The Mayor advised Mr. Meyer that owing to the expensive excavation necessary to make this extension it was found impracticable to do so at this time. E. W. Harvey appeared before the Council and asked that he be granted a space for loading and unloading adjacent to his place of business at 8th and Colorado Streets. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative | maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in GROOMS STREET from Moore Boulevard north to East Thirty-second Street, the center line of whien gas main shall be 20 feet west of and parallel to the east line of said Grooms Street. Said gas main described above shall have a cover of not less than 22 feet. (2) A gas main in GROOMS STREET from East Thirty-second Street to East Thirtythird Street, the center line of which gas main shall be 19 feet east of and purallel to the west line of said Grooms Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in WEST THIRTY-THIRD STREET from Wabash Avenue west to Pratt Avenue, the center line of which gas main shall be 15 feet north of and parallel to the south line of said West Thirty-third Street. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite infor mation upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back filling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The Mayor laid before the Council the following resolution: WHEREAS, M. H. Orockett is the owner of a certain tract or parcel of land in the Isaac Decker Survey, City of Austin, Travis County, Texas, which tract lies east of and adjacent to the east line of South Congress Avenue and north of Riverside Drive and which tract fronts said South Congress Avenue beginning at a point approximately 89.7 feet N. 19°E. of the intersection of the east line of said South Congress Avenue and the north line of Riverside Drive and extending N. 190 E. approximately 480 feet; and WHEREAS, the distance between the east curb line and the east property line of said South Congress Avenue is 15 feet, and he has presented a petition to the City Counoil requesting a permit to set his curb back to a point which is 6 feet west of the east property line of South Congress Avenue for a distance of 138 feet along the south portion of the said M. H. Crockett's frontage, and said M. H. Crockett agrees to build at his expense a 34 foot valley gutter in front of said setback and to construct vertical concrete curbs of not less than 6 inches exposure adjacent to the sidewalk area; and WHEREAS, a plan has been prepared showing the proposed layout and said plan and petition has been considered and approved by the City Council of the City of Austin; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permission be granted to M. H. Crockett, owner of a certain tract or parcel of land in the Isaac Decker Survey, City of Austin, Travis County, Texas, which tract lies east of and adjacent to the east line of South Congress Avenue and north of River596 side Drive and which tract fronts South Congress Avenue beginning at a point approximately 89.7 feet N. 19º E. of the intersection of the east line of said South Congress Avenue and the north line of Riverside Drive and extends N. 19° E. approximately 480 feet, to reconstruct his curb and sidewalk area adjacent to the South 138 feet of his property. O. Rambo and Thos. E. Brown, in accordance with plans and specifications, and recommending the acceptance of same, were read and filed. The Mayor then laid before the Council the following resolution: RESOLUTION OF THE CITY OF AUSTIN, TEXAS, ACCEPTING THE IMPROVEMENT OF A PORTION OF EAST SEVENTH STREET, IN THE CITY OF AUSTIN, AND AUTHORIZING THE PAYMENT OF THE BALANCE DUE BY THE CITY OF AUSTIN AND THE ISSUANCE AND DELIVERY OF CERTIFICATES OF SPECIAL ASSESSMENT AGAINST OWNERS OF ABUTTING PROPERTY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That, Whereas, heretofore the hereinafter described street was ordered improved, contract for said work of improvement duly entered into, and assessment levied against abutting property and the owners thereof to cover the portion of the cost payable by the said property owners; and WHEREAS, pursuant to said contract and other proceedings in connection therewith, L. E. Whitham & Company has completed the improvement of the following street, to-wit: PAVING DISTRICT NO. P-149: EAST SEVENTH STREET from the east line of Comal Street to the east line of Chicon Street; WHEREAS, said improvement is in strict compliance with the terms of said contract, specifications adopted for said improvement, and other proceedings in connection therewith; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said improvement on said portion of said street be and the same is hereby accepted as in full compliance with the terms of said contract, specifications and proceedings and the final estimate due from the City of Austin to L. E. Whitham & Company be and the same is hereby ordered paid. That the Mayor and City Clerk be and are hereby authorized and instructed to issue, execute and deliver to L. E. Whitham & Company certificates of special assessment against the abutting property and the owners thereof, evidencing the several sums of money assessed against said property and the owners thereof respectively for their pro rata of the cost of