Helland, Consulting Engineer, stating that the paving has been completed on East Third Street from the east line of Neches Street to the west line of Red River Street, District No. P-110, in accordance with the plane and specifications and recommending the acceptance of same, were read and filed. The Mayor then laid before the Council the following resolution: RESOLUTION OF THE CITY OF AUSTIN, TEXAS, ACCEPTING THE IMPROVEMENT OF EAST THIRD STREET, IN THE CITY OF AUSTIN, AND AU- THORIZING THE PAYMENT OF THE BALANCE DUE BY THE CITY OF AUSTIN AND THE ISSUANCE AND DELIVERY OF CERTIFICATES OF SPECIAL ASSESSMENT AGAINST OWNERS OF ABUTTING PROPERTY. Driscoll for permit to erect a rock retaining wall at 419 Park Place; also the following report of the City Engineer upon same: "Austin, Texas, June 24, 1931. Mr. Adam R. Johnson, City Manager, Dear Sir: Austin, Texas. Mr. W. A. Driscoll has requested the City Council to grant him a permit to build a rock retaining wall on his property at 419 Park Place. Although Mr. Driscoll1'8 request indicates that the wall will be put upon his place, he desires to have same adjacent to the curb line on City property. Park Place is the only street between 23rd and 32nd Street which runs east and west between Duval and Red River Streets. If the University should elect to close 23rd Street between Red River and Speedway or the new proposed Waller Creek Boulevard, then we would be without a street running east and west from 19th to 32nd. Therefore, this Park Place is destined to become a very heavy traffic street in the near future. Residents on Park Place are already complaining about the heavy use of the street. Ultimately the City will need to have the entire sidewalk area out down to a standard level above the curb line so as to provide a place for pedestrians to walk. If we were to grant the requested type of construction, it would mean that there could not be any sidewalk use on the south side of Park Place, and it would be dangerous for pedestrians to have to use the space between curbs ordinarily used by vehicles. No similar type of development exists on Park Place as proposed by Mr. Driscoll, and up to the present date no walke have been provided on the terrace portion of the south side of Park Place. On account of the anticipated future need for sidewalk area on the south side of Park Place, I recommend that the request for the special type of wall to be placed upon curb line be refused. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in NAVASOTA STREET from East Eighth Street to East Ninth Street, the center line of which gas main shall be 11 feet east of and parallel to the center line of said Navasota Street. Said gas main described above shall have a cover of not less than 22 feet. (2) A gas main in EAST EIGHTH STREET beginning at a point 11 feet east of and 14 feet south of the intersection of the center line of Navasota Street and the north line produced of said Eighth Street; Thence in a westerly direction 14 feet south of and parallel to the north line of said East Eighth Street a distance of approximately 100 feet to tie in the dead end of an existing gas main. Said gas main described above shall have a cover of not less than 22 feet. (3) A gas main in EAVES AVENUE from Navasota Street westerly approximately 250 feet, the center line of which gas main shall be 25 feet north of and parallel to the south line of said. Eaves Avenue. Said gas main described above shall have a cover of not less than 22 feet. (4) A gas main in EAST AVENUE from River Street to Cumminge Street the center line of which gas main shall be 24 feet east of and parallel to the west line of paid Fast Avenue. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special pointe. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that wherever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of back filling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. i The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, it is necessary to construct a shed over the cattle pens at the Oity Abattoir for the protection of the animals being held for slaughter; and 551 WHEREAS, competitive bids have been received for the construction of such shed; and WHEREAS, Brydson Brothers, Contractors, are low bidders for the work; and WHEREAS, the contractor is prepared to execute the contract and begin the work at once; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That $793.00 be and the same is hereby appropriated out of the General Fund of the City of Austin, Texas, for the construction of the shed in accordance with the bid of Brydson Brothers, Contractors. The Mayor laid before the Council the following: "Austin, Texas, June 24, 1931. Mr. Adam R. Johnson, City Manager, Dear Sir: Austin, Texas. I have considered the request of John D. Miller for a permit to construct a commercial driveway on the west side of Lavaca Street a short distance south of Joe Webb's service station. This property is shown on the Zoning Use Map to be located within the "O" Commercial Use District. The only unusual feature about the request is the fact that the granting of this request will decrease the amount available parking space opposite the United States Post Office. However, I do not believe that this justified the refusal of the request and I, therefore, recommend that the request be granted. Assuming that the City Council will favorably consider same, I have prepared a resolution which will grant his request if adopted by the City Council. Respectfully submitted, (Sgd) Orin E. Miller, lessee of property situated at the northwest corner of 6th and Lavaca Streets, has requested that they be granted a permit to construct a commercial driveway across the sidewalk area on the west side of Lavaca Street about 70 feet north of the north line of West 6th Street; and WHEREAS, John D. Miller has presented a plan showing the proposed location of the commercial driveway; and WHEREAS, the City Manager and City Engineer have recommended the granting of said request in accordance with