246 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, March 24, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; absent, Councilman Steck, 1. The Minutes of the last meeting were read and Councilman Alford moved the adoption of same. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillie, Mayor Mofadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. Oity Manager Johnson submitted to the Council the following sealed bids on a 750 gallon pumper for the North Austin Fire Station, which were opened and read: Benson Motor Company, Austin, Texas; Ahrens-Fox Fire Engineering Company, Cincinnati, Ohio; Mack International Truck Company, Dallas, Texas; American LaFrance and Foamite Industries, Inc., Elmira, N. Y.; The Seagrave Corporation, Columbus, Ohio. The above bids were referred to Councilman Mueller, the City Manager, the Fire Chief, and the Purchasing Agent for a tabulation and report to the Council, and Councilman Mueller was then excused from the Council Chamber. J. A. Biggers and other signers on the petition heretofore presented to the Council, asking that the territory just north and west of the State School for the Blind be taken into the city limits for school purposes only, appeared before the Council and urged that favorable action be taken on said petition. Another committee of citizens of the Esperanza Common School District No. 7, accompanied by Mre. C. A. Stoermer, also appeared before the Council and presented a petition signed by a large number of residents of said district, protesting the annexation of the above territory, stating that it would shorten their term of school and increase the tax rato. , After hearing the above discussion Councilman Alford moved that the matter be deferred until the next regular meeting. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, 3; nays, none; Councilmen Mueller and Steck absent, 2. A resolution by Travis Post No. 76, American Legion, requesting that the Council designate some week in April as Spring Clean-Up Week, was read, and the matter referred to the City Attorney to have resolution drawn setting aside the week of April 3-9 as Spring Clean-Up Week. The Mayor laid before the Council the following resolution: WHEREAS, the improvements on 213x132 feet (Lot I), Outlot 24, Division "D", Plat 46, in the name of Mrs. M. L. White are assessed at a valuation of $11,350.00; and WHEREAS, upon investigation of the Tax Department of the City of Austin, it appears that the unit of valuation on said improvements should be $3.50 and the depreciation 25% in order to equalize this property with like property throughout the city; Now, therefore, 247 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Tax Assessor & Collector of the City of Austin be and he is hereby authorized to change his roll for the year 1931 accordingly, thus placing the taxable two-thirds valuation on said improvements at $8,730.00. The above resolution was adopted by the following vote: Councilmen Alford, Gillis, Mayor MoFadden, 3; nays, none; Councilmen Mueller and Steck absent, 2. The Mayor laid before the Council the following resolution: WHEREAS, Lot 2, Outlot 25, Division "O", F. H. Jones Subdivision, Plat 25, located at 2302 East Ist Street, owned by H. D. Dickerson has improvements on it which are valued at $1045.00 for taxable purposes on the tax roll for the year 1931; and WHEREAS, these improvements are old and in a bad state of repair, a fair and equitable valuation of same should be placed at $1050.00 full value, or $700.00 taxable two- thirds value; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Tax Assessor & Collector of the City of Austin be and he is hereby authorized to change his roll for the year 1931 to show a valuation for taxable ригровев on the improvements on Lot 2, Outlot 25, Division "O", F. T. Lacey for a permit to construct a commercial driveway across the sidewalk area adjacent to Lots 3 and 4, Block 34 of the Swisher Subdivision in the Isaac Decker League, same being located on the east side of South Congress Avenue between Mary Street and Johanna Street. The property adjacent to the proposed driveway location has been zoned as businesв ритровев, and he proposes to use his property for a drive-in tourist camp. I recommend that a permit be granted subject to the owner of the property constructing a concrete sidewalk adjacent to his property and a concrete ramp and concrete curb returns between the sidewalk and gutter. 248 I recommend that the permit be granted in accordance with the accompanying sketch and suggested resolution. Lacey, owner of a portion of Block 34 of the Swisher Subdivision in the Isaac Decker League, same being located at 1905 South Congress Avenue, has made application to the City Council for a permit to construct a commercial driveway for drive-in tourist camp ритровев; and WHEREAS, the City Council has favorably considered the granting of said request; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted to J. T. Lacey, owner of a portion of Block 34, of the Swisher Subdivision, and being known as 1905 South Congress Avenue, subject to the owner of said property constructing a concrete driveway between the sidewalk and the gutter, said driveway to be constructed according to plan 2-0-443, which plan is hereby made a part of this resolution, and under the direction of the City Engineer. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, 3; nays, none; Councilmen Mueller and Steck absent, 2. A petition signed by the residents of College Court Addition, protesting any change in the Zoning Ordinance that would permit business establishments of any character in said Addition, was read and referred to the City Plan Commission for attention. Councilman Mueller re-entered the Council Chamber. A request from G. E. Matthews, Proprietor of the Varsity Drug Store, asking for one hour parking on East Twenty-first Street from Speedway to the alley west, was read. The Mayor then laid before the Council the following ordinance: AN ORDINANCE REGULATING TRAFFIC ON EAST TWENTY-FIRST STREET, BETWEEN ITS INTERSECTION WITH SPEEDWAY AND THE ALLEY RUNNING NORTH AND SOUTH BETWEEN TWENTIETH AND TWENTY-FIRST STREETS AND SPEEDWAY AND WICHITA STREET, IN THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES HERETOFORE ORDAINED, REPEALING ORDI- NANCES IN CONFLICT, AND PRESCRIBING A PENALTY. The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent The ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. 249 A communication from the Enfield Realty & Home Building Company, asking that the City take over and operate the Westenfield Swimming Pool for the coming season on the same basis as last summer, was read and the matter referred to the City Manager and Superintendent Recreation Department for their recommendation and report back to the Council. The Mayor laid before the Council the following ordinance: AN ORDINANCE AMENDING, IN THE CERTAIN PARTIOULARS HEREINAFTER STATED, AN ORDINANCE ENTITLED: "AN ORDINANCE, REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSIÓN, OGGUΡΑΝΟΥ, EQUIPMENT, USE, HEIGHT, AREA, LOCATION AND MAINTENANCE OF BUILDINGS AND STRUCTURES IN THE CITY OF AUSTIN, TEXAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; DECLARING AND ESTABLISHING FIRE DISTRICTS; PROVIDING PENALTIES FOR THE VIOLATION THEREQF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. " The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading. Councilman Alford moved that the Council postpone action on the bide received earlier in the meeting on a 750-gallon pumper for the Fire Department until the next regular meeting in order to make a further study of same. Motion was seconded by Councilman Gillie and same prevailed by the following vote: Ayes, Councilmen Alford, Gillie, Mayor Mofadden, 3; nays, Councilman Mueller, 1; absent, Councilman Steak, 1. No further business coming before the Council, Councilman Alford moved that the Council recess, subject to call of the Mayor.