said improvement, in accordance with the terms of said contract and proceedings. The Mayor laid before the Council the following ordinance: AN ORDINANCE REGULATING TRAFFIO ON CERTAIN STREETS AT CERTAIN INTERSECTIONS IN THE CITY OF AUSTIN, PROVIDING FOR STOP SIGNS AT SUCH POINTS, AND PRESCRIBING A PENALTY FOR THE VIOLATION OF THE ORDINANCE. The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading. Helland, Consulting Engineer, stating that the paving has been completed on South Congress Avenue from Station 14 plus 83, beginning at monument at First Streat and Congress Avenue to Station 19 plus 35, known and designated as Unite or Districte Nos. P-175 and P-138, and on Colorado Street from the south line of West Fourteenth Street to the south. line of West Nineteenth Street, known and designated as Unit or District No. P-124, were read and filed. The Mayor then laid before the Council the following resolution: RESOLUTION ACCEPTING STREET IMPROVEMENTS CONSTRUCTED BY SOUTHWEST BITULITHIC COMPANY ON A PORTION OF COLORADO STREET IN THE CITY OF AUSTIN, PROVIDING FOR PAYMENT OF ANY BALANCE DUE BY THE CITY FOR ITS FORTION OF THE COST OF SAID IMPROVELIENTS AND FOR THE DELIVERY OF CERTIFICATES OF ASSESSMENTS AGAINST ABUTTING PROPERTY AND ITS OWNERS. WHEREAS, on the 24th day of March, 1931, the City of Austin entered into a contract with Southwest Bitulithic Company whereby said company agreed to construct street improvements upon various portions of streets in the City of Austin, Texas, among which portions of streets was the following, to-wit: 598 COLORADO STREET from the south property line of Fourteenth Street to the south property line of Nineteenth Street, known and designated as Unit or District No. P-124; and WHEREAS, said contractor has fully completed the street improvements upon said unit or district of improvement above described in accordance with its contract and the plans and specifications made a part thereof and said improvements have been found satisfactory and approved by the Consulting Engineer of the City, and have been found satisfactory and in accordance with the contract by the City Council of said City; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That the street improvements constructed by Southwest Bitulithic Company upon said portion of Colorado Street hereinbefore described be and the same are hereby in all things approved and accepted by the City of Austin. II. WHEREAS, the City Council of the City of Austin has heretofore ordered that the hereinbelow mentioned portions of highways be improved by raising, grading, filling, and installing concrete curbs and gutters, and by paving with two inch Warrenite Bitulithic Wearing Surface on a five inch concrete base, with necessary appurtenances, and contract therefor has been made and entered into with Southwest Bitulithic Company; and WHEREAS, the City Council has caused the City Consulting Engineer to prepare and file estimates of the cost of such improvements, and estimate of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined; Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That suon estimates be and they are adopted and approved. II. That a hearing be given and held by and before the City Council of the City of Austin, Texas, to all owning or claiming any property abutting upon any of said portions of streets and highways, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the 13th day of August, 1931, at 10:00 o'clock A. M., in the regular Council meeting room in the City Hall in the City of Austin, Texas, and the City Manager is hereby directed to give notice of the time and place of such hearing, and of other matters and facts, in accordance with the terms and provisions of Article XXIV of the Charter of the City of Austin, which Article was added by amendment adopted at an election held on November 24, 1928. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Austin, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Article XXIV. The Mayor laid before the Council the following ordinance: ORDINANCE DEOLARING THE NECESSITY FOR AND ORDERING AND PROVIDING FOR THE IMPROVEMENT OF PORTIONS OF THIRTIETH STREET AND FORTIONS OF SUNDRY OTHER STREETS AND HIGHWAYS IN THE CITY OF AUSTIN, TEXAS, LETTING CONTRACT THEREFOR, APPROVING FORM OF CONTRACT AND BOND, AND PROVIDING FOR THE PAYMENT OF COST THEREOF. The above ordinance was read the first time and laid over. The Mayor laid before the Council the following ordinance: ORDINANCE DECLARING THE NECESSITY FOR AND ORDERING AND PROVIDING FOR THE IMPROVEMENT OF A PORTION OF EAST SIXTEENTH STREET IN THE CITY OF AUSTIN, TEXAS, LETTING CONTRACT THEREFOR, APPROVING FORM OF CONTRACT AND BOND, AND PROVIDING FOR THE PAYMENT OF THE COST THEREOF. The above ordinance was read the first time and laid over. M. H. Crockett appeared before the Council and asked that Thirtieth Street from Duval Street to Speedway be paved. The matter was referred to the Consulting Engineer for his recommendation. The Mayor laid before the Council the following ordinance: AN ORDINANCE REGULATING TRAFFIC ON WEST NINTH STREET, BETWEEN ITS INTERSECTION WITH CONGRESS AVENUE AND ITS INTERSECTION WITH LAVACA STREET, IN THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ORDINANCES IN CONFLICT AND PRESCRIBING PENALTIES. ,
