommended house numbers shown on the plat hereto attached marked 2-0-384, which plat is hereby made a part of this resolution. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the 01ty Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4inch low pressure gas main in Red River Street beginning at a point 18 feet south of and 15 feet west of the intersection of the north line of East 45th Street and the center line of Red River Street; Thence in a northerly direction 15 feet west of and parallel to the center line of said Red River Street, a distance of approximately three blocks to the north corporate limits of the City of Austin. Said gas main desoribed above shall have a cover of not less than 2t feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. The assessments to be levied in each unit or district shall be made according to the cost of the improvements in that particular unit or district, and in accordance with the benefits acoruing to the property by reason of said improvements in that particular unit or district, wholly and entirely independent of the cost and of the benefits accruing by reason of the improvements in any other unit or district; and, further, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of L. Whitham & Company for the improvement of said streets be and the same is hereby accepted, and that the City Manager and City Clerk are instructed to enter into contract on behalf of the City of Austin with L. E. Whitham & Company for said improvements in conformity with the terms of their said bid; further, 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That there be and is hereby set aside out of the proceeds of bonds issued and sold for that purpose now on hand available for street improvements a sufficient sum to pay and defray all that portion of the cost of said improvements required by the terms of said contract to be paid by the City of Austin. Councilman Pannell moved that contract be awarded to Brown & Root for limestone rock asphalt flush coat treatment of North Congress Avenue from the Capitol to Nineteenth Street, and West Nineteenth Street from Congress Avenue to West Avenue, being approximately 25,000 square yards, at 10 per square yard, amounting to $2500.00, and that the City Manager be authorized to enter into contract with said firm accordingly. Motion was seconded by Councilman Steck, and same prevailed by the following vote: Ayes, Mayor McFadden, Councilmen Mueller, Pannell, Reed, and Steck, 5; nays, none. Councilman Mueller moved that the Council recess, subject to call of the Mayor.
