143 No further business coming before the Council, Councilman Steck moved that the Council recess, subject to call of the Mayor. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Steck, 4; nays, none; Councilman Mueller absent, 1. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Approved. W.M Fadden Mayor. Austin.Texas. December 14. 1931. The Council met at 7:30 F. M. for the purpose of considering the various tax appeals of property owners submitted to the Council at its meeting on the 9th ultimo. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; absent, none. Mayor MoFadden moved that E. M. Soarbrough & Sons be given a credit of $34,815.00 on their assessment for the year 1931 against the old store building located on the west 16 feet of Lot 3, all of Lot 4, and the south 40 feet of Lot 5, Block 55, Original City, which has been torn down, but that no change be made in the assessed valuation on other improvements belonging to the said E. M. Soarbrough & Sons, and that the Assessor and Collector of Taxes be instructed to change his rolls accordingly. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, the Tax Rolls of the City of Austin show that there is a valuation for the years 1929 and 1930 of $73,140.00 on 146.89 acres belonging to Enfield Realty Company, Westenfield Development Company, Pease Estate, R. Niles Graham, Margaret Graham Cruseman and Sunset Hill-Enfield Company; and WHEREAS, the Oity Tax Department of the City of Austin recommends that the valuation on said 146.39 acres be changed from $73,140.00 to $45,005.00 for the years 1929 and 1930; and WHEREAS, the taxes on said property for the year 1929 were paid on a valuation of $73,140.00 under protest, and the taxes for 1930 remain unpaid pending a settlement of said protest; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Tax Assessor and Collector of the City of Austin is hereby authorized and instructed to change his Tax Rolls on the valuation of said property from $73,140.00 to $45,005.00 for the years 1929 and 1930; and that a refund of $633.03, representing the 144 difference in taxes paid on said acreage for the year 1929, be issued at such time as the unpaid taxes for the year 1930 are paid; and the penalty to be remitted, provided that said taxes for the year 1930 shall be paid on or before April 1, 1932. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. The following signed statement of W. M. Graham is attached to the above resolution and made a part thereof: "I, W. M. Graham, Agent for Enfield Realty Company, Westenfield Development Company, Pease Estate, R. Niles Graham, Margaret Graham Orusemann and Sunset Hill-Enfield Company, hereby agree to the provisions as set forth in the above resolution. (Sgd) W. M. Graham, Agent. N Mayor McFadden moved that the assessed valuation on Lot 14, Blook 1, Outlot 1, Division "2", Duval Subdivision, Plat 102, for the year 1931, in the name of T. X.Dailey be re- duced from $1300.00 to $975.00; that the assessed valuation on the improvements located thereon be reduced from $1390.00 to $615.00; and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor MoFadden moved that the assessed valuation on Lot 15, Block 1, Outlot 1, Divis1on "Z", Duval Subdivision, Plat 102, for the year 1931, in the name of Alma Reese, be re- duced from $1110.00 to $830.00, and that the Oity Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor McFadden moved that the assessed valuation on Lot 16, Block 1, Outlot 1, Division "Z", Duval Subdivision, Plat 102, for the year 1931, in the name of I. Marks, be redus- ed from $555.00 to $415.00, and that the Assessor and Collector of Taxes of the City be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor MoFadden moved that the assessed valuation on Lot 17, Outlot 1, Division "Z", Woodland Subdivision, Plat 102, for the year 1931, in the name of W. T. McElroy, be reduced from $1380.00 to $1240.00, and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor McFadden moved that the assessed valuation on Lot 18, Outlot 1, Division "2", Woodland Subdivision, Plat 102, for the year 1931, in the name of Thomas C. Jensen, be reduced from $1095.00 to $980.00; and that the Assessor and Collector of Taxes of the City be instructed to change his rolls accordingly. Motion was seconded by Councilman Alford, and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Mofadden, Councilmen Mueller and Steck, 5; naye, none. Mayor Mofadden moved that the assessed valuation on Lot 19, less 5 feet, Outlot 1, Division "Z", Woodland Addition, Plat 102, for the year 1931, in the name of Brydson Bros., be reduced from $1165.00 to $815.00, and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. 145 : Mayor MoFadden moved that no change be made in the assessment against the improvements on Lot 9, Colorado Park Addition, Plat 135, for the year 1931, in the name of H. J. Brown, for the reason that same is equalised with other property in the City of like construction. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Moradden, Councilmen Mueller and Steck, 5; nays, none. Mayor McFadden moved that the assessed valuation on the improvements on 50x85 feet of Lot 10, Block 26, Division "E", Plat 1, for the year 1931, in the name of T. W.Folte Estate, be reduced from $7720.00 to $6325.00, and that the Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; naye, none. Jounoilman Steck moved that the assessed valuation on the improvements on a part of Lot"G", Block 6, Outlots 72 and 73, Division "E", Plat 13, for the year 1931, in the name of M. and B. Silberstein, be reduced from $3695.00 to $3285.00; that the assessed valuation on the merchandise belonging to the said M. and S. Silberstein for said year be reduced from $1500.00 to $1185.00; and that the Assessor and Collector of the City be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steok, 