the accompanying plan marked 2-H-172; and WHEREAS, the City Council of the City of Austin has considered the foregoing request and recommendations; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permission be granted subject to the following conditions and the present and future rules and regulations and ordinances of the City of Austin, Texas, apply552 ing to or regulating commercial driveways, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained 1f, after hearing, it is found by the City Council that said John D. Council authorized City Manager to ratify transfer of Cemetery Lot No. 1050 Oakwood Cemetery from H. A. Thomson to Samuel James Redd. Petitions of property owners asking for the paving of Twelfth Street and San Benard Street from Rosewood Avenue to Twelfth Street were read and referred to the City Manager and Consulting Engineer. , A communication from a committee of colored citizens asking that they be donated the water and light to be used at the Samuel Houston Stadium during the convention of the National Benevolent Association to be held at said place, was read. Councilman Steck moved that the request be granted. Kuehne, Chairman, presented to the Council the following report of the City Plan Commission: #TO THE HONORABLE MAYOR AND CITY COUNCIL, Austin, Teхав. Gentlemen: I hereby beg to submit a belated report of the activities of the Oity Plan Commission since the adoption of the City Plan for the City of Austin. The preparation of the City Plan Report of Koock & Fowler of Dallas, Texas, was the major task of the Commission after its appointment. But its activities did not cease with the completion and submission of this Report. The Commission has considered and acted upon a number of city planning matters which have arisen since the adoption of the City Plan. It has in several cases made recommendations to the City Council and to others interested in these particular problems, such as the University of Texas, State Highway Commission, Chamber of Commerce, etc. are:- Among the special problems upon which the Commission has taken some action 1. A recommendation that South Congress Avenue be made ninety feet wide between curbe from the river bridge to the City Limits. 2. A recommendation that South Congress Avenue be projected in a straight line through La Prelle Place to eliminate the sharp turns of the State Highway into the city, which plan has been preferred by the State Highway Commission. 3. Conferences with the Chairman of the University Board of Regents and other officials recommending and urging the early completion of the Waller Creek Boulevard through the University Campus to relieve traffic congestion of Speedway and to afford an outlet into town for the northeast section of the city. The consummation of this project is now assured. 4. Conferences with property owners with the view of extending the Shoal Creek Boulevard north to intersect the State Highway at the School for the Blind, thus providing a direct thoroughfare into the city. Donation of the right-of-way has been assured and other details will be completed in the near future, and a definite propовal will be presented to the Council for its acceptance or rejection. 5. You are aware of the fact that the Statute provides that all sub-divis ion plats in the City of Austin and within five miles of its limite must be approved by the City Plan Commission before they can be filed for record with the County 01erk. ! 557 This phase of the work of the Commission has required a great deal of time and study, as is evidenced by the attached list of plats that have been approved by the Commission. In many cases several meetings and conferences have been held with owners in the consideration of a single plat. This work of the Commission has relieved the Council of a large amount of work and time, which may not perhaps have been fully realized. Since January, 1927, the Commission has considered and approved forty-three sub-division plats scattered over all parts of the city and beyond its limits. A list of the same is attached hereto as Exhibit "A". In the approval of these plats many city planning principles and factors have been applied, with a view to insure a more orderly development of the city, to insure a better street and traffic plan, to avoid the many mistakes of the former hap-hazard laying out of subdivisions, the rectification of which in later years entails a large and unnecessary expense, to prevent dead end streets and dangerous and unnecessary off-sets in streets and thoroughfares, to insure a more economical platting of lots and blocks for the enhancement of values and benefit of the owner. Future plats will be reviewed with special reference to the public utilities, traffic plan, zoning regulations, parks, boulevarde and recreation facilities, and the general welfare and health of the community as well as the private interests of the owner. Under the zoning ordinance new duties and responsibilities are placed upon the Commission by virtue of the submission to it of all proposed amendments and changes in the soning ordinance in accordance with Section 30 thereof. The commission desires to make the following recommendation to the City Council. It is respectfully recommended that when the present terms of the members of the Commission expire that a new commission be appointed of a minimum number for working efficiency and that the terms of the members be made to overlap, similar to those of the Board of Adjustment, for the purpose of maintaining a continuity of policies and activity and consistent continuation of the work of the Commission. It is hoped that the labors and effort of the City Plan Commission have been satisfactory to the City Council, and its sincere appreciation of the honor and privilege of serving the Council and Public is hereby expressed. Mayor McFadden moved that the City Manager be directed to employ such full-time secretary to the Board of Adjustment, whose services would also be available to the Building Inspector's office when needed.
