234 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted Mr. Theo. P. Meyer to construct commercial driveways across the sidewalk ourb and gutter area on the east side of Guadalupe Street, provided that all of said driveways, ramps, curbs and sidewalks are constructed of concrete under the direction of the City Engineer and in accordance with the attached recommendations and in accordance with plan 2-H-204, which recommendations and plan are hereby adopted and made a part of this resolution. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council the following ordinance: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE CREATING AND ESTABLISHING FIRE ZONES IN THE CITY OF AUSTIN, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY" BY CHANGING THE WEST HALF OF BLOCKS 122, 112, 96, AND 85 AND THE SOUTHEAST QUARTER OF BLOCK 85, OF THE ORIGINAL CITY OF AUSTIN, FROM FIRE ZONE NUMBER TWO (2) TO FIRE ZONE NUMBER ONE (1). The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the Oity Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in EAST THIRTY-FIRST STREET from Red River Street westerly approximately two blocks to Waller Creek, the centerline of which gas main shall be 18 fest north of and parallel to the south line of said East Thirty-First Street. Said gas main described above shall have a cover of not less than 3 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that wherever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. That the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said maine have been laid, shall be under the supervision and direction of the Oity Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The above ordinance was read the first time and laid over. 236 The Mayor laid before the Council the following: "Austin, Texas, March 3,1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir The request of Mrs. J. M. Crawford, owner of property in the 1400 blook on South Congress Avenue, has requested the City Council to grant her permission to construct a sidewalk on a grade which is not in accordance with any engineering standard. Mrs. Crawford owns both business and residence property on the west side of Congress Avenue immediately north of Elizabeth Street, both pieces of property already have buildings in place. The sidewalk area of the business building adjacent to the corner has been constructed of concrete for about fifteen years. The north end of this walk adjacent to her residence property is about 3 feet above the gutter line. A standard grade for business property would place the sidewalk only 15 to 18 inches above the gutter line. Inasmuch as no changed use or ownership of the property is anticipated at this time, I rесommend that the special grade as requested by Mrs. Orawford be granted by the City Council. Assuming that this grant will be allowed, I have prepared a resolution which, if adopted, will permit same. Respectfully submitted, (8gd) Orin E. Metolafe, City Engineer. WHEREAS, Urs. J. M. Crawford, owner of property on the west side of Congress Avenue in the 1400 blook, being known as Lots 7, 6, and part of 5, in Block 14, of the Swisher Addition, has requested the City Council to grant her a special sidewalk grade in front of her residence so as to permit a connection with existing improvements; and WHEREAS, Mrs. J. M. Crawford, as owner of the property, has agreed to assume all cost of reconstructing a sidewalk at a regular grade whenever same becomes necessary in the future; and WHEREAS, the City Council of the City of Austin has favorably considered said request therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Mrs. J. M. Orawford, owner of Lots 7, 6, and a portion of Lot 5, in Block 14 of Swisher Addition to the City of Austin, Texas, is hereby granted a permit to construct a sidewalk adjacent to a portion of her property on a special grade subject to the following conditions: (1) That Mrs. J. M. Orawford, as owner of said property, by the acceptance of this special permit agrees to pay all cost of reconstructing a sidewalk in front of her property whenever same is required to be constructed upon a standard grade. (2) That by the acceptance of this grade that she hereby binds her heirs, assigns or guarantees to construct the sidewalk at their expense without cost to the City of Austin for any such future reconstruction of the sidewalk. (3) That all of sidewalk constructed upon this special grade shall be in accordance with the standard city specifications and shall be under the direction of the City Engineer. (4) That this resolution shall be certified to and filed for record in the office of the County Clerk of Travis County.
