170 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, January 21, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Mofadden, Councilmen Mueller and Steck, 5; absent, none. The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Mofadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council the following: "Austin, Texas, January 20, 1932. Mr.Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: We have considered the request of W. T. Caswell, owner of the property situated at the southwest corner of Thirtieth and Guadalupe Streets and being commonly known as 2932-2936 Guadalupe Street, and also the request of W.F.Leeka and J. R. Thompson for a permit to construct commercial driveways across Guadalupe and Thirtieth Streets so as to op- erate a drive-in eating establishment. We find that the proposed improvements are adjacent to property which is being designated on the Zoning map as being within the "C" Commercial Use District. We recommend that this permit be granted subject to the following conditions: That the driveways be constructed of concrete at the expense of the applicant in accordance with plan 2-H-198 as shown by the cross-hatched portion of same. " BE IT RESOLVED BY THE CITY COUNCIL OF THE OTTY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the property situated at the southwest corner of Thirtieth and Guadalupe Streets for drive-in eating establishment site, and hereby authorizes W. T. Caswell, owner, and Leeka and Thompson, lessees, to construct two concrete driveways, one across Guadalupe Street and one across Thirtieth Street, all in accordance with the attached recommendations of the City Engineer and the City Building Inspector and in accordance with plan 2-H-198; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of same after full compliance with all of the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that W. T. Caswell, owner, and Leeka and Thompson, lessees, have failed and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. 171 The Mayor laid before the Council the following : "Austin, Texas, January 20,1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: We have considered the application of J. P. Schneider and Ralph Sohneider for permit to install a gasoline pump in the the rear of the J. B. Schneider grocery store located at West Second Street and Guadalupe Street on premises being legally described as Lot 5 in Block 2 in the Original City of Austin, said pump and gasoline to be for private use only, and find that the following condition existes That Lot 5, Block 2 is located within the "D" Industrial Use District as set forth on the Zoning map of the City of Austin. We recommend that said permit be granted for private use only subject to the following conditions: (1) That all equipment shall be placed not closer, than 10 feet to any City street or alley 1line. (2) That all equipment shall be placed in accord with all provisions set forth in the Filling Station Ordinance. (Sgd) G. S. Moore, Building Inspector. Orin E. Metcalfe, City Engineer. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: M THAT the City Council of the City of Austin hereby approves the installation of a gasoline pump for private use only on property located at West Second Street and Guadalupe Street and legally described as Lot 5 in Block 2 in the Original Oity of Austin, and hereby authorize J. P. Sohneider and Ralph Schneider to have such installation made, which installation shall be made in accord with the provisions set forth in the Filling Station Ordinance of the City of Austin; and no gasolin shall be sold at this location or from the pump installed upon this property, and further subject to all of the provisions in the attached recommendations, and the Building Inspector is hereby authorized to issue the proper permit for the operation of this gasoline pump after full compliance with all of the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that J. The Mayor laid before the Council the following ordinance: AN ORDINANCE AMENDING, IN THE CERTAIN PARTICULARS HEREINAFTER STATED, AN ORDINANCE ENTITLED: "AN ORDINANCE ESTAB- LISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN; AND REGULATING AND DISTRICTING THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN SPACES, THE DENSITY OF POPULATION, THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE INDUSTRY, RESIDENCES AND OTHER PURPOSES; AND DIVIDING THE CITY OF AUSTIN INTO DISTRICTS OR ZONES, AND REGULATING AND DISTRICTING THE ERECTION, CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR AND USE OF BUILDINGS, STRUCTURES OR LAND WITHIN SUCH DISTRICTS OR ZONES; AND PROVIDING UNIFORM REGULATIONS FOR THE SEVERAL CLASSES AND KINDS OF BUILDINGS OR STRUCTURES AND USES WITHIN THE DISTRICTS OR ZONES; AND ADOPTING TWO ZONING MAPS, DISCLOSING RESPECTIVELY THE SEVERAL USE DISTRICTS AND THE SEVERAL HEIGHT AND AREA DISTRICTS, AND THE RESTRICTIONS AND LIMITATIONS AND PROVISIONS APPLICABLE TO SUCH DISTRICTS: AND PROVIDING FOR A BOARD OF 172 ADJUSTMENT AND DEFINING THE POWERS OF SAME; AND PROVIDING CERTAIN PENALTIES AND REMEDIES; AND DEOLARING AN EMERGENCY." The ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilman Mueller moved that same be finally passed. Mayor MoFadden nominated H. F. Kuehne and J.T.Ward for reappointment on the Board of Adjustment for a term of two years, beginning January 1, 1932. Nomination was confirmed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor HoFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council a resolution adopting the General Budget of the City of Austin for the year 1932, which was read and laid over for one week. The first annual report of the Board of Adjustment, covering the months from May 21, 1931, to December 31, 1931, was submitted to the Council. Councilman Gillis moved that said report be received and filed and a vote of thanks be given said Board for the very valuable and immense amount of work accomplished by it during said time. No further business coming before the Council, Councilman Steck moved to recess, subject to call of the Mayor. The application of Gulf Refining Company for permit to erect a gasoline filling station at the northeast corner of Nineteenth and Rio Grande Streets came before the Council. Councilman Mueller moved that the permit be granted, subject to plans and specifications for said station being submitted to and approved by the Building Inspector and the City Engineer. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilman Alford, Mayor MoFadden, Councilmen Mueller and Steck, 4; nays, none; Councilman Gillis absent, 1. Councilman Gillis, by written communication to the Mayor, stated that he was unable to attend the meeting, but was in favor of granting a permit to the Gulf Refining Company to erect a gasoline filling station at northeast corner of Nineteenth and Rio Grande Streets.