5; nays, none. Councilman Steck moved that the Unit figure on the improvements on part of Lot 35, Outlot 36, Division "D", Plat 49, for the year 1931, in the name of Cater Joseph, be changed from $2.50 to $2.00, thus reducing the valuation on said improvements from $6090.00 to $4600.00, and an allowance of 15% for old material in said improvements be made; and that the Assessor and Collector of the Oity be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor MoFadden moved that the assessed valuation of the new improvements on Lots 10 and 11, Block 2, Outlot 43, Division "O", Plat 21, for the year 1931, in the name of William Kutalek, be reduced from $1325.00 to $1265.00, and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Councilman Mueller moved that the assessed valuation on the improvements on the east 63 feet of Lot 2, Block 178, Original City, Plat 1, for the year 1931, in the name of J. J. Lane Estate, be reduced from $1165.00 to $660.00, and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gill18, Mayor NoFadden, Counoilmen Mueller and Steok, 5; nays, none. Councilman Steck moved that no change be made in the assessed valuation on the improvements on Lot 67, Block 7, Aldridge Place, Plat 64, for the year 1931, in the name of Mrs. W. R. Neal, it having been shown that said improvements are not overassessed as equalization is concerned. Motion was seconded by Mayor McFadden, and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. 146 Councilman Gillis moved that the assessed valuation on the stock of merchandise owned by Chas. Rosner at 508 Congress Avenue, as shown by his inventory of January 1, 1931, be reduced from $16,665.00 to $13,305.00 for said year, and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Mayor Mofadden and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor MoFadden moved that due to a clerical error having been made in figuring the inventory of Heidenheimer & Company on January 1, 1931, the assessed valuation of same be reduced from $59,755.00 to $53,085.00 for said year, and that the City Assessor and Collector of Taxes be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis, and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. Mayor MoFadden moved that the changes made by the Board of Equalization in raising the inventories of the six stores and warehouse belonging to the Router Company on the 1st day of January, 1931, be set back in accordance with the sworn statement of Ed Westling, Manager of said Router Company, as follows: Store No. 1 - 117 West Sixth Street - changed from $2000.00 to $1675.00; Store No. 2 - 2308 Guadalupe Street Store No. 3-523 East Sixth Street Store No. 4 - 923 Congress Avenue changed from $1200.00 to $800.00;- - changed from $1400.00 to $1100.00; changed from $1800.00 to $1400.00; Store No. 5 - 1500 Bouth Congress Avenue changed from $1250.00 to $1000.00; Store No. 6-1108 East Ist Street - changed from $1500.00 to $1200.00; Warehouse - changed from $7500.00 to $5900.00; and that the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; naye, none. Mayor McFadden moved that no change be made in the assessed valuation for the year 1931 on the North One-half of Lots 1, 2, 3, and 4, Blook 102, Original City, Plat 7, in the name of Mary K. Bell, as said property is equalized with adjoining property and not overassessed so far as equalization is concerned. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Councilman Gillis moved that no change be made in the assessed valuation of Lote"A" and "B", Outlot 72, Robbins Subdivision, Plat 63, for the year 1931, in the name of Julia Pye, it having been shown that said property is not overassessed so far as equalization is concerned. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steok, 5;nays, none. Councilman Steck moved that the assessed valuation of Lote 17, 18, 19, and 20, Block 31, Hyde Park No. 1, Plat 79; Lots 29, 30, 31, and 32, Block 21, Hyde Park No. 1, Plat 79; Lot 5, Block 16, Plat 84, Hyde Park No. 1; and Lots 8 and 9, Block 16, Hyde Park No. 2, Plat 78, for the year 1931, in the name of the MK&T Land Company, be set back to the same valuations of 1930, and the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. 147 Mayor McFadden moved that the assessed valuation of the improvements on Lot 5, Blook 72, Division "D", Bevills Subdivision, Plat 63, for the year 1931, in the name of Geo. H.Harrington be reduced from $970.00 to $200.00, and the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Alford, and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. Councilman Gillis moved that the assessed valuation of the improvements on Lote 4, 5, and 6, Block 122, Plat 5, Original Oity, for the year 1931, in the name of the Austin Labor Temple, be reduced from $9470.00 to $7710.00, and the City Tax Assessor and Collector be instructed to change his rolls accordingly. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steok, 5; nays, none. Mayor MoFadden moved that the assessed valuation of the improvements on 70x138 feet of Lots 3 and 4, Block 74, Plat 7, Original City, located at 500 West Sixth Street, known as the Stratford-Robertson Apartments, for the year 1931, in the name of J. B. Robertson, Margaret Robertson, Mrs. Zeno 0. Ross, and Warren T. Robertson, be reduced from $19,800.00 to $17,470.00; that the assessed valuation of the land comprising the old Robertson home place, located at Sixth and West Lynn Streets, for the year 1931, in the name of the said J. B. Robertson, Margaret Robertson, Mrs. Zeno C. Ross, and Warren T. Robertson, be reduood from $15,570.00 to $15,040.00, but that no change be made in the assessed valuation of any other property in the City of Austin owned by said parties for the year 1931; and that the Assosser and Collector of Taxes of the City be instructed to change his rolls accordingly.
