Gentlemen: The Board of Trustees of the Austin Public Schools passed the following resolution on April 13, 1931, by a unanimous vote: 'BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE AUSTIN PUBLIC SCHOOLS: That we recommend that the corporate limits of the City of Austin be extended for school purposes only so as to embrace the Govalle Common School District No. 18, Travis County, Texas, as set out in the petition presented herewith'. The Mayor laid before the Council the following resolution: WHEREAS, in 1927 an error was made by the Tax Department in transferring to the block books the valuation placed by the Unit System upon the north of Lots 1, 2, 3, and 4, Block 102, Plat 7, Original Oity, assessed in the name of Mrs. Mary M. Bell, placing the full valuation of same at $6240.00 when it should have been $4990.00; and WHEREAS, this error has been corrected upon the books of the Tax Department as to future years, but it is only fair and equitable that the owner of the above property be entitled to a refund of the amount of excess taxes paid, by reason of said error, for the years 1927, 1928, 1929, and 1930, amounting to $71.65; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That, for the reasons above stated, warrant in the amount of $71.65 be issued out of the General Fund of the City of Austin, payable to the said Mrs. Mary M. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of ite gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: i A gas main in Neches Street from the north line of East Third Street to a pointi 24 feet south of the north line of East Fifth Street, the center line of which gas main shall be 33 feet east of and parallel to the center line of said Neches Street. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be recuired to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is cut in the vicinity of a fire plug, water must be used at intervale during the course of back-filling of the ditches. ! 445 0 That the work and laying of said gas maine, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Helland, Consulting Engineer, stating that the paving has been completed on Twenty-ninth Street from the east line 446 Of Salado Street to the east line of Shoal Crest, known as District No. P-96, was read and ordered filed. The Mayor then laid before the Council the following resolutions: RESOLUTION ACCEPTING STREET IMPROVE- MENTS CONSTRUCTED BY SOUTHWEST BIT- ULITHIO COMPANY ON A PORTION OF FIFTEENTH STREET IN THE CITY OF AUSTIN, PROVIDING FOR A PAYMENT OF ANY BALANCE DUE BY THE CITY FOR ITS PORTION OF THE COSTS OF SAID IMPROVEMENTS AND FOR THE DELIVERY OF CERTIFICATES OF ASSESSMENTS AGAINST ABUTTING PROPERTY AND ITS OWNERS. WHEREAS, on the 25th day of November, 1930, the City of Austin entered into a contract with Southwest Bitulithic Company whereby said Company agreed to construct street improvements upon various portions of streets in the City of Austin, Teхав, among which portions of streets was the following, to-wit: FIFTEENTH STREET from the east property line of Congress Avenue to the west property line of Red River Street, known and designated as Unit or District No.P-92. and WHEREAS, said contractor has fully completed the street improvements upon said unit or district of improvements above described in accordance with its contract and the plans and specifications made a part thereof, and said improvements have been found satisfactory and approved by the Consulting Engineer of the Oity, and have been found satisfactory and in accordance with the contract by the City Council of said City; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That the street improvements constructed by Southwest Bitulithic Company upon said portion of Fifteenth Street hereinbefore described be and the same are hereby in all things approved and accepted by the City of Austin. That any balance of the portion of the cost of said improvements agreed to be paid by the City of Austin be forthwith paid to said Contractor, and that the Mayor and City Clerk of eaid City of Austin be and they are hereby directed to execute and deliver to said Southwest Bitulithic Company assignable certificates of assessment against the various parcels of property abutting upon said portion of street and the owners of said property as heretobefore provided by the ordinance levying assessments against said property and the owners thereof. Dear Sir: "Austin, Texas, April 16,1931. Colorado Street from Fourteenth to Nineteenth Streets is under contract for paving at a forty foot width. Surveys of this street indicate that the width between present curbs varies from 36.6 feet to 40 feet. To make this street a uniform width of forty feet would necessitate the removal of approximately five blocks of curbing that is now in place. I would recommend that the street be paved using existing curbe as far as is practical and using the width of street that now exists. Yours very truly, (Sgd) H. R. F. Helland, Consulting Engineer. " Councilman Mueller moved that the above recommendation of the Consulting Engineer be adopted.
